بَابٌ فِي الشَّاهِدِ وَالْيَمِينِ .

Majma al-Zawaid 7051 — One witness and an oath
وَعَنْ جَابِرِ بْنِ عَبْدِ اللَّهِ الْأَنْصَارِيِّ قَالَ : قَالَ رَسُولُ اللَّهِ - صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ - : " أَمَرَنِي جِبْرِيلُ عَلَيْهِ السَّلَامُ أَنْ أَقْضِيَ بِالْيَمِينِ مَعَ الشَّاهِدِ " .
قُلْتُ : رَوَى لَهُ ابْنُ مَاجَهْ : أَنَّ النَّبِيَّ - صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ - قَضَى بِالْيَمِينِ مَعَ الشَّاهِدِ .
وَفِيهِ إِبْرَاهِيمُ بْنُ أَبِي حَيَّةَ ، وَهُوَ مَتْرُوكٌ .
قُلْتُ : رَوَى لَهُ ابْنُ مَاجَهْ : أَنَّ النَّبِيَّ - صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ - قَضَى بِالْيَمِينِ مَعَ الشَّاهِدِ .
وَفِيهِ إِبْرَاهِيمُ بْنُ أَبِي حَيَّةَ ، وَهُوَ مَتْرُوكٌ .
Sayyiduna Jabir bin Abdullah al-Ansari (may Allah be pleased with him) narrates: The Prophet (peace and blessings be upon him) said: "Jibril instructed me to give judgment on the basis of an oath along with one witness." (Allamah al-Haythami says:) I say: Ibn Majah recorded from this Companion
