Majma al-Zawaid — Hadith 7143

عَنِ الْمِسْوَرِ بْنِ مَخْرَمَةَ، وَجَابِرٍ قَالَا : قَالَ رَسُولُ اللَّهِ - صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " لَا يَرِثُ الصَّبِيُّ حَتَّى يَسْتَهِلَّ صَارِخًا وَاسْتِهْلَالُهُ أَنْ يَصِيحَ أَوْ يَعْطِسَ أَوْ يَبْكِيَ " .
رَوَاهُ الطَّبَرَانِيُّ فِي الْأَوْسَطِ وَالْكَبِيرِ ، وَفِيهِ عَبَّاسُ بْنُ الْوَلِيدِ الْخَلَّالُ وَثَّقَهُ أَبُو مُسْهِرٍ، وَمَرْوَانُ بْنُ مُحَمَّدٍ، وَقَالَ أَبُو دَاوُدَ : لَا أُحَدِّثُ عَنْهُ . وَبَقِيَّةُ رِجَالِهِ رِجَالُ الصَّحِيحِ .
Sayyiduna al-Miswar bin Makhramah (may Allah be pleased with him) and Sayyiduna Jabir (may Allah be pleased with him) narrate that the Prophet (peace and blessings be upon him) said: "(A child who dies immediately after birth) does not become an heir unless he cries out (at birth), and crying out means that he screams, or sneezes, or weeps."
Al-Tabarani recorded it in al-Mu'jam al-Awsat and al-Mu'jam al-Kabir; its chain contains a narrator, Abbas bin al-Walid al-Khallal, whom Abu Mushir and Marwan bin Muhammad declared thiqah (trustworthy). Abu Dawud says: I do not narrate from him. The remaining narrators are the narrators of the Sahih.
