Mustadrak al-Hakim — Hadith 1489

أخبرني أبو النَّضْر محمد بن محمد بن يوسف الفقيه، حدثنا الحسين بن إدريسَ الأنصاريُّ، حدثنا محمد بن عبد الله بن عمّار المَوْصِلي، حدثنا المُعافَى بن عِمْران، عن الأوزاعي، حدثنا الحارث بن يزيد، عن عبد الرحمن بن جُبَير بن نُفَير، عن المُستورِد بن شدَّاد قال: سمعتُ النبي ﷺ يقول: "من كان لنا عاملًا فليكتسِبْ زوجةً، وإن لم يكن له خادمٌ فليكتسِبْ خادمًا، ومن لم يكن له مَسكنٌ فليكتسِبْ مسكنًا". قال (1): وأُخبِرتُ أنَّ النبي ﷺ قال: "مَن اتخذ غيرَ ذلك فهو غالٌّ أو سارق" (2).
هذا حديث صحيح على شرط البخاري، ولم يُخرجاه.
Sayyiduna al-Mustawrid bin Shaddad (may Allah be pleased with him) narrates: I heard the Prophet (peace and blessings be upon him) say: "Whoever takes up an official responsibility on our behalf, if he has no wife, let him marry; if he has no servant, let him take a servant; and if he has no house, let him acquire a house." The narrator said: And I was informed that the Prophet (peace and blessings be upon him) said: "Whoever takes anything (unlawfully) besides that is one who misappropriates, or a thief."
This hadith is sahih on the condition of Bukhari, but the two Shaykhs did not record it.

(1) جاء في "صحيح ابن خزيمة" بإثر الحديث (2370): قال أبو بكر يعني المعافى: وأُخبرتُ أنَّ النبي ﷺ قال: "من اتخذ غير ذلك فهو غالٌّ أو سارق". لكن لم يذكر أحد ممن ترجم للمعافى أنه يكنى أبا بكر، ووقع عند الطبراني في "الكبير" 20/ (725) أنَّ أبا بكر ﵁ قال للنبي ﷺ: أكثرتَ يا رسول الله، فردَّ عليه النبيُّ ﷺ: "من أصاب بعد ذلك فهو غالٌّ". ووقع في "سنن أبي داود" بإثر (2945): قال: قال أبو بكر: أُخبرت أنَّ النبي ﷺ قال: "من اتخذ غير ذلك فهو غالٌّ أو سارق". ولا شكَّ أنَّ هذا الاختلاف هو وهم من بعض الرواة، لكن بالتوفيق بين الروايات يحتمل أنَّ القائل: وأُخبرتُ … إلى آخره: هو المعافى بن عمران، وأنَّ قول النبي ﷺ: "من اتخذ … " إلى آخره، هو جواب لأبي بكر الصديق حين قال: أكثرت يا رسول الله. فهو على هذا معضلٌ، والله تعالى أعلم.
Note / Clarification: In "Sahih Ibn Khuzaymah", immediately after hadith (2370), it is mentioned that Abu Bakr (meaning al-Mu'afa) said: I was told that the Prophet (peace and blessings be upon him) said: "Whoever takes other than that (property) is an embezzler or a thief."
Defect / Technical note: But none of those who wrote al-Mu'afa's biography mentioned that his kunyah was "Abu Bakr". In al-Tabarani's "al-Kabir" (20/ 725) it is stated that Abu Bakr (may Allah be pleased with him) said to the Prophet (peace and blessings be upon him): "O Messenger of Allah, you have said a great deal," and the Prophet (peace and blessings be upon him) said in reply: "Whoever takes anything after that is an embezzler." The same is also mentioned in Sunan Abi Dawud (2945).
Important point: Undoubtedly this discrepancy is an error (wahm) of some of the narrators, but if the narrations are reconciled, it is possible that the one who said "I was told" is al-Mu'afa bin Imran, and that the Prophet's (peace and blessings be upon him) statement was an answer to the question of Abu Bakr al-Siddiq (may Allah be pleased with him). On this basis the narration is "mu'dal" (with two or more consecutive narrators missing from the chain), and Allah knows best.

(2) إسناد الشطر الأول منه صحيح، غير أنَّ تسمية عبد الرحمن بن جبير بن نفير هنا خطأ، صوابه: عبد الرحمن بن جبير، دون ذكر "ابن نفير"، لأنَّ الحارث بن يزيد مصريٌّ، وهو يروي عن عبد الرحمن بن جبير المصري، وليس له رواية عن عبد الرحمن بن جبير بن نفير وهو شامي، وقد جزم الحافظ ابن حجر في "النكت الظراف" 8/ 377 أنَّ عبد الرحمن بن جبير هذا هو المصري. ولم يرد ذكر "ابن نفير" في مصادر التخريج إلّا في بعض روايات الطبراني، والله أعلم.
Grading: Its first part is sahih.
Criticism of a narrator: Naming "Abd al-Rahman bin Jubayr bin Nufayr" here is a mistake; the correct name is just "Abd al-Rahman bin Jubayr" (without "bin Nufayr"). This is because al-Harith bin Yazid is Egyptian and he narrates from Abd al-Rahman bin Jubayr the Egyptian, whereas Abd al-Rahman bin Jubayr bin Nufayr is Syrian and al-Harith has no narration from him. Al-Hafiz Ibn Hajar stated decisively in "al-Nukat al-Ziraf" (8/ 377) that this Abd al-Rahman is the Egyptian one.
وأخرجه أحمد 19/ (18015) و (18017) و (18018) من طريق ابن لهيعة، عن الحارث ¤ ¤ ابن يزيد، عن عبد الرحمن بن جبير، عن المستورد بن شداد، رفعه. وقرن بالموضع الأول والثالث بالحارث بن يزيد: عبد الله بن هبيرة. وقد جاء عنده في جميع مواضعه قول النبي ﷺ في آخره: "من اتخذ … " إلى آخره موصولًا بالحديث. وابن لهيعة سيئ الحفظ.
Reference / Source: Imam Ahmad narrated it (19/ 18015, 18017, 18018) marfu' through Ibn Lahi'ah, from al-Harith bin Yazid, from Abd al-Rahman bin Jubayr, from al-Mustawrid bin Shaddad.
Criticism of a narrator: Ibn Lahi'ah had a poor memory.
وأخرجه كذلك 29/ (18019) من طريق ابن لهيعة، عن عبد الله بن هبيرة وحده - لم يذكر الحارث - عن عبد الرحمن بن جبير، به.
Reference / Source: Imam Ahmad (29/ 18019) narrated it through Ibn Lahi'ah from Abdullah bin Hubayrah alone (without mentioning al-Harith).
وأخرجه أبو داود (2945) عن موسى بن مروان الرقي، عن المعافى، عن الأوزاعي، عن الحارث بن يزيد، عن جبير بن نفير، عن المستورد بن شداد، فذكره. وذكر جبير بن نفير هذا خطأ، صوابه عبد الرحمن بن جبير، كما ذكر المزي في "التحفة" 8/ 377 - 378، والآفة فيه من موسى بن مروان، والله أعلم.
Variation in the chain: Abu Dawud (2945) narrated it through al-Awza'i, from al-Harith bin Yazid, from Jubayr bin Nufayr; but mentioning "Jubayr bin Nufayr" here is a mistake, and the correct name is "Abd al-Rahman bin Jubayr", as al-Mizzi said in "al-Tuhfah" (8/ 377-378). This mistake came from the narrator Musa bin Marwan.
