Al-Matalib al-'Aliyah 1652 — Guardians in marriage

It is narrated from Hasan al-Basri (may Allah have mercy on him) that he said: "Without the presence of a guardian (wali), a marriage is not (legally) contracted."
According to the imams and commentators, what is meant by this is that for the legal validity and permissibility of marriage, the guardianship of the wali is a fundamental and indispensable condition, without which the marriage is not legally valid.
