أَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ، أنبأ أَبُو الْوَلِيدِ، ثنا الْحَسَنُ بْنُ سُفْيَانَ، ثنا أَبُو بَكْرِ بْنُ أَبِي شَيْبَةَ، ثنا ابْنُ عُلَيَّهَ، عَنْ يُونُسَ، عَنِ الْحَسَنِ، فِي أُمِّ الْوَلَدِ تَجْنِي قَالَ: " تُقَوَّمُ عَلَى سَيِّدِهَا ".
Al-Hasan (may Allah have mercy on him) said: If an umm walad commits an offence, (its liability) is assessed against her master.
قَالَ: وحَدَّثَنَا أَبُو بَكْرٍ، ثنا عَبْدُ الْأَعْلَى، عَنْ مَعْمَرٍ، عَنِ الزُّهْرِيِّ، فِي أُمِّ الْوَلَدِ إِذَا جَنَتْ: " فَعَلَى سَيِّدِهَا جِنَايَتُهَا ".
Imam al-Zuhri (may Allah have mercy on him) said: When an umm walad (a slave woman who has borne her master's child) commits an offence, the liability for it rests on her master.
وَأَخْبَرَنَا أَبُو عَبْدِ اللهِ، أنبأ أَبُو الْوَلِيدِ، ثنا مُحَمَّدُ بْنُ أَحْمَدَ بْنِ زُهَيْرٍ، ثنا عَبْدُ اللهِ هُوَ ابْنُ هَاشِمٍ عَنْ وَكِيعٍ، عَنْ سُفْيَانَ، عَنْ خَالِدٍ، عَنْ أَبِي مَعْشَرٍ، عَنْ إِبْرَاهِيمَ، قَالَ: " جِنَايَةُ أُمِّ الْوَلَدِ عَلَى سَيِّدِهَا ".
Ibrahim (may Allah have mercy on him) said: The offence of an umm walad is the liability of her master.
أَخْبَرَنَا أَبُو عَبْدِ اللهِ، أنبأ أَبُو الْوَلِيدِ، ثنا الْحَسَنُ بْنُ سُفْيَانَ، ثنا أَبُو يَحْيَى، ثنا إِبْرَاهِيمُ بْنُ صَدَقَةَ، عَنْ سُفْيَانَ، عَنِ الْحَكَمِ قَالَ: " جِنَايَةُ أُمِّ الْوَلَدِ لَا تَعْدُو رَقَبَتَهَا ".
Al-Hakam said: "The liability for the offence of an umm walad does not go beyond her own person (her value)."
