Book of Blood Money
بَابٌ فِي مَنْ كَشَفَ سِتْرَ بَيْتِ غَيْرِهِ ، فَنَظَرَ إِلَى أَهْلِهِ بِغَيْرِ إِذْنٍ فَفَقَؤُوا عَيْنَهُ .

One who lifts the curtain of another's house and looks at his family without permission, and they put out his eye

عَنْ أَبِي ذَرٍّ قَالَ : قَالَ رَسُولُ اللَّهِ - صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ - : " أَيُّمَا رَجُلٍ كَشَفَ سِتْرًا فَأَدْخَلَ بَصَرَهُ مِنْ قَبْلِ أَنْ يُؤْذَنَ لَهُ فَقَدْ أَتَى حَدًّا لَا يَحِلُّ لَهُ أَنْ يَأْتِيَهُ ، وَلَوْ أَنَّ رَجُلًا فَقَأَ عَيْنَهُ لَهُدِرَتْ ، وَلَوْ أَنَّ رَجُلًا مَرَّ عَلَى بَابٍ لَا سِتْرَ لَهُ ، فَرَأَى عَوْرَةَ أَهْلِهِ فَلَا خَطِيئَةَ عَلَيْهِ ، إِنَّمَا الْخَطِيئَةُ عَلَى أَهْلِ الْبَيْتِ " .
قُلْتُ : رَوَى التِّرْمِذِيُّ بَعْضَهُ . رَوَاهُ أَحْمَدُ ، وَرِجَالُهُ رِجَالُ الصَّحِيحِ غَيْرَ ابْنِ لَهِيعَةَ وَهُوَ حَسَنُ الْحَدِيثِ وَفِيهِ ضَعْفٌ .
Sayyiduna Abu Dharr al-Ghifari (may Allah be pleased with him) narrates that the Prophet (peace and blessings be upon him) said: "Whoever lifts a curtain and sends his gaze (into a house) before being given permission has committed an offence liable to a prescribed punishment (hadd); it is not lawful for him to do that. If the man of the house were to gouge out his eye, that eye would go uncompensated. And if a man passes by a door that has no curtain and sees something private of the household, there is no sin upon him, for the fault lies with the people of the house." (Allamah al-Haythami says:) I say: Al-Tirmidhi recorded part of this report.
Ahmad recorded it, and its narrators are the narrators of the Sahih, except for Ibn Lahi'ah, who is hasan al-hadith (fair in narration), though there is weakness in him.

وَعَنْ أَبِي أُمَامَةَ عَنِ النَّبِيِّ - صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ - قَالَ : " مَنِ اطَّلَعَ مِنْ سُتْرَةٍ إِلَى قَوْمٍ فَفُقِئَتْ عَيْنُهُ فَهُوَ هَدَرٌ " .
رَوَاهُ الطَّبَرَانِيُّ بِإِسْنَادَيْنِ فِي أَحَدِهِمَا حَكِيمُ بْنُ أَبِي حَكِيمٍ ، وَفِي الْأُخْرَى : لَيْثُ بْنُ أَبِي حَكِيمٍ ، وَكِلَاهُمَا عَنْ أَبِي أُمَامَةَ وَلَمْ أَعْرِفْهُمَا ، وَبَقِيَّةُ رِجَالِ أَحَدِهِمَا ثِقَاتٌ .
Sayyiduna Abu Umamah (may Allah be pleased with him) narrates this saying of the Prophet (peace and blessings be upon him): "Whoever peeps through a curtain at the private things of a people, and then his eye is gouged out, it goes uncompensated."
Al-Tabarani recorded it with two chains: one of them contains a narrator, Hakim bin Abi Hakim, and the other contains a narrator, Layth bin Abi Hakim; both of them narrated it from Sayyiduna Abu Umamah (may Allah be pleased with him). I do not know either of them; the remaining narrators of one of the two chains are thiqat (trustworthy).
