بَابٌ فِي الْحَدِّ يَثْبُتُ عِنْدَ الْإِمَامِ فَيُشْفَعُ فِيهِ
A prescribed punishment established before the ruler, and then intercession is made for it

وَعَنْ أُمِّ سَلَمَةَ أَنَّ قُرَيْشًا أَهَمَّهُمْ شَأْنُ الْمَخْزُومِيَّةِ الَّتِي سَرَقَتْ ، قَالُوا : مَنْ يُكَلِّمُ فِيهَا رَسُولَ اللَّهِ - صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ - ؟ فَكَلَّمُوهُ فِي ذَلِكَ ، فَقَالَ رَسُولُ اللَّهِ - صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ - : " إِنَّمَا هَلَكَ الَّذِينَ مِنْ قَبْلِكُمْ أَنَّهُ كَانَ إِذَا سَرَقَ فِيهِمُ الشَّرِيفُ تَرَكُوهُ ، وَإِذَا سَرَقَ فِيهِمُ الضَّعِيفُ أَقَامُوا عَلَيْهِ الْحَدَّ ، وَايْمِ اللَّهِ لَوْ كَانَتْ فَاطِمَةُ بِنْتُ مُحَمَّدٍ لَقَطَعْتُ يَدَهَا " .
رَوَاهُ الطَّبَرَانِيُّ فِي الْأَوْسَطِ وَقَالَ : لَمْ يَرْوِهِ عَنْ عُمَرَ بْنِ قَيْسٍ الْمَاصِرِ إِلَّا عَمْرُو بْنُ أَبِي قَيْسٍ الرَّازِيُّ ، وَخَالَفَهُ أَصْحَابُ الزُّهْرِيِّ ، فَقَالُوا : عَنِ الزُّهْرِيِّ عَنْ عُرْوَةَ عَنْ عَائِشَةَ ، قُلْتُ : وَرِجَالُ الطَّبَرَانِيِّ ثِقَاتٌ .
رَوَاهُ الطَّبَرَانِيُّ فِي الْأَوْسَطِ وَقَالَ : لَمْ يَرْوِهِ عَنْ عُمَرَ بْنِ قَيْسٍ الْمَاصِرِ إِلَّا عَمْرُو بْنُ أَبِي قَيْسٍ الرَّازِيُّ ، وَخَالَفَهُ أَصْحَابُ الزُّهْرِيِّ ، فَقَالُوا : عَنِ الزُّهْرِيِّ عَنْ عُرْوَةَ عَنْ عَائِشَةَ ، قُلْتُ : وَرِجَالُ الطَّبَرَانِيِّ ثِقَاتٌ .
Sayyidah Umm Salamah (may Allah be pleased with her) says: Quraysh became troubled over the matter of the Makhzumi woman who had stolen. The people said: "Who will speak to the Messenger of Allah about this woman?" The people spoke to the Prophet (peace and blessings be upon him) about it, and the Prophet (peace and blessings be upon him) said: "The people before you were destroyed only because when a person of standing among them stole, they would leave him, and when a weak person stole, they would carry out the hadd punishment on him. By Allah, if Fatimah bint Muhammad had (done this), I would have had her hand cut off too."
Al-Tabarani recorded it in al-Mu'jam al-Awsat, and he says: From Umar bin Qays al-Masir,
no one narrated it except Amr bin Abi Qays al-Razi. The students of al-Zuhri differed from him, stating that it is narrated from al-Zuhri, from Urwah, from Sayyidah Aishah (may Allah be pleased with her).
(Allamah al-Haythami says:) I say: The narrators of al-Tabarani are thiqat (trustworthy).
Al-Tabarani recorded it in al-Mu'jam al-Awsat, and he says: From Umar bin Qays al-Masir,
no one narrated it except Amr bin Abi Qays al-Razi. The students of al-Zuhri differed from him, stating that it is narrated from al-Zuhri, from Urwah, from Sayyidah Aishah (may Allah be pleased with her).
