◈ Best Practices for Loan Verification and Legal Documentation in Islam ◈

Islam has outlined three primary Sharʿi methods for ensuring the documentation and verification of a loan transaction. These methods protect both the lender and the borrower and help prevent disputes.

The seller may ask the buyer for something as a guarantee or collateral.
This could be:

  • The same item purchased,
  • A piece of land,
  • A vehicle, or any other valuable asset.

Key Rule:
This pledged item remains with the lender. If the repayment is not made on time, the lender has the Sharʿi right to sell the pledged item to recover his due amount.

This involves a wealthy, reliable, and trustworthy person stepping in to say:

“I guarantee this person’s debt.”

When the loan term ends, the lender has the right to demand payment from the guarantor if the borrower fails to pay. The guarantor then bears full financial responsibility for the loan.

In this method, someone guarantees to present the debtor at the time of repayment. This is known as kafālah.

  • It does not cover the repayment itself,
  • It only ensures that the debtor is brought before the lender when the loan is due.

Difference Between Ḍamān and Kafālah:

  • Ḍamān ensures repayment of the loan,
  • Kafālah ensures physical presence of the debtor.

Once the guarantor presents the debtor, he is freed of all obligations.
