بَابٌ فِي الْحَدِّ يَثْبُتُ عِنْدَ الْإِمَامِ فَيُشْفَعُ فِيهِ
A prescribed punishment established before the ruler, and then intercession is made for it

وَعَنْ مُحَمَّدِ بْنِ يَزِيدَ بْنِ رُكَانَةَ أَنَّ خَالَتَهُ أُخْتَ مَسْعُودِ ابْنِ الْعَجْمَاءِ حَدَّثَتْهُ : أَنَّ أَبَاهَا قَالَ لِرَسُولِ اللَّهِ - صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ - فِي الْمَخْزُومِيَّةِ الَّتِي سَرَقَتْ قَطِيفَةً : نَفْدِيهَا بِأَرْبَعِينَ أُوقِيَّةً . فَقَالَ رَسُولُ اللَّهِ - صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ - : " لَأَنْ تُطَهَّرَ خَيْرٌ لَهَا " . فَأَمَرَ بِهَا فَقُطِعَتْ يَدُهَا ، وَهِيَ مِنْ بَنِي عَبْدِ الْأَشْهَلِ أَوْ مَنْ بَنِي أَسَدٍ .
قُلْتُ : رَوَاهُ ابْنُ مَاجَهْ عَنْهَا عَنْ أَبِيهَا ، وَهَذَا عَنْهَا نَفْسِهَا وَاللَّهُ أَعْلَمُ . رَوَاهُ أَحْمَدُ ، وَفِيهِ مُحَمَّدُ بْنُ إِسْحَاقَ ، وَهُوَ مُدَلِّسٌ .
قُلْتُ : رَوَاهُ ابْنُ مَاجَهْ عَنْهَا عَنْ أَبِيهَا ، وَهَذَا عَنْهَا نَفْسِهَا وَاللَّهُ أَعْلَمُ . رَوَاهُ أَحْمَدُ ، وَفِيهِ مُحَمَّدُ بْنُ إِسْحَاقَ ، وَهُوَ مُدَلِّسٌ .
Muhammad bin Yazid bin Rukanah says that his maternal aunt, the sister of Mas'ud bin al-Ajma', narrated this hadith to him: her father made a request to the Prophet (peace and blessings be upon him) concerning the Makhzumi woman who had stolen a blanket, requesting: "We will give forty uqiyyah as a ransom for her." The Prophet (peace and blessings be upon him) said: "If you let her be purified, that is better for her." Then, by the order of the Prophet (peace and blessings be upon him), that woman's hand was cut off. She was from Banu Abd al-Ashhal, or perhaps from Banu Asad.
(Allamah al-Haythami says:) I say: Ibn Majah recorded this narration from this woman, from her father, while here it is narrated from the woman herself; and Allah knows best.
Ahmad recorded it. Its chain contains Muhammad bin Ishaq, who is a mudallis.
