حَدَّثَنَا عَبْدَانُ بْنُ أَحْمَدَ، ثنا مُحَمَّدُ بْنُ عُبَيْدِ بْنِ حِسَابٍ، ثنا حَمَّادُ بْنُ زَيْدٍ، عَنْ أَيُّوبَ، قَالَ: كَتَبَ إِلَيَّ يَعْلَى بْنُ حَكِيمٍ: إِنِّي سَمِعْتُ سُلَيْمَانَ بْنَ يَسَارٍ، يُحَدِّثُ، عَنْ رَافِعِ بْنِ خَدِيجٍ، قَالَ: كُنَّا نُحَاقِلُ الْأَرْضَ فَنُكْرِيهَا بِالثُّلُثِ وَالرُّبُعِ وَالطَّعَامِ الْمُسَمَّى فَدَخَلَ عَلَيَّ بَعْضُ عُمُومَتِي فَقَالَ: «إِنَّ رَسُولَ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ نَهَانَا الْيَوْمَ عَنْ أَمْرٍ كَانَ لَنَا نَافِعًا وَطَاعَةُ اللهِ وَرَسُولُهُ أَنْفَعُ كُنَّا نُحَاقِلُ الْأَرْضَ فَنُكْرِيهَا بِالثُّلُثِ وَالرُّبُعِ وَالطَّعَامِ الْمُسَمَّى، فَنَهَانَا أَنْ نُكْرِيَهَا بِالرُّبُعِ وَالثُّلُثِ وَالطَّعَامِ الْمُسَمَّى، وَأَمَرَ رَبَّ الْأَرْضِ أَنْ يَزْرَعَهَا أَوْ يُزْرِعَهَا»
It is narrated from Sayyiduna Rafi' bin Khadij (may Allah be pleased with him) that he said: We used to rent out land by way of 'muhaqalah' for a third, a quarter or a fixed quantity of grain. One of my paternal uncles came to me and said: The Messenger of Allah (peace and blessings be upon him) has today forbidden us something that was beneficial to us, yet obedience to Allah and His Messenger is more beneficial. We used to rent out land by way of 'muhaqalah' for a third, a quarter or a fixed quantity of grain, and he forbade us to rent it out for a quarter, a third or a fixed quantity of grain, and he ordered the owner of the land to cultivate it himself or have someone else cultivate it.
