Mustadrak al-Hakim — Hadith 1446

أخبرنا أبو بكر بن إسحاق الفقيه، أخبرنا عبد الله بن أحمد بن حنبل، حدثني عمرو بن محمد النَّاقِد، حدثنا يحيى بن عيسى الرَّمْلي، عن الأعمش، عن عبد الله بن مُرَّة، عن مسروقٍ، قال: قال (1) عبدُ الله: آكلُ الربا، ومُوكِلُه، وشاهداهُ إذا عَلِماهُ، والواشِمةُ والمُوتَشِمةُ، ولاوِي الصَّدقةِ، والمرتدُّ أعرابيًّا بعد الهجرة، مَلعُونُون (2) على لسانِ محمدٍ ﷺ يومَ القيامة (3).
هذا حديث صحيح على شرط مسلم، فقد احتجَّ بيحيى بن عيسى الرَّمْلي، ولم يُخرجاه.
Sayyiduna Abdullah bin Mas'ud (may Allah be pleased with him) states: The one who consumes usury (riba), the one who pays it, its two witnesses if they know it to be usury, the woman who tattoos and the woman who gets herself tattooed, the one who procrastinates in (paying) zakah, and the one who returns to the ignorant life of the desert Bedouin after having emigrated (hijrah): all of these have been declared accursed on the blessed tongue of Muhammad (peace and blessings be upon him) on the Day of Resurrection.
This hadith is sahih (authentic) on the condition of Imam Muslim, since he used Yahya bin Isa al-Ramli as evidence, but the two Shaykhs did not record it.

(1) تحرَّف في الطبعة الهندية إلى: "ما" ليصبح المعنى: ما عَبَدَ اللهَ آكلُ … ! وتبعتها على هذا التحريف كثير من طبعات "المستدرك".
Technical note / Defect ('illah): (1) In the Indian edition the insertion of "ma" changed the meaning entirely, and most editions of al-Hakim fell into this same distortion.

(2) في النسخ الخطية: ملعون، والمثبت من "السنن الكبرى" للبيهقي حيث رواه من طريق المصنف بإسناده ومتنه، ومن سائر مصادر التخريج.
Technical note: (2) The manuscripts read "mal'un"; the adopted reading is taken from al-Bayhaqi and the other sources.

(3) ضعيف بهذه السياقة، يحيى بن عيسى الرملي وإن وثقه العجلي، وأحسن أحمد الثناء عليه، فقد قال النسائي: ليس بالقوي، وقال ابن معين مرة: ليس بشيء، وقال مرة: لا يكتب حديثه، وقال مرة: ضعيف، وقال ابن عدي: عامة ما يرويه لا يتابع عليه، وقد لخص ابن حجر هذه الأقوال بقوله: صدوق يخطئ ورمي بالتشيع. قلنا: وقد تفرَّد برواية هذا الحديث عن الأعمش عن عبد الله بن مرة عن مسروق عن ابن مسعود، وخالفه جمهور أصحاب الأعمش الثقات فرووه عن الأعمش عن عبد الله بن مرة عن الحارث بن عبد الله الأعور عن ابن مسعود، والحارث الأعور ضعيف. وانظر: "العلل" للدارقطني (692).
Grading: (3) In this wording the narration is da'if; Yahya bin 'Isa al-Ramli alone brought it with the chain Masruq from Ibn Mas'ud, whereas according to the trustworthy narrators the correct chain is al-Harith al-A'war from Ibn Mas'ud, and al-Harith al-A'war is weak.
أما حديث مسروق عن ابن مسعود فقد أخرجه البيهقي 9/ 19 عن أبي عبد الله الحاكم، بهذا الإسناد. وقال بإثره: تفرد به يحيى بن عيسى هكذا.
Reference / Source: Al-Bayhaqi transmitted the narration of Masruq through al-Hakim and said that Yahya bin 'Isa is alone in it.
وأخرجه ابن خزيمة (2250) عن علي بن سهل الرملي، عن يحيى بن عيسى الرملي، به.
Reference / Source: Ibn Khuzaymah (2250) narrated it via the chain of Yahya al-Ramli.
وأما حديث الحارث الأعور فقد أخرجه أحمد 6/ (3881)، وابن حبان (3252) من طريق سفيان الثوري، وأحمد 7/ (4428)، والنسائي (5512) و (8666) و (9333) من طريق شعبة، وأحمد 7/ (4090) عن يحيى بن سعيد القطان ووكيع، أربعتهم (الثوري وشعبة والقطان ووكيع) عن الأعمش، عن عبد الله بن مرة، عن الحارث الأعور، عن ابن مسعود، بمتنه سواء.
Grading: The narration of al-Harith al-A'war was narrated by Sufyan al-Thawri, Shu'bah, Yahya al-Qattan and Waki' via the chain of al-A'mash, with the same text.
وقد صحَّ بعضه من أوجه أخرى عن عبد الله بن مسعود:
Corroborating chains and supporting reports: Some parts of this hadith are established from Ibn Mas'ud through other sahih chains:
فقد أخرج مسلم (1597) من طريق علقمة، عن ابن مسعود قال: لعن رسول الله ﷺ آكل الربا ¤ ¤ وموكله.
Reference / Source: It is narrated in Muslim (1597) that he (peace and blessings be upon him) cursed the one who consumes riba (usury) and the one who pays it.
وأخرج أحمد 7/ (4283)، والنسائي (5511) من طريق أبي نعيم الفضل بن دكين، وأحمد (4284) عن أسود بن عامر، و (4403) عن محمد بن عبد الله بن الزبير، ثلاثتهم عن سفيان الثوري، عن أبي قيس عبد الرحمن بن ثروان، عن الهزيل بن شرحبيل الأودي، عن ابن مسعود قال: لعن رسول الله ﷺ الواشمة والمتوشمة، والواصلة والموصولة، والمُحِل والمحلَّل له، وآكل الربا وموكله. وهذا إسناد حسن من أجل عبد الرحمن بن ثروان.
Grading: Ahmad and al-Nasa'i narrated it via the chain of Sufyan al-Thawri from Abu Qays, which mentions the curse on the one who tattoos, the one who joins hair, the one who performs tahlil marriage, and the one who consumes riba. This chain is hasan.
وأخرج أحمد 6/ (3725) و (3737) و (3809) و 7/ (4327)، وأبو داود (3333)، والترمذي (1206)، وابن ماجه (2277)، وابن حبان (5025) من طرق عن سماك بن حرب، عن عبد الرحمن بن عبد الله بن مسعود، عن أبيه قال: لعن رسول الله ﷺ آكل الربا وموكله وشاهديه وكاتبه. قال الترمذي: حديث حسن صحيح.
Grading: The narration via the chain of Simak bin Harb, which also mentions the curse on the witnesses and the scribe of riba, was declared hasan sahih by Imam al-Tirmidhi.
وفي الباب عن أبي جحيفة عند البخاري (5347): لعن النبي ﷺ الواشمة والمستوشمة، وآكل الربا وموكله، ونهى عن ثمن الكلب، وكسب البغي، ولَعَنَ المصورين.
Reference / Source: It is narrated in al-Bukhari (5347) from Abu Juhayfah (may Allah be pleased with him) that he (peace and blessings be upon him) cursed the woman who tattoos and the one who has herself tattooed, and the one who consumes riba and the one who pays it; he forbade the price of a dog and the earnings of a prostitute, and he cursed the image-makers.
وعن جابر بن عبد الله عند مسلم (1598): لعن رسول الله ﷺ آكل الربا وموكله وكاتبه وشاهديه، وقال: هم سواء.
Reference / Source: It is narrated in Muslim (1598) from Jabir (may Allah be pleased with him) that he (peace and blessings be upon him) declared all those involved in a transaction of riba to be equal.
قوله: "لاوي الصدقة" اسم فاعل من لواه، أي: صَرَفه، والمراد: مانع الصدقة. قاله السندي في حاشيته على "سنن النسائي".
(Note / Clarification): "Lawi al-sadaqah": this means one who withholds zakat or delays paying it.
