Mustadrak al-Hakim — Hadith 1496

أخبرنا أبو بكر بن إسحاق الفقيه، أخبرنا الحَسَن بن علي بن زياد، حدثنا إبراهيم بن موسى، حدثنا عبد الرزاق، أخبرنا مَعمَر، عن زيد بن أسلم، عن عطاء بن يسار، عن أبي سعيد الخُدْري قال: قال رسول الله ﷺ: "لا تَحِلُّ الصَّدقةُ لغنيٍّ إلَّا لخمسةٍ: لِغازٍ في سبيل الله، أو لعاملٍ عليها، أو لغارمٍ، أو لرجلٍ اشتراها بمالِه، أو لرجلٍ كان له جارٌ مسكينٌ، فتُصُدِّق على المسكين، فأَهدَى المسكينُ للغنيِّ" (1).
هذا حديث صحيحٌ على شرط الشيخين ولم يُخرجاه لإرسال مالك بن أنس إياه عن زيد بن أسلم (2).
Sayyiduna Abu Sa'id al-Khudri (may Allah be pleased with him) narrates that the Messenger of Allah (peace and blessings be upon him) said: "Zakah is not lawful for a wealthy person except in five cases: one who fights in the path of Allah, the collector ('amil) of zakah, a debtor (who is unable to pay), a man who bought it with his own money, or a man who has a poor neighbour to whom charity was given, and then that poor man gave it as a gift to a wealthy person."
This hadith is sahih on the condition of the two Shaykhs, but they did not record it because Malik bin Anas narrated it mursal from Zayd bin Aslam.

(1) حديث صحيح، رجاله ثقات، إلا أنه قد اختلف في وصله وإرساله كما سيأتي. أبو بكر بن إسحاق الفقيه: اسمه أحمد، وإبراهيم بن موسى: هو ابن يزيد الرازي.
Grading: The hadith is sahih and the narrators are thiqah, but there is disagreement about whether it is connected (muttasil) or mursal.
Criticism of a narrator: Abu Bakr bin Ishaq al-Faqih (Ahmad) and Ibrahim bin Musa al-Razi are thiqah.
وأخرجه أحمد 18/ (11538)، وأبو داود (1636)، وابن ماجه (1841) من طريق عبد الرزاق الصنعاني، بهذا الإسناد.
Reference / Source: Ahmad (18/ 11538), Abu Dawud (1636) and Ibn Majah (1841) narrated it through Abd al-Razzaq al-San'ani.
وأخرج أحمد 17/ (11268)، وأبو داود (1637) من طريق عطية بن سعد العوفي، عن أبي سعيد الخدري قال: قال رسول الله ﷺ: "لا تحل الصدقة لغني، إلّا في سبيل الله، أو ابن السبيل، أو جار فقير يتصدق عليه، فيهدي لك أو يدعوك". وعطية العوفي ضعيف.
Grading: Because of the weakness of Atiyyah al-Awfi this chain is weak; Ahmad (17/ 11268) and Abu Dawud (1637) narrated it.

(2) وقد تابع مالكًا على إرساله سفيانُ بن عيينة عند ابن عبد البر في "التمهيد" 5/ 96. أما معمر بن راشد فقد تابعه على وصله: سفيان الثوري عند عبد الرزاق (7152)، والدارقطني في "السنن" (1997)، وفي "العلل" (2279)، والبيهقي 7/ 15، ولا شكَّ أنَّ معمرًا والثوري حافظان، فيكون عطاء قد أرسله مرة ووصله أخرى، وصحَّح وصله البزار في "مسنده" كما في "نصب الراية" 4/ 378، ورجَّح الإرسال الدارقطني في "العلل"، وأبو حاتم كما في "العلل" لابنه (642).
Variation in the chain: Imam Malik and Sufyan bin Uyaynah narrated it as "mursal", whereas Ma'mar bin Rashid and Sufyan al-Thawri narrated it as "muttasil" (connected).
General principle: Since Ma'mar and al-Thawri are both hafiz (master memorisers), it is possible that Ata' narrated it sometimes as mursal and sometimes as connected. Al-Bazzar considered the connected version correct, whereas al-Daraqutni preferred the mursal version.
وقد أعلَّ أبو حاتم وأبو زرعة رواية الثوري بما علّقه أبو داود بإثر الحديث (1636) عن الثوري، عن زيد بن أسلم، قال: حدثني الثبت عن النبي ﷺ. فسألهما ابن أبي حاتم: أليس الثبت هو عطاء؟ ¤ ¤ قالا: لو كان عطاءً لم يُكْنِ عنه.
Defect / Technical note: Abu Hatim and Abu Zur'ah declared al-Thawri's narration defective on the basis of what Abu Dawud recorded (after hadith 1636) from al-Thawri, from Zayd bin Aslam, who said: "The reliable one (al-thabt) told me from the Prophet (peace and blessings be upon him)." When Ibn Abi Hatim asked them whether "the reliable one" was not Ata', they said that if it had been Ata', he would not have alluded to him (without naming him).
