أَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ، ثنا أَبُو الْعَبَّاسِ مُحَمَّدُ بْنُ يَعْقُوبَ، ثنا مُحَمَّدُ بْنُ إِسْحَاقَ الصَّغَانِيُّ، ثنا أَبُو الْجَوَّابِ، ثنا عَمَّارٌ هُوَ ابْنُ رُزَيْقٍ عَنْ أَبِي حُصَيْنٍ، عَنِ الشَّعْبِيِّ، قَالَ: أُتِيَ عَلِيٌّ رَضِيَ اللهُ عَنْهُ بِشَرَاحَةَ الْهَمْدَانِيَّةِ قَدْ فَجَرَتْ، فَرَدَّهَا حَتَّى وَلَدَتْ، فَلَمَّا وَلَدَتْ قَالَ: ائْتُونِي بِأَقْرَبِ النِّسَاءِ مِنْهَا، فَأَعْطَاهَا وَلَدَهَا، ثُمَّ جَلَدَهَا وَرَجَمَهَا، ثُمَّ قَالَ: جَلَدْتُهَا بِكِتَابِ اللهِ، وَرَجَمْتُهَا بِالسُّنَّةِ، ثُمَّ قَالَ: " أَيُّمَا امْرَأَةٍ نَعَى عَلَيْهَا وَلَدُهَا، أَوْ كَانَ اعْتِرَافٌ، فَالْإِمَامُ أَوَّلُ مَنْ يَرْجُمُ، ثُمَّ النَّاسُ، فَإِنْ نَعَاهَا الشُّهُودُ فَالشُّهُودُ أَوَّلُ مَنْ يَرْجُمُ، ثُمَّ الْإِمَامُ ثُمَّ النَّاسُ ".
Al-Sha'bi said that Sharahah al-Hamdaniyyah, who had committed adultery, was brought to Sayyiduna Ali (may Allah be pleased with him); then he sent her back so that she could give birth. When the child was born, he said: Call her closest female relative. She was called, then the child was given to her; then he (may Allah be pleased with him) first flogged her, then stoned her, and said: I have flogged her on account of the Book of Allah and stoned her according to the Sunnah of the Messenger (peace and blessings be upon him). Then he said: Any woman whose adultery becomes evident through confession or pregnancy, the imam should be the first to stone her, then the people; and if her adultery became evident through testimony, then the witnesses should stone first, then the imam and then the people.
وَأَخْبَرَنَا أَبُو زَكَرِيَّا بْنُ أَبِي إِسْحَاقَ الْمُزَكِّي، أنبأ أَبُو عَبْدِ اللهِ مُحَمَّدُ بْنُ يَعْقُوبَ الشَّيْبَانِيُّ، ثنا مُحَمَّدُ بْنُ عَبْدِ الْوَهَّابِ، أنبأ جَعْفَرُ بْنُ عَوْنٍ، أنبأ الْأَجْلَحُ، عَنِ الشَّعْبِيِّ، قَالَ: جِيءَ بِشَرَاحَةَ الْهَمْدَانِيَّةِ إِلَى عَلِيٍّ رَضِيَ اللهُ عَنْهُ، فَقَالَ لَهَا: وَيْلَكِ لَعَلَّ رَجُلًا وَقَعَ عَلَيْكِ وَأَنْتِ نَائِمَةٌ، قَالَتْ: لَا، قَالَ: لَعَلَّكِ اسْتَكْرَهَكِ، قَالَتْ: لَا، قَالَ: لَعَلَّ زَوْجَكِ مِنْ عَدُوِّنَا هَذَا أَتَاكِ، فَأَنْتِ تَكْرَهِينَ أَنْ تَدُلِّي عَلَيْهِ يُلَقِّنُهَا لَعَلَّهَا تَقُولُ: نَعَمْ قَالَ: فَأَمَرَ بِهَا فَحُبِسَتْ، فَلَمَّا وَضَعَتْ مَا فِي بَطْنِهَا أَخْرَجَهَا يَوْمَ الْخَمِيسِ فَضَرَبَهَا مِائَةً، وَحَفَرَ لَهَا يَوْمَ الْجُمُعَةِ فِي الرَّحَبَةِ، وَأَحَاطَ النَّاسُ بِهَا وَأَخَذُوا الْحِجَارَةَ، فَقَالَ: لَيْسَ هَكَذَا الرَّجْمُ، إِذًا يُصِيبُ بَعْضُكُمْ بَعْضًا، صُفُّوا كَصَفِّ الصَّلَاةِ، صَفًّا خَلْفَ صَفٍّ، ثُمَّ قَالَ: أَيُّهَا النَّاسُ أَيُّمَا امْرَأَةٍ جِيءَ بِهَا، وَبِهَا حَبَلٌ، يَعْنِي، أَوِ اعْتَرَفَتْ فَالْإِمَامُ أَوَّلُ مَنْ يَرْجُمُ ثُمَّ النَّاسُ، وَأَيُّمَا امْرَأَةٍ جِيءَ بِهَا، أَوْ رَجُلٍ زَانٍ فَشَهِدَ عَلَيْهِ أَرْبَعَةٌ بِالزِّنَا، فَالشُّهُودُ أَوَّلُ مَنْ يَرْجُمُ، ثُمَّ الْإِمَامُ ثُمَّ النَّاسُ، ثُمَّ رَجَمَهَا ثُمَّ أَمَرَهُمْ فَرَجَمَ صَفٌّ ثُمَّ صَفٌّ، ثُمَّ قَالَ: افْعَلُوا بِهَا مَا تَفْعَلُونَ بِمَوْتَاكُمْ " قَالَ الشَّيْخُ رَحِمَهُ اللهُ: قَدْ ذَكَرْنَا أَنَّ جَلْدَ الثَّيِّبِ صَارَ مَنْسُوخًا، وَأَنَّ الْأَمْرَ صَارَ إِلَى الرَّجْمِ فَقَطْ.
Al-Sha'bi said that Sharahah al-Hamdaniyyah was brought to Sayyiduna Ali (may Allah be pleased with him), and he said to her: Woe to you! Perhaps a man had intercourse with you while you were asleep? She said: No. He said: Perhaps he forced you? She said: No. He said: Perhaps your husband, who is among this enemy of ours, came to you, and you do not want to point him out? He was prompting her in the hope that she would say yes. Then he gave orders concerning her and she was confined. When she had delivered what was in her womb, he brought her out on Thursday and gave her a hundred lashes, and on Friday he had a pit dug for her in al-Rahabah. The people surrounded her and took up stones, but he said: This is not how stoning is done; this way you would hit one another. Line up like the rows of prayer, row behind row. Then he said: O people, any woman who is brought while pregnant, or who confesses, the imam is the first to stone her, then the people; and any woman, or adulterous man, who is brought and against whom four people testify to adultery, the witnesses are the first to stone, then the imam, then the people. Then he stoned her, then he ordered them, and one row after another stoned her. Then he said: Do with her what you do with your dead.
