عَنْ أَبِي هُرَيْرَةَ عَنِ النَّبِيِّ - صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ - قَالَ : " مَنْ قُتِلَ فِي عِمِّيَّةٍ رَمْيًا يَكُونُ بَيْنَهُمْ بِحَجَرٍ أَوْ عَصًا أَوْ سَوْطٍ ، عَقْلُهُ عَقْلُ خَطَأٍ ، وَمَنْ قُتِلَ عَمْدًا فَهُوَ قَوَدٌ ، مَنْ حَالَ دُونَهُ فَعَلَيْهِ لَعْنَةُ اللَّهِ وَغَضَبُهُ ، لَا يَقْبَلُ اللَّهُ مِنْهُ صَرْفًا وَلَا عَدْلًا " . رَوَاهُ الطَّبَرَانِيُّ فِي الْأَوْسَطِ وَالْبَزَّارُ ، وَفِيهِ حَمْزَةُ النَّصِيبِيُّ ، وَهُوَ مَتْرُوكٌ .
Sayyiduna Abu Hurayrah (may Allah be pleased with him) reports this statement of the Prophet (peace and blessings be upon him): "Whoever dies during a collective brawl from being struck by a stone, a staff or a whip, his blood money is the blood money of accidental killing. Whoever is killed deliberately, retaliation (qisas) is due for it. Whoever obstructs that, the curse of Allah Almighty and His wrath will be upon him, and Allah Almighty will not accept any voluntary or obligatory worship from him."
Al-Tabarani recorded it in al-Mu'jam al-Awsat, and al-Bazzar also recorded it. Its chain contains Hamzah al-Nasibi, who is matruk (abandoned).
