Majma al-Zawaid — Hadith 11595

وَعَنْ أَنَسِ بْنِ مَالِكٍ أَنَّ النَّبِيَّ - صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ - قَرَأَ : "وَكَتَبْنَا عَلَيْهِمْ فِيهَا أَنَّ النَّفْسَ بِالنَّفْسِ وَالْعَيْنُ بِالْعَيْنِ" بِنَصْبِ النَّفْسِ ، وَرَفْعِ الْعَيْنِ . قُلْتُ : رَوَاهُ أَبُو دَاوُدَ غَيْرَ قَوْلِهِ : نَصْبِ النَّفْسِ ، وَرَفْعِ الْعَيْنِ . رَوَاهُ أَحْمَدُ ، وَرِجَالُهُ رِجَالُ الصَّحِيحِ غَيْرَ أَبِي عَلِيِّ بْنِ يَزِيدَ ، وَهُوَ ثِقَةٌ .
Sayyiduna Anas bin Malik (may Allah be pleased with him) narrates: The Prophet (peace and blessings be upon him) recited this verse: "And We prescribed for them therein that a life is for a life and an eye for an eye." The narrator says: That is, in it the Prophet (peace and blessings be upon him) recited the word "al-nafs" with a fathah and the word "al-'ayn" with a dammah.
(Allamah al-Haythami says:) I say: Abu Dawud recorded this narration, but he did not record the words: he recited the word "al-nafs" with a fathah and the word "al-'ayn" with a "dammah".
Ahmad recorded it, and its narrators are the narrators of the Sahih, except Abu Ali bin Yazid, who is thiqah (trustworthy).
