عَنْ عَبْدِ اللَّهِ بْنِ مَسْعُودٍ قَالَ : نَهَى رَسُولُ اللَّهِ - صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ - عَنْ صَفْقَتَيْنِ فِي صَفْقَةٍ وَاحِدَةٍ .
قَالَ سِمَاكٌ : الرَّجُلُ يَبِيعُ الْبَيْعَ فَيَقُولُ : هُوَ بِنُسَاء بِكَذَا وَكَذَا . وَهُوَ بِنَقْدٍ بِكَذَا وَكَذَا .
رَوَاهُ الْبَزَّارُ ، وَأَحْمَدُ .
Sayyiduna Abdullah bin Mas'ud (may Allah be pleased with him) narrates: The Prophet (peace and blessings be upon him) forbade making two deals in a single deal. The narrator Simak says: (What is meant by this is that) a man sells something and then says: "On credit it will be for such-and-such, and for cash it will be for such-and-such."
Al-Bazzar and Ahmad recorded it.

وَرَوَى لَهُ الطَّبَرَانِيُّ فِي الْأَوْسَطِ وَلَفْظُهُ : قَالَ رَسُولُ اللَّهِ - صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ - : " لَا تَحِلُّ صَفْقَتَانِ فِي صَفْقَةٍ " .
Al-Tabarani recorded it from him in al-Mu'jam al-Awsat with these words: the Prophet (peace and blessings be upon him) said: "Two deals in one deal are not lawful."

وَرَوَاهُ فِي الْكَبِيرِ وَلَفْظُهُ : " الصَّفْقَةُ بِالصَّفْقَتَيْنِ رِبًا " . وَهُوَ مَوْقُوفٌ .
وَرَوَاهُ الْبَزَّارُ كَذَلِكَ وَزَادَ : وَأَمَرَنَا رَسُولُ اللَّهِ - صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ - بِإِسْبَاغِ الْوُضُوءِ .
وَرِجَالُ أَحْمَدَ ثِقَاتٌ .
He recorded it in al-Mu'jam al-Kabir, and its wording is: "One deal within two deals is usury (riba)."
This narration is "mawquf" (stopping at the Companion).
Al-Bazzar recorded it likewise and added: the Prophet (peace and blessings be upon him) ordered us to perform ablution thoroughly. The narrators of Ahmad are thiqat (trustworthy).

وَعَنِ ابْنِ عُمَرَ قَالَ : قَالَ رَسُولُ اللَّهِ - صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ - : " مَطْلُ الْغَنِيِّ ظُلْمٌ ، وَإِذَا أُحِلْتَ عَلَى مَلِيءٍ فَاتْبَعْهُ ، وَلَا بَيْعَتَيْنِ فِي وَاحِدَةٍ " .
رَوَاهُ أَحْمَدُ ، وَالْبَزَّارُ ، وَلَفْظُهُ أَنَّ النَّبِيَّ - صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ - نَهَى عَنْ بَيْعَتَيْنِ فِي بَيْعَةٍ ، وَرِجَالُ أَحْمَدَ رِجَالُ الصَّحِيحِ .
Sayyiduna Abdullah bin Umar (may Allah be pleased with them both) narrates that the Prophet (peace and blessings be upon him) said: "A well-off person's delaying (payment) is injustice; when someone is referred to another person for collecting (his due), he should follow up that other person; and two deals in one deal are not permissible."
Ahmad and al-Bazzar recorded it, and their wording is: "The Prophet (peace and blessings be upon him) forbade making two deals in one deal." The narrators of Ahmad are the narrators of the Sahih.

وَعَنْ عَبْدِ الْوَارِثِ بْنِ سَعْدٍ قَالَ : قَدِمْتُ مَكَّةَ ، فَوَجَدْتُ فِيهَا أَبَا حَنِيفَةَ ، وَابْنَ أَبِي لَيْلَى ، وَابْنَ شُبْرُمَةَ ، فَسَأَلْتُ أَبَا حَنِيفَةَ قُلْتُ : مَا تَقُولُ فِي رَجُلٍ بَاعَ بَيْعًا ، وَشَرَطَ شَرْطًا ؟ قَالَ : الْبَيْعُ بَاطِلٌ ، وَالشَّرْطُ بَاطِلٌ .
ثُمَّ أَتَيْتُ ابْنَ أَبِي لَيْلَى فَسَأَلْتُهُ ؟ فَقَالَ : الْبَيْعُ جَائِزٌ ، وَالشَّرْطُ بَاطِلٌ .
ثُمَّ أَتَيْتُ ابْنَ شُبْرُمَةَ فَسَأَلْتُهُ ؟ فَقَالَ : الْبَيْعُ جَائِزٌ ، وَالشَّرْطُ جَائِزٌ .
فَقُلْتُ : يَا سُبْحَانَ اللَّهِ ! ثَلَاثَةٌ مِنْ فُقَهَاءِ الْعِرَاقِ اخْتَلَفُوا عَلَيَّ فِي مَسْأَلَةٍ وَاحِدَةٍ ، فَأَتَيْتُ أَبَا حَنِيفَةَ ، فَأَخْبَرْتُهُ ، فَقَالَ : لَا أَدْرِي مَا قَالَا ، حَدَّثَنِي عَمْرُو بْنُ شُعَيْبٍ ، عَنْ أَبِيهِ ، عَنْ جَدِّهِ أَنَّ النَّبِيَّ - صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ - نَهَى عَنْ بَيْعٍ ، وَشَرْطٍ ، الْبَيْعُ بَاطِلٌ ، وَالشَّرْطُ بَاطِلٌ .
ثُمَّ أَتَيْتُ ابْنَ أَبِي لَيْلَى ، فَأَخْبَرْتُهُ ، فَقَالَ : لَا أَدْرِي مَا قَالَا ، حَدَّثَنِي هِشَامُ بْنُ عُرْوَةَ ، عَنْ أَبِيهِ ، عَنْ عَائِشَةَ قَالَتْ : أَمَرَنِي رَسُولُ اللَّهِ - صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ - أَنْ أَشْتَرِيَ بَرِيرَةً فَأَعْتِقَهَا ؛ الْبَيْعُ جَائِزٌ ، وَالشَّرْطُ بَاطِلٌ .
ثُمَّ أَتَيْتُ ابْنَ شُبْرُمَةَ ، فَأَخْبَرْتُهُ ، فَقَالَ : لَا أَدْرِي مَا قَالَا ، حَدَّثَنِي مِسْعَرُ بْنُ كِدَامٍ ، عَنْ مُحَارِبِ بْنِ دِثَارٍ ، عَنْ جَابِرِ بْنِ عَبْدِ اللَّهِ قَالَ : بَعَثَ رَسُولُ اللَّهِ - صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ - نَاقَةً وَشَرَطَ حَمْلَنَا إِلَى الْمَدِينَةِ ؛ الْبَيْعُ جَائِزٌ وَالشَّرْطُ جَائِزٌ .
رَوَاهُ الطَّبَرَانِيُّ فِي الْأَوْسَطِ ، وَفِي طَرِيقِ عَبْدِ اللَّهِ بْنِ عَمْرٍو مَقَالٌ .
Abd al-Warith bin Sa'd narrates: I came to Makkah and found Imam Abu Hanifah, Imam Ibn Abi Layla and Imam Ibn Shubrumah there. I asked Imam Abu Hanifah; I said: "What do you say about a man who sells something and then stipulates a condition?" He said: "The sale is void and the condition is void too." Then I came to Ibn Abi Layla and asked him the same question, and he said: "The sale is valid and the condition is void." Then I came to Ibn Shubrumah and asked him this question, and he said: "The sale is valid and the condition is valid too." I said: "Subhan Allah! What is this? Three jurists of Iraq are giving me different opinions on a single issue." I came to Imam Abu Hanifah and told him about it, and he said: "I do not know on what basis the two of them gave this ruling. Amr bin Shu'ayb narrated this hadith to me from his father, from his grandfather, that the Prophet (peace and blessings be upon him) forbade stipulating a condition in a sale; so the sale is void and the condition is void too." Abd al-Warith says: Then I came to Ibn Abi Layla and told him this, and he said: "I do not know on what basis the two of them gave this ruling. Hisham bin Urwah narrated this hadith to me from his father, from Sayyidah Aishah (may Allah be pleased with her), who said: the Prophet (peace and blessings be upon him) ordered me to buy Barirah and set her free." (Ibn Abi Layla said:) "So this sale is valid and the condition is void." Abd al-Warith says: I came to Ibn Shubrumah and told him about this, and he said: "I do not know on what basis the two of them gave this ruling. Mis'ar bin Kidam narrated to me from Muharib bin Dithar this statement of Sayyiduna Jabir bin Abdullah (may Allah be pleased with him): The Prophet (peace and blessings be upon him) sent (or sold) a she-camel and stipulated that it would be ridden up to Madinah." (Ibn Shubrumah said:) "So here the sale is valid and the condition is valid too."
Al-Tabarani recorded it in al-Mu'jam al-Awsat, and there is criticism concerning the chain of the narration from Sayyiduna Abdullah bin Amr (may Allah be pleased with him).

وَعَنِ ابْنِ عَبَّاسٍ أَنَّ النَّبِيَّ - صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ - قَالَ لِعَتَّابِ بْنِ أَسِيدٍ : " إِنِّي قَدْ بَعَثْتُكَ عَلَى أَهْلِ اللَّهِ - أَهْلِ مَكَّةَ - فَانْهَهُمْ عَنْ بَيْعِ مَا لَمْ يُقْبَضْ ، وَعَنْ رِبْحِ مَا لَمْ يَضْمَنُوا ، وَعَنْ شَرْطَيْنِ فِي شَرْطٍ ، وَعَنْ بَيْعٍ وَقَرْضٍ ، وَعَنْ بَيْعٍ وَسَلَفٍ " .
رَوَاهُ الطَّبَرَانِيُّ فِي الْأَوْسَطِ ، وَفِيهِ يَحْيَى بْنُ صَالِحٍ الْأَيْلِيُّ ؛ قَالَ الذَّهَبِيُّ : رَوَى عَنْهُ يَحْيَى بْنُ بُكَيْرٍ مَنَاكِيرَ . قُلْتُ : وَلَمْ أَجِدْ لِغَيْرِ الذَّهَبِيِّ فِيهِ كَلَامًا . وَبَقِيَّةُ رِجَالِهِ رِجَالُ الصَّحِيحِ .
Sayyiduna Abdullah bin Abbas (may Allah be pleased with them both) narrates that the Prophet (peace and blessings be upon him) said to Sayyiduna Attab bin Asid (may Allah be pleased with him): "I am about to send you to the people of Allah (that is, the people of Makkah). Forbid them from selling what has not been taken into possession, from profiting on what they do not bear liability for, from (stipulating) two conditions in one condition, from (combining) a sale and a loan, and from (combining) a sale and an advance (salaf)."
Al-Tabarani recorded it in al-Mu'jam al-Awsat; its chain contains Yahya bin Salih al-Ayli. Al-Dhahabi says: Yahya bin Bukayr narrated munkar (objectionable) reports from him. Allamah al-Haythami says: I say: I have not found anyone other than al-Dhahabi criticising him. The rest of its narrators are the narrators of the Sahih.

وَعَنْ حَكِيمِ بْنِ حِزَامٍ قَالَ : نَهَانِي رَسُولُ اللَّهِ - صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ - عَنْ أَرْبَعِ خِصَالٍ فِي الْبَيْعِ : عَنْ سَلَفٍ ، وَبَيْعٍ ، وَشَرْطَيْنِ فِي بَيْعٍ ، وَبَيْعِ مَا لَيْسَ عِنْدِي ، وَرِبْحِ مَا لَمْ يُضْمَنْ .
قُلْتُ : رَوَى النَّسَائِيُّ بَعْضَهُ .
رَوَاهُ الطَّبَرَانِيُّ فِي الْكَبِيرِ ، وَفِيهِ الْعَلَاءُ بْنُ خَالِدٍ الْوَاسِطِيُّ وَثَّقَهُ ابْنُ حِبَّانَ، وَضَعَّفَهُ مُوسَى بْنُ إِسْمَاعِيلَ .
Sayyiduna Hakim bin Hizam (may Allah be pleased with him) narrates: The Prophet (peace and blessings be upon him) forbade me four things in sales: (combining) an advance (salaf) and a sale; two conditions in one sale; selling something I do not have; and profit on something for which there is no liability. (Allamah al-Haythami says:) I say: Imam al-Nasa'i (may Allah have mercy on him) recorded part of it.
Al-Tabarani recorded it in al-Mu'jam al-Kabir; its chain contains al-Ala' bin Khalid al-Wasiti, whom Ibn Hibban declared thiqah (trustworthy), while Musa bin Isma'il declared him da'if (weak).

وَعَنْ عَتَّابِ بْنِ أَسِيدٍ أَنَّ النَّبِيَّ - صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ - قَالَ لَهُ حِينَ أَمَّرَهُ مَكَّةَ : " هَلْ أَنْتَ مُبَلِّغٌ عَنِّي قَوْمَكَ مَا آمُرُكَ بِهِ ؟ قُلْ لَهُمْ : لَا يَجْمَعْ أَحَدُكُمْ بَيْعًا وَسَلَفًا ، وَلَا يَبِعْ أَحَدُكُمْ بَيْعَ غَرَرٍ ، وَلَا يَبِعْ أَحَدٌ مَا لَيْسَ عِنْدَهُ " .
رَوَاهُ الطَّبَرَانِيُّ فِي الْكَبِيرِ ، وَفِيهِ مُوسَى بْنُ عُبَيْدَةَ الرَّبَذِيُّ ، وَهُوَ ضَعِيفٌ .
Sayyiduna Attab bin Asid (may Allah be pleased with him) narrates that when the Prophet (peace and blessings be upon him) appointed him governor over the people of Makkah, he said to him: "Will you convey to your people on my behalf what I instruct you? Say to them: None of you should combine a sale and an advance (salaf), none of you should make a deceptive sale (gharar), and none of you should sell something that he does not have."
Al-Tabarani recorded it in al-Mu'jam al-Kabir; its chain contains Musa bin Ubaydah al-Rabadhi, and he is da'if (weak).

وَعَنْ عَبْدِ اللَّهِ قَالَ : نَهَانَا رَسُولُ اللَّهِ - صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ - عَنْ صَوْمَيْنِ ، وَعَنْ صَلَاتَيْنِ ، وَعَنْ لِبَاسَيْنِ ، وَعَنْ مَطْعَمَيْنِ ، وَعَنْ نِكَاحَيْنِ ، وَعَنْ بَيْعَتَيْنِ . فَأَمَّا الصَّوْمَانُ : فَيَوْمُ الْفِطْرِ وَيَوْمُ الْأَضْحَى . وَأَمَّا الصَّلَاتَانِ : فَصَلَاةٌ بَعْدَ الْغَدَاةِ حَتَّى تَطْلُعَ الشَّمْسُ ، وَصَلَاةٌ بَعْدَ الْعَصْرِ حَتَّى تَغْرُبَ الشَّمْسُ . وَأَمَّا اللِّبَاسَانِ : فَأَنْ يَحْتَبِيَ فِي ثَوْبٍ وَاحِدٍ ، وَلَا يَكُونُ بَيْنَ عَوْرَتِهِ وَبَيْنَ السَّمَاءِ شَيْءٌ فَتُدْعَى تِلْكَ السَّمَّاءُ . وَأَمَّا الْمَطْعَمَانِ : فَأَنْ يَأْكُلَ بِشِمَالِهِ وَيَمِينُهُ صَحِيحَةٌ ، وَيَأْكُلَ مُتَّكِئًا . وَأَمَّا الْبَيْعَانِ : فَيَقُولُ الرَّجُلُ : تَبِيعُ لِي ، وَأَبِيعُ لَكَ . وَأَمَّا النِّكَاحَانِ : فَنِكَاحُ الْبَغِيِّ وَنِكَاحٌ عَلَى الْخَالَةِ وَالْعَمَّةِ .
قُلْتُ : عَزَاهُ فِي الْأَطْرَافِ إِلَى النَّسَائِيِّ ، وَلَمْ أَرَهُ فِي الصُّغْرَى .
رَوَاهُ الطَّبَرَانِيُّ فِي الْكَبِيرِ ، وَرِجَالُهُ رِجَالُ الصَّحِيحِ .
Sayyiduna Abdullah (may Allah be pleased with him) narrates: The Prophet (peace and blessings be upon him) forbade us two kinds of fasts, two kinds of prayers, two kinds of dress, two kinds of eating, two kinds of marriage and two kinds of sales. As for the two fasts, they are (fasting on) the day of Eid al-Fitr and Eid al-Adha. As for the two prayers, they are a prayer offered after the Fajr prayer until the sun rises, and a prayer after the Asr prayer until the sun sets. As for the two kinds of dress, one form is that a man wraps a single garment around himself in the manner of ihtiba' (sitting with the knees drawn up), with no cloth between his private parts and the sky. As for the two kinds of eating, it is that a man eats with his left hand while his right hand is sound, and that a man eats while reclining. As for the two kinds of sales, one form is that a man says: "You sell this to me and I will sell to you." As for the two kinds of marriage, they are marrying a prostitute, and marrying (a woman) over her maternal aunt or paternal aunt (that is, marrying the niece of one's wife). (Allamah al-Haythami says:) The author of "al-Atraf" attributed it to Imam al-Nasa'i (may Allah have mercy on him), but I have not seen this narration in Sunan al-Nasa'i.
Al-Tabarani recorded it in al-Mu'jam al-Kabir, and its narrators are the narrators of the Sahih.
