Majma al-Zawaid — Hadith 10722

وَعَنْ مُحَمَّدِ بْنِ عَبْدِ الرَّحْمَنِ بْنِ أَبِي لَيْلَى ; أَنَّ ابْنَ مَسْعُودٍ قَالَ : شِبْهُ الْعَمْدِ الْحَجَرُ وَالْعَصَا وَالسَّوْطُ وَالدَّفْعَةُ ، وَكُلُّ شَيْءٍ عَمَدْتَهُ بِهِ ، فَفِيهِ التَّغْلِيظُ فِي الدِّيَةِ ، وَالْخَطَأُ أَنْ يَرْمِيَ شَيْئًا فَيُخْطِئَ بِهِ .
رَوَاهُ الطَّبَرَانِيُّ ، وَإِسْنَادُهُ مُنْقَطِعٌ بَيْنَ ابْنِ أَبِي لَيْلَى وَابْنِ مَسْعُودٍ ، وَرِجَالُهُ إِلَى ابْنِ أَبِي لَيْلَى رِجَالُ الصَّحِيحِ .
Muhammad bin Abd al-Rahman bin Abi Layla narrates that Sayyiduna Abdullah bin Mas'ud (may Allah be pleased with him) said: "Quasi-deliberate killing is by a stone, a staff, a whip or a shove, and in everything with which you acted deliberately, the aggravated blood money is due. Accidental killing is when someone throws something and it strikes (the victim) by mistake."
Al-Tabarani recorded it. Its chain is broken (munqati') between Ibn Abi Layla and Sayyiduna Abdullah bin Mas'ud (may Allah be pleased with him), and its narrators up to Ibn Abi Layla are the narrators of the Sahih.
