Majma al-Zawaid — Hadith 10771

وَعَنْ عُبَادَةَ قَالَ : وَقَضَى - يَعْنِي النَّبِيَّ - صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ - فِي دِيَةِ الْكُبْرَى الْمُغَلَّظَةِ ثَلَاثِينَ بِنْتَ لَبُونٍ ، وَثَلَاثِينَ حِقَّةً ، وَأَرْبَعِينَ خَلِفَةً . وَقَضَى فِي الدِّيَةِ الصُّغْرَى ثَلَاثِينَ بِنْتَ لَبُونٍ ، وَثَلَاثِينَ حِقَّةً ، وَعِشْرِينَ ابْنَةَ مَخَاضٍ ، وَعِشْرِينَ بَنِي مَخَاضٍ ذُكُورٍ .
ثُمَّ غَلَتِ الْإِبِلُ بَعْدَ وَفَاةِ رَسُولِ اللَّهِ - صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ - وَهَانَتِ الدَّرَاهِمُ ، فَقَوَّمَ عُمَرُ - رَضِيَ اللَّهُ عَنْهُ - إِبِلَ الدِّيَةِ سِتَّةَ آلَافِ دِرْهَمٍ حِسَابُ أُوقِيَّةٍ لِكُلِّ بَعِيرٍ . ثُمَّ غَلَتِ الْإِبِلُ وَهَانَتِ الْوَرِقُ فَزَادَ عُمَرُ أَلْفَيْنِ حِسَابَ أُوقِيَّتَيْنِ لِكُلِّ بَعِيرٍ . ثُمَّ غَلَتِ الْإِبِلُ وَهَانَتِ الدَّرَاهِمُ فَأَتَمَّهَا عُمَرُ اثْنَيْ عَشَرَ أَلْفًا حِسَابَ ثَلَاثِ أَوَاقٍ لِكُلِّ بَعِيرٍ .
قَالَ : فَزَادَ ثُلُثُ الدِّيَةِ فِي الشَّهْرِ الْحَرَامِ ، وَثُلُثًا آخَرَ فِي الْبَلَدِ الْحَرَامِ . قَالَ : فَتَمَّتِ دِيَةُ الْحَرَمَيْنِ عِشْرِينَ أَلْفًا . قَالَ : فَكَانَ يُقَالُ : يُؤْخَذُ مِنْ أَهْلِ الْبَادِيَةِ مِنْ مَاشِيَتِهِمْ وَلَا يُكَلَّفُونَ الْوَرِقَ ، وَلَا الذَّهَبَ ، وَيُؤْخَذُ مِنْ كُلِّ قَوْمٍ مَا لَهُمْ فِي الْعَدْلُ فِي أَمْوَالِهِمْ .
رَوَاهُ عَبْدُ اللَّهِ فِي زِيَادَاتِهِ عَلَى أَبِيهِ فِي حَدِيثٍ طَوِيلٍ تَقَدَّمَ فِي الْأَحْكَامِ ، وَإِسْحَاقُ بْنُ يَحْيَى لَمْ يُدْرِكْ عُبَادَةَ .
Sayyiduna Ubadah (may Allah be pleased with him) narrates: He, that is, the Prophet (peace and blessings be upon him), ruled concerning the major, heavy (mughallazah) blood money that thirty bint labun, thirty hiqqah and forty khalifah (pregnant she-camels) are to be paid. And concerning the minor blood money, he ruled that thirty bint labun, thirty hiqqah, twenty bint makhad and twenty male ibn makhad are to be paid. After the passing of the Prophet (peace and blessings be upon him), the price of camels rose and the value of dirhams fell, so Sayyiduna Umar (may Allah be pleased with him) set the camels of the blood money as equal to six thousand dirhams, reckoning one uqiyah for each camel. Then the price of camels rose and the value of silver fell, so Sayyiduna Umar (may Allah be pleased with him) added two thousand dirhams, which comes to two uqiyah for each camel. Then the price of camels rose further and the value of the dirham fell, so Sayyiduna Umar (may Allah be pleased with him) completed it at twelve thousand, in which the price of each camel comes to three uqiyah. The narrator said: In the sacred month, one third of the blood money is added, and in the sacred city (al-balad al-haram) a further third is added. The narrator said: So the blood money in the two Sanctuaries comes to a full twenty thousand. The narrator said: It used to be said that from the people of the desert their livestock will be taken, and they will not be obliged to pay in silver or gold (dirhams or dinars), and from every people payment will be taken out of their own particular wealth, in accordance with justice.
Abdullah recorded it in his Ziyadat (the additional narrations he recorded beyond those of his father), within a long hadith that has already passed in the Book of Rulings (Kitab al-Ahkam). The narrator Ishaq bin Yahya did not live in the time of Sayyiduna Ubadah (may Allah be pleased with him).
