قَالَ مُسَدَّدٌ : حَدَّثَنَا هُشَيْمٌ ، نَبَا يُونُسُ بْنُ عُبَيْدٍ ، عَنِ الْحَسَنِ ، وَمُغِيرَةَ ، عَنْ إِبْرَاهِيمَ قَالَ : " لَا نِكَاحَ إِلَّا بِوَلِيٍّ ، أَوِ السُّلْطَانِ ".
It is narrated from Ibrahim al-Nakha'i (may Allah have mercy on him) that he said: "There is no (legally valid) marriage except with a guardian (wali), or else under the authority of the ruler."
حَدَّثَنَا عَبْدُ الْوَاحِدِ بْنُ زِيَادٍ ، نَبَا يُونُسُ بْنُ عُبَيْدٍ ، عَنِ الْحَسَنِ رَضِيَ اللهُ عَنْهُ ، قَالَ : " لَا نِكَاحَ إِلَّا بِوَلِيٍّ ".
It is narrated from Hasan al-Basri (may Allah have mercy on him) that he said: "Without the presence of a guardian (wali), a marriage is not (legally) contracted."

وَقَالَ أَبُو يَعْلَى : حَدَّثَنَا مُحَمَّدُ بْنُ عَبْدِ الرَّحْمَنِ بْنِ سَهْمٍ الْأَنْطَاكِيُّ ، نَبَا بَقِيَّةُ ، نَبَا مُبَشِّرُ بْنُ عُبَيْدٍ ، عَنْ أَبِي الزُّبَيْرِ ، عَنْ جَابِرٍ رَضِيَ اللهُ عَنْهُ ، قَالَ : قَالَ رَسُولُ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ : " لَا تُنْكَحُ النِّسَاءُ إِلَّا مِنَ الْأَكْفَاءِ ، وَلَا يُزَوِّجُهُنَّ إِلَّا الْأَوْلِيَاءُ ، وَلَا مَهْرَ دُونَ عَشَرَةِ دَرَاهِمَ ".
It is narrated from Sayyiduna Jabir (may Allah be pleased with him) that the Messenger of Allah (peace and blessings be upon him) said: "Women are to be married only to men who are their equals (kufw), all the matters of their marriage are to be carried out only by their awliya' (legal guardians), and the dowry (mahr) should not be less than ten dirhams."
