Bayhaqi 16130 — Blood money for quasi-deliberate killing is due

It is narrated from Abu Hurayrah (may Allah be pleased with him) that two women of Hudhayl fought, and one of them struck the other with a stone, which hit her belly; she died and her unborn child was also aborted. He (peace and blessings be upon him) ruled that the diyah of that woman be paid by the 'aqilah (paternal kinsmen) of the other woman, and that a male or a female slave be given for the unborn child. Then someone said: How can we pay diyah for one who neither eats nor drinks, who neither spoke nor cried out? Such blood should go unrequited. So, according to Abu Hurayrah (may Allah be pleased with him), the Prophet (peace and blessings be upon him) said about him: "This one is of the brothers of the soothsayers."
