أخبرَناه أبو بكر محمد بن المؤمَّل، حدثنا الفضل بن محمد الشَّعْراني، حدثنا عبد الله بن محمد النُّفيلي، حدثنا عبَّاد بن العوَّام، عن سفيان بن حسين، عن الزُّهري، عن سالم، عن أبيه قال: كَتَبَ رسول الله ﷺ كتابَ الصدقة، فلم يُخرِجْه إلى عُمَّاله حتى قُبِض، فقَرَنَه بسيفه، فعَمِل به أبو بكر حتى قُبِض، ثم عَمِل به عمرُ حتى قُبِض، فكان فيه: في خمس من الإبل شاةٌ، وفي عشَرةٍ شاتان، وفي خمسَ عَشْرةَ ثلاثُ شِياه، وفي عشرين أربعُ شِياه، وفي خمسٍ وعشرين بنتُ مَخَاض إلى خَمسٍ وثلاثين، فإذا زادت واحدةً ففيها بنتُ لَبونٍ إلى خمسٍ وأربعين، فإذا زادت واحدةً ففيها حِقَّة إلى ستين، فإذا زادت واحدةً ففيها جَذَعة إلى خمسٍ وسبعين، فإذا زادت واحدةً ففيها بنتا لَبونٍ إلى تسعين، فإذا زادت واحدةً ففيها حِقَّتان إلى عشرين ومئة، فإن كانت الإبلُ أكثرَ من ذلك ففي كلِّ خمسين حِقَّةٌ، وفي كلِّ أربعين بنتُ لَبون. وفي الغنم في كلِّ أربعين شاةً شاةٌ إلى عشرين ومئة، فإذا زادت واحدةً فشاتان إلى مئتين، فإذا زادت واحدةً على المئتين ففيها ثلاثُ شِياه إلى ثلاث مئة، فإن كانت الغنم أكثرَ من ذلك ففي كل مئة شاةٍ شاةٌ، وليس فيها شيءٌ حتى تَبلُغَ المئةَ. ولا يُفرَّق بين مُجتَمِع، ولا يُجمَع بين متفرِّقٍ مخافةَ الصدقة، وما كان من خَليطَينِ فإنهما يتراجعان بالسَّوِيّة. ولا يُؤخَذ في الصدقة هَرِمةٌ ولا ذاتُ عيبٍ. قال الزهري: إذا جاء المصَدِّقُ قُسِمت الشاءُ أثلاثًا: ثلثًا شِرارٌ، وثلثًا خِيارٌ، وثلثًا وَسَطٌ (1)، فيأخذُ المصَدِّقُ من الوسط. ولم يَذكُر الزهريُّ البقر (2). هذا حديث كبيرٌ في هذا الباب، يشهد بكثرة الأحكام التي في حديث ثُمامة عن أنس، إلّا أنَّ الشيخين لم يخرجا لسفيان بن حسين الواسطي في الكتابين، وسفيان ابن حسين أحد أئمة الحديث، وثَّقه يحيى بن معين، ودخل خُرَاسان مع يزيد بن المهلَّب، ودخل نيسابورَ، سمع منه جماعةٌ من مشايخنا القَهَنْدَزِيُّون، مثل مُبشِّر بن عبد الله بن رَزِين وأخيه عمر بن عبد الله وغيرهما، ويُصحِّحه على شرط الشيخين حديثُ عبد الله بن المبارك عن يونس بن يزيد عن الزُّهري، وإن كان فيه أدنى إرسالٍ فإنه شاهدٌ صحيح لحديث سفيان بن حسين:
Sayyiduna Abdullah bin Umar (may Allah be pleased with them both) states that the Messenger of Allah (peace and blessings be upon him) had a document written containing the rulings of zakah, but he (peace and blessings be upon him) passed away before he could send it to his agents (governors). He (peace and blessings be upon him) had kept it together with his sword. Then Sayyiduna Abu Bakr (may Allah be pleased with him) acted according to it until his death, and then Sayyiduna Umar (may Allah be pleased with him) also acted upon it. In it was written: For five camels one sheep is due, for ten two, for fifteen three, and for twenty four sheep. From twenty-five to thirty-five camels, a one-year-old she-camel (bint makhad); if they increase by even one, then from thirty-six to forty-five, a two-year-old she-camel (bint labun); if they increase by one, then from forty-six to sixty, a three-year-old she-camel (hiqqah); if they increase by one, then from sixty-one to seventy-five, a four-year-old she-camel (jadha'ah); if they increase by one, then from seventy-six to ninety, two two-year-old she-camels (bint labun); if they increase by one, then from ninety-one to one hundred and twenty, two three-year-old she-camels (hiqqah). When there are more than that, one hiqqah is due for every fifty and one bint labun for every forty. For sheep, from forty to one hundred and twenty, one sheep; from one hundred and twenty-one to two hundred, two sheep; from two hundred and one to three hundred, three sheep; and when there are more than that, one sheep for every hundred. For fear of zakah, separate animals are not to be gathered together, nor are animals kept together to be separated, and partners will divide (the liability) between themselves equally. An old or defective animal will not be taken in zakah. Al-Zuhri says: When the zakah collector comes, the sheep are to be divided into three parts: one part inferior, one part the best and one part average; then the collector takes the zakah from the average part.
Al-Zuhri did not mention cattle in it. This is a great hadith in this chapter, supporting the many rulings found in the narration of Thumamah from Sayyiduna Anas; however, the two Shaykhs did not take the narrations of Sufyan bin Husayn al-Wasiti in their two books, even though Sufyan bin Husayn is one of the imams of hadith. Yahya bin Ma'in declared him reliable. He came to Khurasan with Yazid bin al-Muhallab and also came to Nishapur, where a group of our shaykhs from al-Quhandiz heard from him, such as Mubashshir bin Abdullah bin Razin, his brother Umar bin Abdullah, and others. And the narration of Abdullah bin al-Mubarak from Yunus bin Yazid from al-Zuhri establishes it as authentic on the condition of the two Shaykhs; even though there is a slight irsal (break in the chain) in it, it is an authentic supporting narration (shahid) for the hadith of Sufyan bin Husayn:

(1) كذا في (ز) و (ب) بنصب "ثلثًا" ورفع ما بعدها في الكلمات الثلاث، وهو الموافق لما في "السنن الكبرى" للبيهقي 4/ 88 بروايته عن المصنف، وفي (ص) و (ع) بنصب الجميع، وكلاهما له وجه في العربية. Reference / Source: In manuscripts (z) and (b), the word "thuluthan" is in the accusative and the three words after it are in the nominative, and this agrees with al-Bayhaqi's "al-Sunan al-Kubra" (4/88), which he narrated from the author (al-Hakim). Variation in the chain: Whereas in manuscripts (s) and ('a) all the words are in the accusative, and both forms are permissible according to Arabic grammar.
(2) حديث صحيح، رجاله ثقات إلا أن سفيان بن حسين في روايته عن الزهري كلام، وقد توبع. سالم: هو ابن عبد الله بن عمر بن الخطاب. Grading: This hadith is sahih; all its narrators are thiqah, except that there is criticism of Sufyan bin Husayn's narration from Imam al-Zuhri, Corroborating chains and supporting reports: however, he has been corroborated (mutaba'ah). Salim is Salim bin Abdullah bin 'Umar bin al-Khattab. وأخرجه أبو داود (1568) عن عبد الله بن محمد النفيلي، بهذا الإسناد. Reference / Source: Abu Dawud (1568) narrated it through Abdullah bin Muhammad al-Nufayli, with this same chain. وأخرجه أحمد 8/ (4632)، والترمذي (621) من طريق عباد بن العوام، به. قال الترمذي: هذا حديث حسن، والعمل على هذا عند عامة الفقهاء. واقتصر أحمد على أول الحديث فقط ¤ ¤ إلى قوله: "وفي خمس وعشرين ابنة مخاض"، ثم قال الإمام أحمد بإثره فيما رواه عنه ابنه عبد الله: ثم أصابتني عِلَّةٌ في مجلس عباد بن العوام، فكتبت تمام الحديث، فأحسبني لم أفهم بعضه، فشككتُ في بقية الحديث، فتركتُه. Reference / Source: Imam Ahmad (4632) and al-Tirmidhi (621) narrated it via the route of 'Abbad bin al-'Awwam. Grading: Al-Tirmidhi says that this hadith is hasan and that most jurists act upon it. Details of the narration: Imam Ahmad limited himself to the first part of the hadith, up to "and for twenty-five, a bint makhad". Then, according to what his son Abdullah narrated from him, Imam Ahmad said after it: "Then an illness came upon me in the gathering of 'Abbad bin al-'Awwam. I wrote down the whole hadith, but I think I did not understand part of it properly, so, being in doubt about the rest of the hadith, I left it out." وأخرجه أحمد (4634)، وأبو داود (1569) من طريق محمد بن يزيد الواسطي، عن سفيان بن حسين، به. Reference / Source: Ahmad (4634) and Abu Dawud (1569) narrated it through Muhammad bin Yazid al-Wasiti from Sufyan bin Husayn. وأخرجه ابن ماجه (1798) و (1805) من طريق سليمان بن كثير، عن الزهري، به. وذكر سليمان في روايته أنَّ الزهري قال: أقرأني سالم كتابًا .. إلى آخره. وسليمان بن كثير في روايته عن الزهري كلام أيضًا، إلّا أنه وسفيان بن حسين يقوي أحدهما الآخر. Reference / Source: Ibn Majah (1798) and (1805) narrated it via the route of Sulayman bin Kathir from al-Zuhri. Sulayman mentioned in his narration that Imam al-Zuhri said: "Salim read a document out to me", to the end. Criticism of a narrator: There is also criticism of Sulayman bin Kathir's narration from al-Zuhri, Corroborating chains and supporting reports: but he and Sufyan bin Husayn strengthen each other. وأخرجه بأخصر مما هنا: ابن ماجه (1807) من طريق يزيد بن عبد الرحمن، عن أبي هند، عن نافع، عن ابن عمر. لم يذكر زكاة الإبل. وهذا إسناد ضعيف لجهالة أبي هند. Reference / Source: Ibn Majah (1807) narrated it more briefly than here via the route of Yazid bin Abd al-Rahman from Abu Hind from Nafi' from Ibn 'Umar, without mentioning the zakat of camels. Grading: This chain is da'if because Abu Hind is majhul (unknown). ويشهد للحديث ما صحَّ من أحاديث هذا الباب فيما سلف قبله وفيما سيأتي بعده. Corroborating chains and supporting reports: This hadith is supported by the sahih hadiths on this topic that have preceded or will come later. ونقل البيهقي في "السنن" 4/ 88 عن الترمذي أنه قال في "العلل": سألت محمد بن إسماعيل عن هذا الحديث فقال: أرجو أن يكون محفوظًا، وسفيان بن حسين صدوق. Reference / Source: Al-Bayhaqi transmitted in "al-Sunan" (4/88) from Imam al-Tirmidhi that he said in "al-'Ilal": Technical note / Defect ('illah): I asked Muhammad bin Isma'il (Imam al-Bukhari) about this hadith and he said: "I hope that it is preserved (mahfuz), and Sufyan bin Husayn is saduq (truthful)."
