Majma al-Zawaid — Hadith 7604

وَعَنِ ابْنِ عُمَرَ قَالَ : سَمِعْتُ رَسُولَ اللَّهِ - صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ - يَقُولُ : " إِنَّ كُلَّ جَارِيَةٍ بِهَا حَبَلٌ حَرَامٌ عَلَى صَاحِبِهَا حَتَّى تَضَعَ مَا فِي بَطْنِهَا " .
رَوَاهُ الطَّبَرَانِيُّ فِي حَدِيثٍ طَوِيلٍ ، وَهُوَ بِتَمَامِهِ فِي الْأَطْعِمَةِ فِي أَكْلِ الثُّومِ ، وَفِيهِ يَحْيَى بْنُ عَبْدِ اللَّهِ الْبَابَلُتِّيُّ ، وَهُوَ ضَعِيفٌ . قُلْتُ : وَتَأْتِي أَحَادِيثُ فِي الِاسْتِبْرَاءِ فِي الطَّلَاقِ .
Sayyiduna Abdullah bin Umar (may Allah be pleased with them both) narrates: I heard the Prophet (peace and blessings be upon him) say: "Every slave girl who is pregnant is forbidden to her master (i.e. for him to have relations with her) until she gives birth to what is in her womb."
Al-Tabarani recorded it within a long hadith, the complete narration of which will come later in the chapter on food, under eating garlic. Its chain contains Yahya bin Abdullah al-Babulti, who is da'if (weak). I say: Hadiths on istibra' (waiting to confirm the womb is free) will come in the chapter on divorce.
