Abu Sasan said: I was with Sayyiduna Uthman bin Affan (may Allah be pleased with him) when al-Walid bin Uqbah was brought. Humran and another man had testified against him: one testified that he had drunk wine, and the other testified that he had seen him vomiting it. Sayyiduna Uthman bin Affan (may Allah be pleased with him) said: "One does not vomit it without drinking it. O Ali, apply the prescribed punishment to him." Sayyiduna Ali bin Abi Talib (may Allah be pleased with him) told Sayyiduna al-Hasan bin Ali (may Allah be pleased with them both) to do it, and Sayyiduna al-Hasan bin Ali (may Allah be pleased with them both) said: "Let the one who has taken charge of its ease (the benefits of office) also take charge of its hardship." Then Sayyiduna Ali bin Abi Talib (may Allah be pleased with him) told Sayyiduna Abdullah bin Ja'far (may Allah be pleased with them both), and he carried out the prescribed punishment. When forty lashes were complete, Sayyiduna Ali bin Abi Talib (may Allah be pleased with him) stopped him and said: "The Prophet (peace and blessings be upon him) and Sayyiduna Abu Bakr al-Siddiq (may Allah be pleased with him) gave 40 lashes, and Sayyiduna Umar bin al-Khattab (may Allah be pleased with him) gave 80. All of these are Sunnah, but this (forty) is dearer to me." Imam al-Shafi'i (may Allah have mercy on him) said: The prescribed punishment is not to be applied until there is certainty.
