Al-Matalib al-'Aliyah 1547 — Those who held that a Muslim inherits

حَدَّثَنَا أَبُو وَكِيعٍ ، عَنْ أَبِي إِسْحَاقَ ، عَنِ الْحَارِثِ ، عَنْ عَلِيٍّ رَضِيَ اللهُ عَنْهُ ، قَالَ : " لَا يَرِثُ الْمُسْلِمُ الْكَافِرَ ، إِلَّا إِنْ كَانَ لَهُ عَبْدًا " ، وَفِي لَفْظٍ : " إِلَّا أَنْ يَكُونَ مَمْلُوكًا لَهُ ".
It is narrated from Sayyiduna Ali (may Allah be pleased with him) that he said: "No Muslim can inherit from a disbeliever, except in the case where he (the disbeliever) is his slave." And the wording of one narration is: "Unless he is his mamluk (slave)."
