أَخْبَرَنَا أَبُو أَحْمَدَ عَبْدُ اللهِ بْنُ مُحَمَّدِ بْنِ الْحَسَنِ الْمِهْرَجَانِيُّ، أنبأ أَبُو بَكْرِ بْنُ جَعْفَرٍ الْمُزَكِّي، ثنا مُحَمَّدُ بْنُ إِبْرَاهِيمَ الْبُوشَنْجِيُّ، ثنا ابْنُ بُكَيْرٍ، ثنا مَالِكٌ، عَنْ نَافِعٍ، ⦗٥٨٦⦘ عَنِ ابْنِ عُمَرَ، أَنَّهُ قَالَ فِي أُمِّ الْوَلَدِ يُتَوَفَّى عَنْهَا سَيِّدُهَا: " تَعْتَدُّ بِحَيْضَةٍ ". وَقَدْ مَضَى فِي كِتَابِ الْعِدَّةِ مَا رُوِيَ فِيهَا مِنَ الِاخْتِلَافِ، وَبِاللهِ التَّوْفِيقُ..
Nafi' narrates from Ibn Umar (may Allah be pleased with them both) that he said: When the master of an umm walad dies, the ruling concerning her waiting period ('iddah) is that she observes a waiting period of one menstrual cycle.
أَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ، أنبأ أَبُو الْوَلِيدِ، ثنا الْحَسَنُ بْنُ سُفْيَانَ، ثنا أَبُو بَكْرٍ، ثنا الْمُعْتَمِرُ بْنُ سُلَيْمَانَ، عَنْ كَثِيرِ بْنِ نُبَاتَةَ، عَنِ ابْنِ سِيرِينَ قَالَ: " إِذَا اشْتَرَى الرَّجُلُ الْوَصِيفَةَ لَمْ تَبْلُغِ الْمَحِيضَ اسْتَبْرَأَهَا بِثَلَاثَةِ أَشْهُرٍ ".
Ibn Sirin (may Allah have mercy on him) said: When a man buys a young slave girl who has not yet reached the age of menstruation, he observes istibra' (waiting to establish that the womb is free) with her for three months.
وَأَخْبَرَنَا أَبُو عَبْدِ اللهِ، أنبأ أَبُو الْوَلِيدِ، ثنا مُحَمَّدُ بْنُ أَحْمَدَ بْنِ زُهَيْرٍ، ثنا عَبْدُ اللهِ هُوَ ابْنُ هَاشِمٍ عَنْ وَكِيعٍ، عَنْ مِسْعَرٍ، وَسُفْيَانَ، عَنْ عَبْدِ الْكَرِيمِ، عَنْ مُجَاهِدٍ قَالَ: " ثَلَاثَةُ أَشْهُرٍ ".
Mujahid (may Allah have mercy on him) said: Three months.
