Abd al-Warith bin Sa'd narrates: I came to Makkah and found Imam Abu Hanifah, Imam Ibn Abi Layla and Imam Ibn Shubrumah there. I asked Imam Abu Hanifah; I said: "What do you say about a man who sells something and then stipulates a condition?" He said: "The sale is void and the condition is void too." Then I came to Ibn Abi Layla and asked him the same question, and he said: "The sale is valid and the condition is void." Then I came to Ibn Shubrumah and asked him this question, and he said: "The sale is valid and the condition is valid too." I said: "Subhan Allah! What is this? Three jurists of Iraq are giving me different opinions on a single issue." I came to Imam Abu Hanifah and told him about it, and he said: "I do not know on what basis the two of them gave this ruling. Amr bin Shu'ayb narrated this hadith to me from his father, from his grandfather, that the Prophet (peace and blessings be upon him) forbade stipulating a condition in a sale; so the sale is void and the condition is void too." Abd al-Warith says: Then I came to Ibn Abi Layla and told him this, and he said: "I do not know on what basis the two of them gave this ruling. Hisham bin Urwah narrated this hadith to me from his father, from Sayyidah Aishah (may Allah be pleased with her), who said: the Prophet (peace and blessings be upon him) ordered me to buy Barirah and set her free." (Ibn Abi Layla said:) "So this sale is valid and the condition is void." Abd al-Warith says: I came to Ibn Shubrumah and told him about this, and he said: "I do not know on what basis the two of them gave this ruling. Mis'ar bin Kidam narrated to me from Muharib bin Dithar this statement of Sayyiduna Jabir bin Abdullah (may Allah be pleased with him): The Prophet (peace and blessings be upon him) sent (or sold) a she-camel and stipulated that it would be ridden up to Madinah." (Ibn Shubrumah said:) "So here the sale is valid and the condition is valid too."
Al-Tabarani recorded it in al-Mu'jam al-Awsat, and there is criticism concerning the chain of the narration from Sayyiduna Abdullah bin Amr (may Allah be pleased with him).
