Mustadrak al-Hakim — Hadith 1461

ما حدَّثَناه أبو العباس محمد بن يعقوب، حدثنا محمد بن إسحاق الصَّغَاني، حدثنا يزيد بن هارون، أخبرنا محمد بن إسحاق وحَبِيب بن [أبي] (2) حَبِيب، عن عمرو بن هَرِم (3)، أنَّ أبا الرِّجال محمد بن عبد الرحمن الأنصاري حدَّثه: أنَّ عمر بن عبد العزيز حين استُخلِف أَرسَل إلى المدينة يلتمس عهدَ النبي ﷺ في الصدقات، فوَجَدَ عند آل عمرو بن حزم كتابَ النبيِّ ﷺ إلى عمرو بن حَزْم في الصَّدقات، ووَجَدَ عند آل عمر بن الخطاب كتابَ عمرَ إلى عُمّاله في الصَّدقات، بمثلِ كتاب النبيِّ ﷺ إلى عمرو بن حَزْم، فأَمَرَ عمرُ بن عبد العزيز عمَّالَه على الصَّدقات أن يأخذوا بما في ذَينِكَ الكتابين، فكان فيهما: صدقةُ الإبل ما زادت على التسعين واحدةً ففيها حِقَّتان إلى عشرين ومئة، فإذا زادت على العشرين ومئة واحدةً ففيها ثلاثُ بنات لبونٍ حتى تبلغ تسعًا وعشرين ومئة، فإذا كانت الإبلُ أكثرَ من ذلك فليس في ما لا يبلُغُ العشرةَ منها شيءٌ حتى تبلُغَ العشرة (1). وأما كتابُ النبيِّ ﷺ لعَمْرو بن حَزْم فإنَّ إسناده من شرط هذا الكتاب، ولذلك ذكرتُ السِّياقةَ بطولها.
Muhammad bin Abd al-Rahman al-Ansari states that when Umar bin Abd al-Aziz assumed the caliphate, he sent word to Madinah that the covenant of the Prophet (peace and blessings be upon him) concerning zakah should be searched for. So they found with the family of Amr bin Hazm the letter which the Prophet (peace and blessings be upon him) had written to Amr bin Hazm concerning zakah, and with the family of Umar bin al-Khattab they found the letter which Sayyiduna Umar had written to his agents, and it was exactly in accordance with the letter of the Prophet (peace and blessings be upon him). So Umar bin Abd al-Aziz ordered that zakah be collected according to it. It was also written in it that when there are more than ninety camels, up to one hundred and twenty, two three-year-old she-camels (hiqqah) are due; and when there are more than one hundred and twenty, up to one hundred and twenty-nine, three two-year-old she-camels (bint labun) are due; and when the camels are more than that, nothing is due on an increase of fewer than ten until (the increase) reaches ten. As for the letter of the Prophet (peace and blessings be upon him) written to Amr bin Hazm, its chain meets the condition of this book, and that is why I have mentioned this entire account.

Note / Clarification: This part had dropped out of the handwritten manuscripts.
Criticism of a narrator: He is Habib bin Abi Habib al-Jarmi, and the name of Abu Habib is Yazid.

(3) تحرف في النسخ إلى: هارون، والمثبت من "تلخيص الذهبي"، وهو الصواب.
Note / Clarification: In the manuscripts this name was distorted into "Harun", while the adopted text is taken from "Talkhis al-Dhahabi", and that is correct.

(1) إسناده - مع إرساله - صحيح، فهو مرسل في حكم المسند، ويقال فيه كما قيل في الذي قبله، فعمر بن عبد العزيز وجد كتابي رسول الله ﷺ وعمر بن الخطاب، فهو وِجادة، وطريقه من طرق التحمل الدالة على الاتصال في عرف علماء المصطلح.
Grading: Its chain, despite being mursal, is sahih, because it is a mursal that is in effect "musnad" (connected).
General principle: The same is said of it as was said of the narration before it. 'Umar bin Abd al-'Aziz found the two letters/documents of the Messenger of Allah (peace and blessings be upon him) and of 'Umar bin al-Khattab, so this is "wijadah" (finding a written document), and in the terminology of the hadith scholars this method is one of the modes of transmission that indicate connection (ittisal) of the chain.
وأخرجه البيهقي 4/ 92 عن أبي عبد الله الحاكم، بهذا الإسناد.
Reference / Source: Al-Bayhaqi (4/92) narrated it via the route of Abu Abdullah al-Hakim, with this same chain.
وأخرجه مطولًا ومختصرًا أبو عبيد القاسم بن سلام في "الأموال" (934) و (947)، والطحاوي في "أحكام القرآن" (616)، وفي "معاني الآثار" 4/ 473، والدارقطني (1987)، والبيهقي 4/ 91 من طريق يزيد بن هارون، عن حبيب بن أبي حبيب وحده، به. لم يذكروا فيه محمد بن إسحاق بن يسار.
Reference / Source: Abu 'Ubayd al-Qasim bin Sallam narrated it at length and in brief in "al-Amwal" (934) and (947), al-Tahawi in "Ahkam al-Qur'an" (616) and "Ma'ani al-Athar" (4/473), al-Daraqutni (1987) and al-Bayhaqi (4/91), via the route of Yazid bin Harun from Habib bin Abi Habib alone. They did not mention Muhammad bin Ishaq bin Yasar in it.
