Abd al-Rahman bin Ghanm said: We were stationed at the city of Qinnasrin with Shurahbil bin al-Simt. When he conquered it, we obtained spoils, including animals (sheep and cattle). He divided part of it among us and put the remainder into the spoils. I mentioned this to Mu'adh bin Jabal (may Allah be pleased with him), and he said: "We were with the Messenger of Allah (peace and blessings be upon him) in the Battle of Khaybar; he (peace and blessings be upon him) divided a part of the spoils among us and put the rest into the spoils."

Qasim, the freed slave of Abd al-Rahman, narrated from the Companions of the Prophet (peace and blessings be upon him) (may Allah be pleased with them) that they said: We used to eat meat in the military expeditions without dividing it, and when we returned to our homes our bags were full of it.

Imam al-Shafi'i (may Allah have mercy on him) said: It has been narrated from some people, as I say, that the Prophet (peace and blessings be upon him) "permitted them to eat the spoils in enemy territory, but (said) do not take anything of it out." If this is established from the Messenger of Allah (peace and blessings be upon him), then with it there is no other argument; and if it is not established because there is an unknown narrator in it, then likewise among the narrators from whom its permissibility is reported there is also an unknown narrator.
The Shaykh said: By the first, Imam al-Shafi'i meant the hadith of al-Waqidi, and by the second, what we mentioned after it.

Abu Hamzah al-Attar (may Allah have mercy on him) asked al-Hasan (may Allah have mercy on him): "O Abu Sa'id, I am a man whose trade is in al-Aylah. I fill (my stomach) with food, then I go into enemy territory and eat dry and fresh dates there; what is your view of this?" Al-Hasan (may Allah have mercy on him) said: "We took part in a military expedition with Abd al-Rahman bin Samurah (may Allah be pleased with him), and Companions of the Prophet (peace and blessings be upon him) (may Allah be pleased with them) were also present. When they climbed up to the fruit, they would eat from it, but they would not spoil it nor carry it away."
