Mustadrak al-Hakim — Hadith 1442

حدثنا أبو علي الحسين بن عليٍّ الحافظ، حدثنا أبو العباس أحمد بن محمد الهَمْداني، حدثنا أبو شَيْبة إبراهيم بن عبد الله، حدثنا خالد بن مَخلَد، حدثنا سليمان بن بلال، عن عمرو بن أبي عمرو، عن عِكْرمة، عن ابن عباس قال: قال رسولُ الله ﷺ: "ليس عليكم في غَسْلِ ميِّتِكم غُسْلٌ إذا غَسَّلتُموه، فإنَّ ميِّتَكم ليس بنَجِسٍ، فَحَسْبُكم أن تَغْسِلوا أيديَكم" (1).
هذا حديثٌ صحيحٌ على شرط البخاري، ولم يُخرجاه. وفيه رَفْضٌ لحديثٍ مختلَفٍ فيه على محمد بن عمرٍو بأسانيد: "مَن غسَّلَ ميتًا فليغتسل" (1). [أول كتاب الزكاة]
It is narrated from Sayyiduna Ibn Abbas (may Allah be pleased with them both) that the Messenger of Allah (peace and blessings be upon him) said: "When you wash one of your deceased, a ritual bath (ghusl) is not obligatory upon you, for your deceased is not impure; rather, it is sufficient for you to wash your hands."
This hadith is sahih (authentic) on the condition of Imam Bukhari, but the two Shaykhs did not record it. It contains a refutation of the disputed hadith narrated from Muhammad bin Amr, in whose various chains it is stated: "Whoever washes a deceased person should take a ritual bath himself." (1) صحيح موقوفًا، وخالد بن مخلد - وهو القطواني -: له مناكير، وقد خالف الثقات، فقد رواه هنا عن سليمان بن بلال مرفوعًا، ورووه عن سليمان موقوفًا، وهو الصواب كما سيأتي.
Grading: (1) This narration is sahih as mawquf on Ibn Abbas; Khalid bin Makhlad went against the trustworthy narrators by reporting it as marfu', whereas the correct position is that it is mawquf, as will be made clear below.
وأخرجه البيهقي 1/ 306 عن أبي عبد الله الحاكم، بهذا الإسناد، مرفوعًا. وقال بإثره: هذا ضعيف، والحمل فيه على أبي شيبة كما أظن. قلنا: وأبو شيبة، وهو إبراهيم بن أبي بكر بن أبي شيبة، أقوى وأوثق من خالد بن مخلد، فالحملُ فيه على خالد أولى من الحمل عليه، والله أعلم.
Grading: Al-Bayhaqi (1/306) narrated it as marfu' via the chain of al-Hakim and declared it weak, placing the blame on Abu Shaybah, but in our view Khalid bin Makhlad is more responsible for it.
وأخرجه مرفوعًا كذلك: ابن شاهين في "ناسخ الحديث ومنسوخه" (38) و (304)، والدارقطني (1839) عن أحمد بن محمد بن سعيد الهمداني، به.
Reference / Source: Ibn Shahin and al-Daraqutni (1839) also narrated it as marfu'.
وخالف خالدًا في رفعه: أبو سلمة منصور بن سلمة عند ابن شاهين (39) و (305)، والبيهقي 1/ 306، ومعلَّى بن منصور عند البيهقي 1/ 306، وعبد الله بن وهب عند البيهقي 3/ 398، فرووه - وهم ثقات - عن سليمان بن بلال، به موقوفًا علي ابن عباس.
Grading: In contrast to Khalid bin Makhlad, trustworthy narrators such as Abu Salamah, Mu'alla bin Mansur and Abdullah bin Wahb narrated it from Sulayman bin Bilal as mawquf on Ibn Abbas.
ويؤيد وقفه ما رواه عبد الرزاق (6101) عن ابن جريج، عن عطاءٍ قال: سئل ابن عباس: أعلى من غسل ميتًا غسل؟ قال: لا، قد إذًا نجَّسوا صاحبهم، ولكن وضوءٌ.
Corroborating chains and supporting reports: The narration of Abd al-Razzaq (6101) supports its being mawquf: Ibn Abbas (may Allah be pleased with them) said, "There is no ghusl on the one who washes the deceased, otherwise your companion (the deceased) would be deemed impure; rather, wudu suffices."

(1) تعقبه الذهبي في "تلخيص المستدرك" قائلًا: بل نعمل بهما فيستحب الغسل. قلنا: وحديث "من غسل ميتًا فليغتسل" أخرجه أحمد 13/ (7689)، وأبو داود (3161)، وابن ماجه (1463)، والترمذي (993)، وابن حبان (1161) من حديث أبي هريرة مرفوعًا، ورجاله ثقات إلّا أنه اختلف في رفعه ووقفه أيضًا. انظر لزامًا تعليقنا على "مسند أحمد" (7689).
Grading: (1) Al-Dhahabi, critiquing al-Hakim in al-Talkhis, said that both can be acted upon to the extent of ghusl being recommended. The marfu' narration of Abu Hurayrah ("Whoever washes a deceased person, let him take a bath") is narrated by trustworthy narrators in Ahmad (13/7689) and others, but there is also a difference over whether it is marfu' or mawquf.
قال الترمذي: وقد اختلف أهل العلم في الذي يغسل الميت، فقال بعض أهل العلم من أصحاب النبي ﷺ وغيرهم: إذا غسل ميتًا فعليه الغسل، وقال بعضهم: عليه الوضوء، وقال مالك: أستحب الغسل من غسل الميت ولا أرى ذلك واجبًا، وهكذا قال الشافعي، وقال أحمد: أرجو أنه لا يجب عليه الغسل، وإنما الوضوء فأقل ما قيل فيه، وقال إسحاق: لا بد من الوضوء. وقد روي عن عبد الله بن المبارك أنه قال: لا يغتسل ولا يتوضأ من غسل الميت.
Grading: Imam al-Tirmidhi says that the Companions and the Successors differed on this: Imam Malik and al-Shafi'i regard it as recommended, Imam Ahmad and Ishaq regard wudu as necessary, while according to Ibn al-Mubarak neither ghusl nor wudu is required.
