Sayyiduna Abu Sa'id al-Khudri (may Allah be pleased with him) said: Ever since a tipsy man was brought to the Prophet (peace and blessings be upon him), I do not drink nabidh made in earthenware jars. He said: "O Messenger of Allah, I have not drunk wine; rather, I made nabidh of raisins and dates in a gourd vessel (dubba') and drank it." So the Prophet (peace and blessings be upon him) ordered: "Let him be beaten with hands and sandals." And then he forbade making nabidh in this way.

A drinker was brought to Sayyiduna Umar (may Allah be pleased with him), and he said: I will send you to a man who will show you no leniency. He sent him to Muti' bin al-Aswad (may Allah be pleased with him) and said: Tomorrow morning apply the prescribed punishment to him. The next day Sayyiduna Umar (may Allah be pleased with him) went to him and found him beating very hard. On seeing this he said: You have all but killed the man! How many lashes have you given? He said: Sixty. He said: Waive the remaining 20 for him (let the severity of your beating count in place of them).
Abu Ubayd said: This hadith shows that "the drinker should not be flogged too severely, and that he is to be flogged after his intoxication has worn off."

Abu Majid said that the nephew of a man from among the Muslims became intoxicated. He said: "O Abu Abd al-Rahman (may Allah be pleased with him), my nephew has become intoxicated." He said: "Shake him about and smell his breath." They did so; then he was put in prison and summoned the next morning. After that he narrated the previous narration about the severe flogging.
Some of the people of knowledge reject this hadith, because Yahya al-Jabir is da'if (weak) and Abu Majid is majhul (unknown).
