Sayyiduna Abdullah bin Abbas (may Allah be pleased with them both) narrated that the Prophet (peace and blessings be upon him) did not fix any prescribed punishment for wine. He narrated that a man drank wine and became intoxicated; he was staggering about in the road. People were taking him to the Prophet (peace and blessings be upon him). When he came level with the house of Sayyiduna al-Abbas (may Allah be pleased with him), he broke free, went in to Sayyiduna al-Abbas (may Allah be pleased with him) and clung to him. When this was mentioned to the Prophet (peace and blessings be upon him), he (peace and blessings be upon him) smiled and said: "Did he really do that?" And he (peace and blessings be upon him) gave no order concerning him.

Sayyiduna Abdullah bin Abbas (may Allah be pleased with them both) said: The Prophet (peace and blessings be upon him) punished the drinker only at a later stage. He (peace and blessings be upon him) went on the expedition of Tabuk, and at night Abu Alqamah bin al-A'war al-Sulami (may Allah be pleased with him), dead drunk, came upon his (peace and blessings be upon him) chamber, until he cut some of the chamber's ropes. He (peace and blessings be upon him) asked: "Who is this?" It was said: Abu Alqamah, in a state of intoxication. Then he (peace and blessings be upon him) said: "Let someone take hold of him and leave him at his mount."
If this is authentically established from Sayyiduna Abdullah bin Abbas (may Allah be pleased with them both), then the meaning is that he (peace and blessings be upon him) did not fix a prescribed punishment for wine in words, but he fixed it in practice. Nor does this contradict the hadith that preceded, in which a man was seen staggering drunk in the road and, as they were bringing him to him (peace and blessings be upon him), he ran off to Sayyiduna al-Abbas (may Allah be pleased with him); for the prescribed punishment had not been established against him by his own confession or by the testimony of upright witnesses, and it was only presumed that he was intoxicated, so he left him.

Ibn Jurayj (may Allah have mercy on him) said: I said to Ata (may Allah have mercy on him): If the smell of drink comes from someone, would you flog him? He said: The smell of drink is nothing; but if they all drank something together and even one of them became intoxicated from it, I would give them all the full prescribed punishment.

It is narrated from Sayyiduna Abdullah bin Mas'ud (may Allah be pleased with him) that he said: I was sitting in Hims and the people said: Recite the Qur'an to us. I recited Surah Yusuf, and a man said: By Allah, it was not revealed like this. I said: Woe to you! I recited it to the Prophet (peace and blessings be upon him) and he (peace and blessings be upon him) said: "Very good," and you say this? While I was still speaking, I noticed the smell of wine on him, so I said: You drink wine and deny the Book of Allah? By Allah, I will not let you go home until I give you the prescribed punishment.

Sayyiduna Abdullah bin Amir bin Rabi'ah (may Allah be pleased with him) said that Sayyiduna Umar (may Allah be pleased with him) appointed Sayyiduna Qudamah bin Maz'un (may Allah be pleased with him) as governor over Bahrain. He was the maternal uncle of the Mother of the Believers Sayyidah Hafsah (may Allah be pleased with her) and of Sayyiduna Abdullah bin Umar (may Allah be pleased with them both). Al-Jarud (may Allah be pleased with him), the chief of Banu Abd al-Qays, came and said: O Commander of the Believers, Umar! Qudamah has drunk wine and become dead drunk. I have come to know of one of the prescribed punishments of Allah concerning him, so I have informed you. Sayyiduna Umar (may Allah be pleased with him) asked: Is there any other witness? He said: Sayyiduna Abu Hurayrah (may Allah be pleased with him). When he was asked, he said: I did not see him drinking wine, but he was vomiting in a state of intoxication. Sayyiduna Umar (may Allah be pleased with him) said: You have given half a testimony. Then Sayyiduna Umar (may Allah be pleased with him) summoned Sayyiduna Qudamah (may Allah be pleased with him) from Bahrain, and he came. Al-Jarud (may Allah be pleased with him) went to him and said: Apply the Book of Allah to this man. Sayyiduna Umar (may Allah be pleased with him) said: Are you a witness or a plaintiff? He said: I am a witness. He said: Then you have already given your testimony. The next day al-Jarud (may Allah be pleased with him) made the same demand again, and Sayyiduna Umar (may Allah be pleased with him) said: You are not acting as a witness but becoming a plaintiff. Al-Jarud (may Allah be pleased with him) said: I adjure you by Allah. Sayyiduna Umar (may Allah be pleased with him) said: Keep your tongue under control, or I will punish you. At this Sayyiduna Abu Hurayrah (may Allah be pleased with him) said: If our testimony is not accepted, then ask the daughter of al-Walid (who is Qudamah's wife). When she was asked, she too gave testimony. Then Sayyiduna Umar (may Allah be pleased with him) said to Sayyiduna Qudamah (may Allah be pleased with him): I will apply the prescribed punishment to you. Sayyiduna Qudamah (may Allah be pleased with him) said: You cannot apply the prescribed punishment to me. Sayyiduna Umar (may Allah be pleased with him) asked: Why? He said: Because Allah Almighty says: "There is no sin upon those who believe and do righteous deeds for what they have eaten." [Surah al-Ma'idah: 93] Sayyiduna Umar (may Allah be pleased with him) said: You are interpreting it wrongly; if you feared Allah, you would never do what is forbidden. Then Sayyiduna Umar (may Allah be pleased with him) consulted the people about flogging Sayyiduna Qudamah (may Allah be pleased with him), and they advised against it. He asked again, and they again advised against it, saying that he was ill. Then Sayyiduna Umar (may Allah be pleased with him) said: I would rather present myself before Allah having had the lashes given than have this prescribed punishment become a collar around my neck. Then he sent for a whip and applied the prescribed punishment to Sayyiduna Qudamah (may Allah be pleased with him). Sayyiduna Qudamah (may Allah be pleased with him) became angry with Sayyiduna Umar (may Allah be pleased with him), and in that state the two of them performed Hajj. When they returned from Hajj and stopped at al-Suqya, Sayyiduna Umar (may Allah be pleased with him) woke from his sleep and said: Bring Qudamah to me. He was called, but he refused to come. Sayyiduna Umar (may Allah be pleased with him) said: Bring him by force. So he was brought by force. He spoke with him and sought forgiveness for him, and this was their first reconciliation.
At the beginning of this story it is shown that Sayyiduna Umar (may Allah be pleased with him) did not apply the prescribed punishment to him on the basis of a mere smell and a single testimony until the matter was established.

Ibn Sirin (may Allah have mercy on him) said that al-Jarud (may Allah be pleased with him) came to Sayyiduna Umar (may Allah be pleased with him) and complained that the governor drank wine. Sayyiduna Umar (may Allah be pleased with him) asked for a witness, and he said: Sayyiduna Abu Hurayrah (may Allah be pleased with him). He (may Allah be pleased with him) said: He is your in-law, your in-law! And he said: I will certainly flog him. So he said: What right is this, that your in-law drinks wine and you flog my in-law? He asked: Who else? He said: Alqamah. So when the testimony was given, he ordered that he be flogged, and said: Since I took office, I have shown favour to no one in my rule except him, and I was not blessed in him. Go and flog him.

Abu Sasan said: I was with Sayyiduna Uthman bin Affan (may Allah be pleased with him) when al-Walid bin Uqbah was brought. Humran and another man had testified against him: one testified that he had drunk wine, and the other testified that he had seen him vomiting it. Sayyiduna Uthman bin Affan (may Allah be pleased with him) said: "One does not vomit it without drinking it. O Ali, apply the prescribed punishment to him." Sayyiduna Ali bin Abi Talib (may Allah be pleased with him) told Sayyiduna al-Hasan bin Ali (may Allah be pleased with them both) to do it, and Sayyiduna al-Hasan bin Ali (may Allah be pleased with them both) said: "Let the one who has taken charge of its ease (the benefits of office) also take charge of its hardship." Then Sayyiduna Ali bin Abi Talib (may Allah be pleased with him) told Sayyiduna Abdullah bin Ja'far (may Allah be pleased with them both), and he carried out the prescribed punishment. When forty lashes were complete, Sayyiduna Ali bin Abi Talib (may Allah be pleased with him) stopped him and said: "The Prophet (peace and blessings be upon him) and Sayyiduna Abu Bakr al-Siddiq (may Allah be pleased with him) gave 40 lashes, and Sayyiduna Umar bin al-Khattab (may Allah be pleased with him) gave 80. All of these are Sunnah, but this (forty) is dearer to me." Imam al-Shafi'i (may Allah have mercy on him) said: The prescribed punishment is not to be applied until there is certainty.
