Majma al-Zawaid — Hadith 7853

وَعَنْ مُحَمَّدِ بْنِ إِسْحَاقَ قَالَ : ادَّعَى نَصْرُ بْنُ الْحَجَّاجِ بْنِ عِلَاطٍ السُّلَمِيُّ عَبْدَ اللَّهِ بْنَ رَب‍َاحٍ مَوْلَى خَالِدِ بْنِ الْوَلِيدِ فَقَامَ عَبْدُ الرَّحْمَنِ بْنُ خَالِدِ بْنِ الْوَلِيدِ فَقَالَ : مَوْلَايَ وُلِدَ عَلَى فِرَاشِ مَوْلَايَ ، وَقَالَ نَصْرٌ : أَخِي أَوْصَانِي بِمَنْزِلِهِ قَالَ : فَطَالَتْ خُصُومَتُهُمْ ، فَدَخَلُوا مَعَهُ عَلَى مُعَاوِيَةَ - وَفِهْرٌ تَحْتَ رَأْسِهِ - فَادَّعَيَا ، فَقَالَ مُعَاوِيَةُ : سَمِعْتُ رَسُولَ اللَّهِ - صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ - يَقُولُ : " الْوَلَدُ لِلْفِرَاشِ وَلِلْعَاهِرِ الْحَجَرُ " .
قَالَ نَصْرٌ : فَأَيْنَ قَضَاؤُكَ هَذَا يَا مُعَاوِيَةُ فِي زِيَادٍ ؟ فَقَالَ مُعَاوِيَةُ : قَضَاءُ رَسُولِ اللَّهِ - صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ - خَيْرٌ مِنْ قَضَاءِ مُعَاوِيَةَ ، فَكَانَ عَبْدُ اللَّهِ بْنُ رَبَاحٍ لَا يُجِيبُ نَصْرًا إِلَى مَا يَدَّعِي ، فَقَالَ نَصْرٌ :
أَبَـا خَـالِدٍ خُذْ مِثْلَ مَالِي وِرَاثَةً وَخُذْنِي أَخًا عِنْدَ الْهَزَاهِزِ شَاهِدَا
أَبَـا خَـالِدٍ مَـالِي ثَرَاءٌ وَمَنْصِبٌ سَبْـيٌ وَأَعْرَاقٌ تَهُزُّكَ صَـاعِدَا
أَبَـا خَـالِدٍ لَا تَجْعَـلَنَّ بَنَـاتِنَـا إِمَـاءً لِمَخْزُومٍ وَكُـنَّ مَوَاجِدَا
أَبَا خَالِدٍ إِنْ كُنْتَ تَخْشَى ابْنَ خَالِدٍ فَلَمْ يَكُنِ الْحَجَّاجُ يَرْهَبُ خَالِدَا
أَبَـا خَـالِدٍ لَا نَحْنُ نَـارٌ وَلَا هُمُ جِنَانٌ تَرَى فِيهَا الْعُيُونَ رَوَاكِدَا
رَوَاهُ أَبُو يَعْلَى ، وَإِسْنَادُهُ مُنْقَطِعٌ ، وَرِجَالُهُ ثِقَاتٌ .
Muhammad bin Ishaq narrates: Nasr bin al-Hajjaj bin Ilat al-Sulami made a claim concerning Abdullah bin Rabah, the slave of Sayyiduna Khalid bin al-Walid. Abd al-Rahman, the son of Sayyiduna Khalid bin al-Walid (may Allah be pleased with him), stood up and said, "He is my slave, who was born on the bed of my father." Nasr bin al-Hajjaj said, "My brother instructed me concerning him." The narrator says: When their dispute grew long, they took him with them to Sayyiduna Mu'awiyah (may Allah be pleased with him), who had a stone under his head. The two of them each presented their claim, and Sayyiduna Mu'awiyah (may Allah be pleased with him) said that he had heard the Prophet (peace and blessings be upon him) say: "The child belongs to the owner of the bed, and for the fornicator there is deprivation." At this Nasr bin al-Hajjaj said, "O Mu'awiyah! Then why did you not give this judgement concerning Ziyad?" Sayyiduna Mu'awiyah (may Allah be pleased with him) said, "The judgement of the Messenger of Allah is better than the judgement of Mu'awiyah." Abdullah bin Rabah gave no response to the claim of Nasr bin al-Hajjaj, so Nasr composed these verses: "O Abu Khalid! Take wealth equal to my wealth as inheritance, and give me my brother, who is a witness in times of trial. O Abu Khalid, my wealth is fine and my standing is excellent, and there are roots that will keep stirring you as you rise. O Abu Khalid, do not make our daughters the slave women of Makhzum, or else they will be distressed (or angered). O Abu Khalid! If you fear Ibn Khalid, then Hajjaj did not drive Khalid away. O Abu Khalid! Neither are we fire, nor are they (such) gardens in which you see still springs."
Abu Ya'la recorded it. Its chain is munqati' (broken), and its narrators are thiqat (trustworthy).
