بَابٌ فِيمَنْ وَطِئَ امْرَأَةً وَحَمْلُهَا لِغَيْرِهِ .

وَعَنْ رَجَاءِ بْنِ حَيْوَةَ عَنْ أَبِيهِ عَنْ جَدِّهِ أَنَّ جَارِيَةً مِنْ خَيْبَرَ مَرَّتْ عَلَى رَسُولِ اللَّهِ - صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ - وَهِيَ مُجِحٌّ فَقَالَ النَّبِيُّ - صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ - : " لِمَنْ هَذِهِ ؟ " قَالُوا : لِفُلَانٍ . قَالَ : " أَيَطَؤُهَا ؟ " قِيلَ : نَعَمْ . قَالَ : " فَكَيْفَ يَصْنَعُ بِوَلَدِهَا أَيَدَّعِيهِ وَلَيْسَ لَهُ بِوَلَدٍ أَمْ يَسْتَعْبِدُهُ ، وَهُوَ يَغْذُوهُ فِي سَمْعِهِ وَبَصَرِهِ لَقَدْ هَمَمْتُ أَنْ أَلْعَنَهُ لَعْنَةً تَدْخُلُ مَعَهُ فِي قَبْرِهِ " .
رَوَاهُ الطَّبَرَانِيُّ ، وَفِيهِ خَارِجَةُ بْنُ مُصْعَبٍ ، وَهُوَ مَتْرُوكٌ .

Raja' bin Haywah reports from his father, from his grandfather: At Khaybar a slave girl passed by the Prophet (peace and blessings be upon him); she was pregnant and close to giving birth. The Prophet (peace and blessings be upon him) asked: Whose (slave girl) is she? The people said: She belongs to so-and-so. The Prophet (peace and blessings be upon him) asked: Does he have relations with her? It was said: Yes. The Prophet (peace and blessings be upon him) said: What will he do with her child? Will he claim it, when it is not his child? Or will he make it a slave, when he has nourished its hearing and sight? I was about to curse him with a curse that would enter his grave with him.
Al-Tabarani recorded it. Its chain contains Kharijah bin Mus'ab, who is matruk (abandoned).
