أَخْبَرَنَا أَبُو سَعِيدِ بْنُ أَبِي عَمْرٍو، ثنا أَبُو الْعَبَّاسِ الْأَصَمُّ، ثنا بَحْرُ بْنُ نَصْرٍ، ثنا ابْنُ وَهْبٍ، أَخْبَرَنِي ابْنُ لَهِيعَةَ، عَنْ يَحْيَى بْنِ سَعِيدٍ، أَنَّ مِنَ السُّنَّةِ، أَنْ تُنَجَّمَ، الدِّيَةُ فِي ثَلَاثِ سِنِينَ.
Yahya bin Sa'id (may Allah have mercy on him) said: It is the Sunnah that the diyah be fixed in instalments over three years.
وَأَخْبَرَنَا أَبُو سَعِيدٍ، ثنا أَبُو الْعَبَّاسِ، أنبأ الرَّبِيعُ بْنُ سُلَيْمَانَ، أنبأ الشَّافِعِيُّ، أنبأ مُسْلِمٌ، عَنِ ابْنِ جُرَيْجٍ، قَالَ: قُلْتُ لِعَطَاءٍ: تَغْلِيظُ الْإِبِلِ؟ قَالَ: مِائَةٌ مِنَ الْأَصْنَافِ كُلِّهَا، وَيُؤْخَذُ فِي مُضِيِّ كُلِّ سَنَةٍ ثَلَاثَ عَشْرَةَ خَلِفَةً وَثُلُثٌ، وَعَشْرُ جِذَاعٍ، وَعَشْرُ حِقَاقٍ قَالَ الشَّافِعِيُّ: وَالتَّغْلِيظُ كَمَا قَالَ عَطَاءٌ، يُؤْخَذُ فِي مُضِيِّ كُلِّ سَنَةٍ ثَلَاثَ عَشْرَةَ وَثُلُثٌ، وَعَشْرُ حِقَاقٍ، وَعَشْرُ جِذَاعٍ.
Ibn Jurayj (may Allah have mercy on him) said: I asked Ata' (may Allah have mercy on him) about the aggravated diyah in camels, and he said: One hundred, from all the categories, and at the passing of each year 13 and a third pregnant she-camels, 10 hiqqahs and 10 jadha'ahs are taken. And Imam al-Shafi'i (may Allah have mercy on him) also said the same.
