بَابُ قتل الكلاب

قَالَ أَبُو دَاوُدَ : حَدَّثَنَا هِشَامٌ ، عَنْ يَحْيَى ، عَنْ بِنْتِ أَبِي رَافِعٍ رَضِيَ اللهُ عَنْهَا قَالَتْ : إِنَّ النَّبِيَّ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ دَفَعَ إِلَى أَبِي رَافِعٍ رَضِيَ اللهُ عَنْهُ الْعَنَزَةَ ، وَأَمَرَهُ أَنْ يَقْتُلَ كِلَابَ الْمَدِينَةِ ، فَقَتَلَهَا إِلَّا كَلْبًا ، فَجَاءَ إِلَى النَّبِيِّ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ فَأَمَرَهُ بِقَتْلِهِ .
2328 \ 2 - وَقَالَ الْحَارِثُ : حَدَّثَنَا عَبْدُ الْعَزِيزِ بْنُ أَبَانَ ، ثَنَا هِشَامٌ ، بِهِ .
2328 \ 3 - وَقَالَ أَبُو يَعْلَى : حَدَّثَنَا مُحَمَّدُ بْنُ أَبِي بَكْرٍ ، ثَنَا هَارُونُ الْخَزَّازُ ، ثَنَا عَلِيُّ بْنُ الْمُبَارَكِ ، ثَنَا يَحْيَى بْنُ [أَبِي] كَثِيرٍ ، عَنْ بِنْتِ أَبِي رَافِعٍ رَضِيَ اللهُ عَنْهَا ، نَحْوَهُ .
2328 \ 2 - وَقَالَ الْحَارِثُ : حَدَّثَنَا عَبْدُ الْعَزِيزِ بْنُ أَبَانَ ، ثَنَا هِشَامٌ ، بِهِ .
2328 \ 3 - وَقَالَ أَبُو يَعْلَى : حَدَّثَنَا مُحَمَّدُ بْنُ أَبِي بَكْرٍ ، ثَنَا هَارُونُ الْخَزَّازُ ، ثَنَا عَلِيُّ بْنُ الْمُبَارَكِ ، ثَنَا يَحْيَى بْنُ [أَبِي] كَثِيرٍ ، عَنْ بِنْتِ أَبِي رَافِعٍ رَضِيَ اللهُ عَنْهَا ، نَحْوَهُ .
It is narrated from the daughter of Abu Rafi' (may Allah be pleased with her) that the Prophet (peace and blessings be upon him) gave Sayyiduna Abu Rafi' (may Allah be pleased with him) a short spear and ordered him to kill the dogs of Madinah. Sayyiduna Abu Rafi' (may Allah be pleased with him) killed (most of) the dogs except one dog. Then he came to the Prophet (peace and blessings be upon him), and he (peace and blessings be upon him) ordered him to kill that (remaining) dog as well.
Imam al-Harith also narrated this same hadith through Abd al-Aziz bin Aban from Hisham with the same chain.
And Imam Abu Ya'la also recorded a similar narration through Muhammad bin Abi Bakr, Harun al-Khazzaz, Ali bin al-Mubarak and Yahya bin Abi Kathir from the daughter of Abu Rafi' (may Allah be pleased with her).
Imam al-Harith also narrated this same hadith through Abd al-Aziz bin Aban from Hisham with the same chain.

وَقَالَ أَبُو بَكْرٍ : حَدَّثَنَا ابْنُ نُمَيْرٍ ، عَنْ مُوسَى بْنِ عُبَيْدَةَ ، ثَنَا أَبَانُ بْنُ صَالِحٍ ، عَنِ الْقَعْقَاعِ بْنِ حَكِيمٍ ، عَنْ سَلْمَى أُمِّ رَافِعٍ ، عَنْ أَبِي رَافِعٍ رَضِيَ اللهُ عَنْهُ قَالَ : جَاءَ جِبْرِيلُ عَلَيْهِ السَّلَامُ ، فَاسْتَأْذَنَ عَلَى رَسُولِ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ ، فَأَذِنَ لَهُ فَأَبْطَأَ عَلَيْهِ ، فَأَخَذَ رَسُولُ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ رِدَاءَهُ ، فَقَامَ إِلَيْهِ وَهُوَ قَائِمٌ بِالْبَابِ ، فَقَالَ رَسُولُ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ : " قَدْ أَذِنَّا " فَقَالَ : أَجَلْ يَا رَسُولَ اللهِ ، وَلَكِنَّا لَا نَدْخُلُ بَيْتًا فِيهِ صُورَةٌ وَلَا كَلْبٌ ، فَنَظَرُوا فَوَجَدُوا جَرْوًا فِي بَعْضِ بُيُوتِهِمْ ، فَقَالَ أَبُو رَافِعٍ رَضِيَ اللهُ عَنْهُ : فَأَمَرَنِي رَسُولُ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ حِينَ أَصْبَحْتُ ، فَلَمْ أَدَعْ فِي الْمَدِينَةِ كَلْبًا إِلَّا قَتَلْتُهُ ، فَإِذَا أَنَا بِامْرَأَةٍ قَاصِيَةٍ وَلَهَا كَلْبٌ يَنْبَحُ عَنْهَا ، فَكَأَنِّي رَحِمْتُهَا فَتَرَكْتُهُ وَجِئْتُهُ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ فَأَخْبَرْتُهُ ، فَأَمَرَنِي أَنْ أَقْتُلَهُ ، فَرَجَعْتُ إِلَى الْكَلْبِ فَقَتَلْتُهُ ، قَالَ : فَقَالَ النَّاسُ : مَا يَحِلُّ لَنَا يَا رَسُولَ اللهِ مِنْ هَذِهِ الْأُمَّةِ الَّتِي أَمَرْتَ بِقَتْلِهَا ؟ ، فَأَنْزَلَ اللهُ تَبَارَكَ وَتَعَالَى : وَمَا عَلَّمْتُمْ مِنَ الْجَوَارِحِ مُكَلِّبِينَ " .
2329 \ 2 - رَوَاهُ أَبُو يَعْلَى ، عَنْ أَبِي بَكْرٍ بِطُولِهِ .
2329 \ 3 - قَالَ : وَحَدَّثَنَا الْمُقَدَّمِيُّ ، حَدَّثَنَا زَيْدُ بْنُ الْحُبَابِ ، ثَنَا مُوسَى بْنُ عُبَيْدَةَ بِتَمَامِهِ وَزَادَ : فَقَالَ رَسُولُ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ : إِذَا أَرْسَلَ الرَّجُلُ كَلْبَهُ وَذَكَرَ اسْمَ اللهِ فَلْيَأْكُلْ مَا لَمْ يَأْكُلْ .
2329 \ 2 - رَوَاهُ أَبُو يَعْلَى ، عَنْ أَبِي بَكْرٍ بِطُولِهِ .
2329 \ 3 - قَالَ : وَحَدَّثَنَا الْمُقَدَّمِيُّ ، حَدَّثَنَا زَيْدُ بْنُ الْحُبَابِ ، ثَنَا مُوسَى بْنُ عُبَيْدَةَ بِتَمَامِهِ وَزَادَ : فَقَالَ رَسُولُ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ : إِذَا أَرْسَلَ الرَّجُلُ كَلْبَهُ وَذَكَرَ اسْمَ اللهِ فَلْيَأْكُلْ مَا لَمْ يَأْكُلْ .
It is narrated from Sayyiduna Abu Rafi' (may Allah be pleased with him) that Jibril (peace be upon him) came and asked permission of the Messenger of Allah (peace and blessings be upon him) (to enter the house). He (peace and blessings be upon him) gave him permission, but Jibril (peace be upon him) was slow (to come in). The Messenger of Allah (peace and blessings be upon him) took his cloak and went towards him, while Jibril (peace be upon him) was standing at the door. The Messenger of Allah (peace and blessings be upon him) said: "We have (indeed) given permission." Jibril (peace be upon him) said: "Yes, O Messenger of Allah, but we do not enter a house in which there is an image or a dog." Then the Companions looked and found a puppy in one of their houses. Sayyiduna Abu Rafi' (may Allah be pleased with him) said: "When morning came, the Messenger of Allah (peace and blessings be upon him) ordered me not to leave any dog in Madinah without killing it." Abu Rafi' (may Allah be pleased with him) says: "Then I saw a woman of a remote area who had a dog barking in her defence, and it was as if I felt pity for her, so I left it, and I came to him (peace and blessings be upon him) and told him. He (peace and blessings be upon him) ordered me to kill it (as well). So I went back and killed that dog." Abu Rafi' (may Allah be pleased with him) said: "(After this incident) the people asked: 'O Messenger of Allah, what is lawful for us from this nation (that is, this species of dogs) which you have ordered to be killed?' Then Allah, the Blessed and Exalted, revealed this verse: (And those hunting animals you have trained as hounds) [Surah al-Ma'idah: 4]."
Abu Ya'la narrated this hadith from Abu Bakr in full.
Al-Muqaddami said: Zayd bin al-Hubab narrated to us; he said: Musa bin Ubaydah narrated it to us in full, and added in it: The Messenger of Allah (peace and blessings be upon him) said: "When a man sends out his (hunting) dog (to hunt) and mentions the name of Allah, let him eat that (game), as long as the dog has not eaten from it itself."

وَقَالَ الْحَارِثُ : حَدَّثَنَا رَوْحُ بْنُ عُبَادَةَ ، ثَنَا ابْنُ جُرَيْجٍ ، ثَنَا الْعَبَّاسُ بْنُ أَبِي خِدَاشٍ ، عَنِ الْفَضْلِ بْنِ عُبَيْدِ اللهِ ، عَنْ أَبِي رَافِعٍ رَضِيَ اللهُ عَنْهُ قَالَ : إِنَّ النَّبِيَّ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ قَالَ : يَا أَبَا رَافِعٍ ، اقْتُلْ كُلَّ كَلْبٍ بِالْمَدِينَةِ . قَالَ : فَوَجَدْتُ نِسْوَةً فِي الْمَدِينَةِ مِنَ الْبَقِيعِ لَهُنَّ كَلْبٌ ، فَقُلْنَ : يَا أَبَا رَافِعٍ ، إِنَّ رَسُولَ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ قَدْ أَغْزَى رِجَالَنَا ، وَإِنَّ هَذَا الْكَلْبَ يَنْفَعُنَا بَعْدَ اللهِ تَعَالَى ، وَاللهِ مَا يَسْتَطِيعُ أَحَدٌ أَنْ يَأْتِيَنَا حَتَّى تَقُومَ امْرَأَةٌ مِنَّا فَتَحُولَ بَيْنَهُ وَبَيْنَهُ ، فَاذْكُرْهُ لِلنَّبِيِّ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ ، قَالَ : فَذَكَرَ ذَلِكَ أَبُو رَافِعٍ لِلنَّبِيِّ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ ، فَقَالَ : يَا أَبَا رَافِعٍ ، اقْتُلْهُ فَإِنَّمَا يَمْنَعُهُنَّ اللهُ تَعَالَى .
2330 \ 2 - وَقَالَ أَبُو يَعْلَى : حَدَّثَنَا أَبُو خَيْثَمَةَ ، ثَنَا رَوْحٌ بِتَمَامِهِ .
2330 \ 3 - قَالَ : وَحَدَّثَنَا عَمْرُو بْنُ الضَّحَّاكِ بْنِ مَخْلَدٍ ، ثَنَا أَبُو عَاصِمٍ ، عَنِ ابْنِ جُرَيْجٍ بِهِ .
2330 \ 2 - وَقَالَ أَبُو يَعْلَى : حَدَّثَنَا أَبُو خَيْثَمَةَ ، ثَنَا رَوْحٌ بِتَمَامِهِ .
2330 \ 3 - قَالَ : وَحَدَّثَنَا عَمْرُو بْنُ الضَّحَّاكِ بْنِ مَخْلَدٍ ، ثَنَا أَبُو عَاصِمٍ ، عَنِ ابْنِ جُرَيْجٍ بِهِ .
It is narrated from Sayyiduna Abu Rafi' (may Allah be pleased with him) that the Prophet (peace and blessings be upon him) said: "O Abu Rafi', kill every dog in Madinah." Abu Rafi' (may Allah be pleased with him) narrated: I found some women of Madinah in the area of al-Baqi' who had a dog, and they said: "O Abu Rafi', the Messenger of Allah (peace and blessings be upon him) has sent our men out to war, and after Allah Almighty this dog is of benefit to us. By Allah, no one can come to us unless one of us women stands up and comes between him (the one coming) and the dog. So mention this to the Prophet (peace and blessings be upon him)." Abu Rafi' (may Allah be pleased with him) said: "So Abu Rafi' mentioned this to the Prophet (peace and blessings be upon him), and he (peace and blessings be upon him) said: 'O Abu Rafi', kill it, for it is only Allah Almighty who protects them.'"
Abu Ya'la said: "Abu Khaythamah narrated to us; Rawh narrated the complete hadith to him."
He (Abu Ya'la) said: "And Amr bin al-Dahhak bin Makhlad narrated to us; Abu Asim narrated (this same hadith) to him from Ibn Jurayj in the same way."

وَحَدَّثَنَا الْمُقَدَّمِيُّ ، ثَنَا أَبُو عَامِرٍ ، ثَنَا يَعْقُوبُ بْنُ مُحَمَّدٍ ، عَنْ أَبِي الرِّجَالِ ، عَنْ سَالِمِ بْنِ عَبْدِ اللهِ ، عَنْ أَبِي رَافِعٍ رَضِيَ اللهُ عَنْهُ قَالَ : أَمَرَنِي رَسُولُ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ بِقَتْلِ الْكِلَابِ ، فَخَرَجْتُ لَا أَرَى كَلْبًا إِلَّا قَتَلْتُهُ ، فَإِذَا كَلْبٌ يَدُورُ ، فَذَهَبْتُ لِقَتْلِهِ فَنَادَانِي إِنْسَانٌ مِنْ جَوْفِ بَيْتٍ ، مَا تُرِيدُ أَنْ تَصْنَعَ ؟ قُلْتُ : أَقْتُلُ هَذَا الْكَلْبَ ، قَالَتْ : إِنِّي امْرَأَةٌ بِضَيْعَةٌ ، وَهَذَا الْكَلْبُ يَمْنَعُ عَنِّي السَّبُعَ ، وَيُؤْذِنُ بِالْخَايِنِ ، فَأَتَيْتُ النَّبِيَّ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ ، فَذَكَرْتُ ذَلِكَ لَهُ ، فَأَمَرَنِي بِقَتْلِهِ .
It is narrated from Sayyiduna Abu Rafi' (may Allah be pleased with him): "The Messenger of Allah (peace and blessings be upon him) ordered me to kill the dogs, so I went out and killed every dog I saw. Then there was a dog going around, and I went forward to kill it, when a woman called out to me from inside a house: 'What do you intend to do?' I said: 'I am about to kill this dog.' The woman said: 'I am a lone and weak woman, and this dog keeps the beasts of prey away from me and warns me of a thief.' So I came to the Prophet (peace and blessings be upon him) and mentioned this to him (peace and blessings be upon him), and he ordered me to kill it."
