قَالَ إِسْحَاقُ : أَخْبَرَنَا يَحْيَى بْنُ آدَمَ ، ثَنَا ابْنُ أَبِي زَائِدَةَ ، عَنِ الْمُجَالِدِ بْنِ سَعِيدٍ ، عَنْ زِيَادِ بْنِ عِلَاقَةَ ، عَنْ سَعْدِ بْنِ أَبِي وَقَّاصٍ رَضِيَ اللهُ عَنْهُ ، قَالَ : لَمَّا قَدِمَ النَّبِيُّ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ الْمَدِينَةَ جَاءَتْهُ جُهَيْنَةُ ، فَقَالُوا لَهُ : إِنَّكَ قَدْ نَزَلْتَ بَيْنَ أَظْهُرِنَا فَأَوْثِقْ لَنَا حَتَّى نَأْمَنَكَ وَتَأْمَنَّا . قَالَ : فَأَوْثَقَ لَهُمْ وَلَمْ يُسْلِمُوا .
It is narrated from Sayyiduna Sa'd bin Abi Waqqas (may Allah be pleased with him) that when the Prophet (peace and blessings be upon him) came to Madinah, the people of the tribe of Juhaynah came to him (peace and blessings be upon him) and said: "You have come to stay among us, so make a firm covenant (of peace) with us, so that we are safe from you and you are safe from us." The narrator said: "So he (peace and blessings be upon him) made a covenant with them, although they had not yet accepted Islam."
وَقَالَ أَبُو يَعْلَى : حَدَّثَنَا عُبَيْدُ اللهِ ، ثَنَا الضَّحَّاكُ بْنُ مَخْلَدٍ ، أَنَا سُفْيَانُ ، أَخْبَرَنِي مُحَمَّدُ بْنُ السَّائِبِ - هُوَ الْكَلْبِيُّ - عَنْ أَصْبَغَ بْنِ نُبَاتَةَ ، عَنْ عَلِيٍّ رَضِيَ اللهُ عَنْهُ قَالَ : إِنَّ النَّبِيَّ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ صَالَحَ بَنِي تَغْلِبَ عَلَى أَنْ يَثْبُتُوا عَلَى دِينِهِمْ ، وَلَا يُنَصِّرُوا أَبْنَاءَهُمْ ، وَإِنَّهُمْ قَدْ نَقَضُوا ، وَإِنَّهُ إِنْ يَتِمَّ لِيَ الْأَمْرُ قَتَلْتُ الْمُقَاتِلَةَ وَسَبَيْتُ الذُّرِّيَّةَ .
2029 \ 2 - وَحَدَّثَنَا عُبَيْدُ اللهِ ، ثَنَا عَبْدُ الرَّحْمَنِ بْنُ عُثْمَانَ الْبَكْرَاوِيُّ ، ثَنَا مُحَمَّدُ بْنُ السَّائِبِ الْكَلْبِيُّ ، فَذَكَرَهُ نَحْوَهُ ، وَلَفْظُهُ : شَهِدْتُ النَّبِيَّ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ صَالَحَ نَصَارَى بَنِي تَغْلِبَ عَلَى أَنْ لَا يُنَصِّرُوا أَوْلَادَهُمْ ، فَإِنْ فَعَلُوا فَقَدْ بَرِئَتْ مِنْهُمُ الذِّمَّةُ . قَالَ عَلِيٌّ رَضِيَ اللهُ عَنْهُ : فَقَدْ وَاللهِ فَعَلُوا ، فَوَاللهِ لَأَنْ يَتِمَّ لِيَ الْأَمْرُ لَأَقْتُلَنَّ مُقَاتِلَهُمْ وَلَأَسْبِيَنَّ ذَرَارِيَّهُمْ .
2029 \ 2 - وَحَدَّثَنَا عُبَيْدُ اللهِ ، ثَنَا عَبْدُ الرَّحْمَنِ بْنُ عُثْمَانَ الْبَكْرَاوِيُّ ، ثَنَا مُحَمَّدُ بْنُ السَّائِبِ الْكَلْبِيُّ ، فَذَكَرَهُ نَحْوَهُ ، وَلَفْظُهُ : شَهِدْتُ النَّبِيَّ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ صَالَحَ نَصَارَى بَنِي تَغْلِبَ عَلَى أَنْ لَا يُنَصِّرُوا أَوْلَادَهُمْ ، فَإِنْ فَعَلُوا فَقَدْ بَرِئَتْ مِنْهُمُ الذِّمَّةُ . قَالَ عَلِيٌّ رَضِيَ اللهُ عَنْهُ : فَقَدْ وَاللهِ فَعَلُوا ، فَوَاللهِ لَأَنْ يَتِمَّ لِيَ الْأَمْرُ لَأَقْتُلَنَّ مُقَاتِلَهُمْ وَلَأَسْبِيَنَّ ذَرَارِيَّهُمْ .
It is narrated from Sayyiduna Ali (may Allah be pleased with him): "The Prophet (peace and blessings be upon him) made peace with the people of Banu Taghlib on the condition that they would remain on their religion but would not make their children Christians (Nasara). But they have broken this covenant; if my authority becomes fully established, I will kill their fighters and take their offspring captive." In the wording narrated through another chain, Sayyiduna Ali (may Allah be pleased with him) said: "I was myself present when the Prophet (peace and blessings be upon him) made peace with the Christians of Banu Taghlib on the condition that they would not make their children Christians; if they did so, the covenant of protection would no longer apply to them." Sayyiduna Ali (may Allah be pleased with him) said (during his caliphate): "By Allah! They have violated this covenant (by making their children Christians). So by Allah! If my authority becomes fully established, I will certainly kill their fighting men and take their offspring as slaves." The chain of this report contains a narrator named Muhammad bin al-Sa'ib al-Kalbi (who has been criticised from a technical standpoint).
