Sayyiduna Jabir (may Allah be pleased with him) narrates: The Jews brought a man and a woman from among them who had committed adultery. The Prophet (peace and blessings be upon him) said: "Bring me the two most learned men among you." So the people brought the two sons of Suriya to him. The Prophet (peace and blessings be upon him) said: "Are you two more learned than those behind you?" They said: "That is what people claim." So the Prophet (peace and blessings be upon him) adjured them both by Allah, who revealed the Torah to Sayyiduna Musa: "What ruling do you find in the Torah of Allah concerning these two (the man and the woman)?" The two of them said: "We find this ruling in the Torah: When a man is found with a woman in a house, it is a suspicious situation, and there is a punishment for it. When a man is found in a woman's garment or upon her belly, it is a suspicious situation, and there is a punishment for it. And when four people testify that they saw the man, like the kohl stick going into the kohl container (that he committed adultery with that woman), he is to be stoned." The Prophet (peace and blessings be upon him) said: "Then what prevented you from stoning these two?" The two of them said: "Our authority has gone, so we disliked killing." The Prophet (peace and blessings be upon him) called for the witnesses; they testified, and the Prophet (peace and blessings be upon him) ordered that the two of them (the man and the woman) be stoned. (Allamah al-Haythami says:) I say:
Abu Dawud and others recorded it in abridged form.
Al-Bazzar recorded it via Mujalid, from al-Sha'bi, from Sayyiduna Jabir (may Allah be pleased with him), and Ibn Adi declared this narration sahih (authentic).
