أَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ، ثنا أَبُو الْعَبَّاسِ مُحَمَّدُ بْنُ يَعْقُوبَ، ثنا أَحْمَدُ بْنُ شَيْبَانَ، ثنا سُفْيَانُ بْنُ عُيَيْنَةَ، ح وَأَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ، وَأَبُو زَكَرِيَّا يَحْيَى بْنُ إِبْرَاهِيمَ بْنِ مُحَمَّدِ بْنِ يَحْيَى، قَالَا: ثنا أَبُو الْعَبَّاسِ مُحَمَّدُ بْنُ يَعْقُوبَ، أنبأ الرَّبِيعُ بْنُ سُلَيْمَانَ، أنبأ الشَّافِعِيُّ، أنبأ سُفْيَانُ بْنُ عُيَيْنَةَ، عَنْ مُطَرِّفٍ، عَنِ الشَّعْبِيِّ، عَنْ أَبِي جُحَيْفَةَ، قَالَ: سَأَلْتُ عَلِيًّا رَضِيَ اللهُ عَنْهُ، وَفِي رِوَايَةِ ابْنِ شَيْبَانَ قَالَ: قُلْتُ لِعَلِيٍّ رَضِيَ اللهُ عَنْهُ: هَلْ عِنْدَكُمْ مِنَ النَّبِيِّ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ شَيْءٌ، سِوَى الْقُرْآنِ؟ فَقَالَ لَا، وَالَّذِي فَلَقَ الْحَبَّةَ وَبَرَأَ النَّسَمَةَ إِلَّا أَنْ يُعْطِيَ اللهُ عَبْدًا فَهْمًا فِي كِتَابِهِ وَمَا فِي الصَّحِيفَةِ. قُلْتُ: وَمَا فِي الصَّحِيفَةِ؟ قَالَ:: " الْعَقْلُ، وَفِكَاكُ الْأَسِيرِ، وَلَا يُقْتَلُ مُسْلِمٌ بِكَافِرٍ "،.
Sayyiduna Abu Juhayfah (may Allah be pleased with him) said: I asked Sayyiduna Ali (may Allah be pleased with him), and in the narration of Ibn Shayban: I said to Ali (may Allah be pleased with him): Do you have anything from the Prophet of Allah (peace and blessings be upon him) other than the Qur'an? He said: No, by the One who splits the seed and creates living beings, except the understanding of the Book of Allah that Allah gives to His servant, and what is in the scroll. I asked: What is written in the scroll? He said: "Blood money, freeing captives, and that a Muslim is not to be killed in return for a disbeliever."
وَأَخْبَرَنَا أَبُو عَمْرٍو مُحَمَّدُ بْنُ عَبْدِ اللهِ الْأَدِيبُ، أنبأ أَبُو بَكْرٍ الْإِسْمَاعِيلِيُّ، أَخْبَرَنِي أَبُو يَعْلَى، ثنا هَارُونُ بْنُ مَعْرُوفٍ، ثنا سُفْيَانُ، عَنْ مُطَرِّفٍ، قَالَ: سَمِعْتُ الشَّعْبِيَّ، يَقُولُ: أَخْبَرَنِي أَبُو جُحَيْفَةَ، قَالَ: قُلْتُ لِعَلِيٍّ رَضِيَ اللهُ عَنْهُ، فَذَكَرَهُ بِمِثْلِهِ. رَوَاهُ الْبُخَارِيُّ فِي الصَّحِيحِ، عَنْ صَدَقَةَ بْنِ الْفَضْلِ، عَنْ سُفْيَانَ بْنِ عُيَيْنَةَ.

أَخْبَرَنَا أَبُو عَمْرٍو الْأَدِيبُ، أنبأ أَبُو بَكْرٍ الْإِسْمَاعِيلِيُّ، أنبأ يُوسُفُ الْقَاضِي، ثنا عَمْرُو بْنُ مَرْزُوقٍ، أنبأ زُهَيْرٌ، عَنْ مُطَرِّفٍ، عَنْ عَامِرٍ، عَنْ أَبِي جُحَيْفَةَ، قَالَ: قُلْتُ لِعَلِيٍّ رَضِيَ اللهُ عَنْهُ: يَا أَمِيرَ الْمُؤْمِنِينَ هَلْ عِنْدَكُمْ مِنَ الْوَحْيِ شَيْءٌ؟ قَالَ: لَا وَالَّذِي فَلَقَ الْحَبَّةَ وَبَرَأَ النَّسَمَةَ، مَا أَعْلَمُ إِلَّا فَهْمًا يُعْطِيهِ اللهُ عَزَّ وَجَلَّ رَجُلًا وَمَا فِي الصَّحِيفَةِ. قُلْتُ: وَمَا فِي الصَّحِيفَةِ؟ قَالَ: " الْعَقْلُ، وَفِكَاكُ الْأَسِيرِ، وَلَا يُقْتَلُ مُؤْمِنٌ بِمُشْرِكٍ ". قَالَ زُهَيْرٌ: فَقُلْتُ لِمُطَرِّفٍ: وَمَا فِكَاكُ الْأَسِيرِ؟ قَالَ: أَنْ يُفَكَّ مِنَ الْعَدُوِّ، جَرَتْ بِذَلِكَ السُّنَّةُ. وَقَالَ مُطَرِّفٌ: الْعَقْلُ الْمَعْقُلَةُ. رَوَاهُ الْبُخَارِيُّ فِي الصَّحِيحِ، عَنْ أَحْمَدَ بْنِ يُونُسَ، عَنْ زُهَيْرٍ.
Sayyiduna Abu Juhayfah (may Allah be pleased with him) said: I asked Sayyiduna Ali (may Allah be pleased with him): Do you have anything of the revelation? He said: "No. By the One who splits the seed and creates living beings! I know nothing beyond the understanding of the Qur'an that Allah Almighty gives to His servant, and this scroll." I said: What is in this scroll? He said: "Blood money, freeing captives (from the enemy), and that a believer will not be killed in return for a polytheist."
Zuhayr said: I asked Mutarrif: What is 'fikak al-asir'? He said: That the captive be freed from the enemy; the Sunnah has been established on this. And Mutarrif further said that 'al-aql' means blood money.

أَخْبَرَنَا أَبُو الْحَسَنِ عَلِيُّ بْنُ مُحَمَّدٍ الْمُقْرِئُ، أنبأ الْحَسَنُ بْنُ مُحَمَّدِ بْنِ إِسْحَاقَ، ثنا يُوسُفُ بْنُ يَعْقُوبَ، ثنا مُحَمَّدُ بْنُ الْمِنْهَالِ، ثنا يَزِيدُ بْنُ زُرَيْعٍ، ثنا سَعِيدُ بْنُ أَبِي عَرُوبَةَ، عَنْ قَتَادَةَ، عَنِ الْحَسَنِ، عَنْ قَيْسِ بْنِ عَبَّادٍ، قَالَ: أَتَيْنَا عَلِيًّا رَضِيَ اللهُ عَنْهُ، أَنَا وَجَارِيَةُ بْنُ قُدَامَةَ السَّعْدِيُّ، فَقُلْنَا: هَلْ مَعَكَ عَهْدٌ مِنْ رَسُولِ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ؟ فَقَالَ: لَا، إِلَّا مَا فِي قِرَابِ سَيْفِي. فَأَخْرَجَ لَنَا مِنْهُ كِتَابًا فَقَرَأَهُ فَإِذَا فِيهِ: " الْمُسْلِمُونَ تَتَكَافَأُ دِمَاؤُهُمْ، وَيَسْعَى بِذِمَّتِهِمْ أَدْنَاهُمْ، وَهُمْ يَدٌ عَلَى مَنْ سِوَاهُمْ، أَلَا لَا يُقْتَلُ مُسْلِمٌ بِكَافِرٍ، وَلَا ذُو عَهْدٍ فِي عَهْدِهِ إِلَّا مَنْ أَحْدَثَ حَدَثًا أَوْ آوَى مُحْدِثًا، فَعَلَيْهِ لَعْنَةُ اللهِ وَالْمَلَائِكَةِ وَالنَّاسِ أَجْمَعِينَ ".
Qays bin Abbad (may Allah have mercy on him) said: We came to Sayyiduna Ali (may Allah be pleased with him), and Jariyah bin Qudamah al-Sa'di (may Allah be pleased with him) was with me. We asked: Do you have any covenant from the Messenger of Allah (peace and blessings be upon him)? He said: No, only what is in the sheath of my sword. Then he took out a letter from it and read it, and in it was written: "The blood of the Muslims is equal, one to another; the protection granted by the lowest of them is honoured; and they will be helped against those besides them. Beware! A Muslim is not to be killed in return for a disbeliever, nor one who has a covenant while his covenant lasts. Whoever introduces an innovation or gives shelter to an innovator, upon him is the curse of Allah, the angels and all people."
أَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ، ثنا أَبُو الْعَبَّاسِ مُحَمَّدُ بْنُ يَعْقُوبَ، أنبأ الرَّبِيعُ بْنُ سُلَيْمَانَ، أنبأ الشَّافِعِيُّ، أنبأ مُسْلِمُ بْنُ خَالِدٍ، عَنِ ابْنِ أَبِي حُسَيْنٍ عَنْ عَطَاءٍ، وَطَاوُسٍ، أَحْسَبُهُ قَالَ: وَمُجَاهِدٍ، وَالْحَسَنِ، أَنَّ رَسُولَ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ قَالَ يَوْمَ الْفَتْحِ: " لَا يُقْتَلُ مُؤْمِنٌ بِكَافِرٍ " قَالَ الشَّافِعِيُّ رَحِمَهُ اللهُ: وَهَذَا عَامٌّ عِنْدَ أَهْلِ الْمَغَازِي أَنَّ رَسُولَ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ، تَكَلَّمَ بِهِ فِي خُطْبَتِهِ يَوْمَ الْفَتْحِ وَهُوَ يُرْوَى عَنِ النَّبِيِّ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ مُسْنَدًا مِنْ حَدِيثِ عَمْرِو بْنِ شُعَيْبٍ وَحَدِيثِ عِمْرَانَ بْنِ حُصَيْنٍ. قَالَ الشَّيْخُ: أَمَّا حَدِيثُ عَمْرٍو.
Ata, Tawus, (and, the narrator thinks, also) Mujahid and al-Hasan (may Allah have mercy on them) narrate from the Prophet (peace and blessings be upon him) that on the day of the Conquest of Makkah he (peace and blessings be upon him) said: "A believer is not to be killed in return for a disbeliever."
Imam al-Shafi'i (may Allah have mercy on him) said: It is commonly known among the scholars of the military expeditions (maghazi) that the Messenger of Allah (peace and blessings be upon him) said this in his sermon on the day of the Conquest, and it is narrated from the Prophet (peace and blessings be upon him) with a connected chain (musnad) through the hadith of Amr bin Shu'ayb and the hadith of Imran bin Husayn.

فَأَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ، وَأَبُو سَعِيدِ بْنُ أَبِي عَمْرٍو قَالَا: ثنا أَبُو الْعَبَّاسِ مُحَمَّدُ بْنُ يَعْقُوبَ، ثنا أَحْمَدُ بْنُ عَبْدِ الْجَبَّارِ الْعُطَارِدِيُّ، ثنا يُونُسُ بْنُ بُكَيْرٍ. ح وَأَخْبَرَنَا أَبُو طَاهِرٍ الْفَقِيهُ، أنبأ أَبُو حَامِدِ بْنُ بِلَالٍ، ثنا أَبُو الْأَزْهَرِ، ثنا يَعْقُوبُ بْنُ إِبْرَاهِيمَ بْنِ سَعْدٍ، ثنا أَبِي جَمِيعًا، عَنِ ابْنِ إِسْحَاقَ، حَدَّثَنِي عَمْرُو بْنُ شُعَيْبٍ، عَنْ أَبِيهِ، عَنْ جَدِّهِ، قَالَ: خَطَبَ رَسُولُ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ النَّاسَ عَامَ الْفَتْحِ فَقَالَ: " أَيُّهَا النَّاسُ إِنَّهُ مَا كَانَ مِنْ حِلْفٍ فِي الْجَاهِلِيَّةِ فَإِنَّ الْإِسْلَامَ لَمْ يَزِدْهُ إِلَّا شِدَّةً، وَلَا حِلْفَ فِي الْإِسْلَامِ، وَالْمُسْلِمُونَ يَدٌ عَلَى مَنْ سِوَاهُمْ، يَسْعَى بِذِمَّتِهِمْ أَدْنَاهُمْ، يَرُدُّ عَلَيْهِمْ أَقْصَاهُمْ، تُرَدُّ سَرَايَاهُمْ عَلَى قَعَدَتِهِمْ، لَا يُقْتَلُ مُؤْمِنٌ بِكَافِرٍ، دِيَةُ الْكَافِرِ نِصْفُ دِيَةِ الْمُؤْمِنِ، لَا جَلَبَ وَلَا جَنَبَ، وَلَا تُؤْخَذُ صَدَقَاتُهُمْ إِلَّا فِي دُورِهِمْ " لَفْظُ حَدِيثِ يُونُسَ بْنِ بُكَيْرٍ.
Amr bin Shu'ayb (may Allah have mercy on him) narrates from his father, and he from his grandfather (Sayyiduna Abdullah bin Amr, may Allah be pleased with them both), that the Messenger of Allah (peace and blessings be upon him) delivered a sermon in the year of the Conquest of Makkah and said: "O people! Whatever alliance there was in Jahiliyyah, Islam has only made it stronger, and there is no (new) alliance in Islam. The Muslims are one hand against others; the protection granted by the lowest of them is honoured; the farthest of them returns (the spoils) to them; the spoils of their raiding parties are shared with those who stay behind; no believer will be killed in return for a disbeliever; the blood money of a disbeliever is half the blood money of a believer; there is no jalab and no janab (the zakah collector does not make people bring their animals to him, nor do the owners take their animals away from him); and their zakah is not to be taken except at their own dwellings."
وَأَخْبَرَنَا أَبُو عَلِيٍّ، أَخْبَرَنَا أَبُو بَكْرِ بْنُ دَاسَةَ، ثنا أَبُو دَاوُدَ، ثنا عُبَيْدُ اللهِ بْنُ عُمَرَ، حَدَّثَنِي هُشَيْمٌ، عَنْ يَحْيَى بْنُ سَعِيدٍ، عَنْ عَمْرِو بْنِ شُعَيْبٍ، عَنْ أَبِيهِ، عَنْ جَدِّهِ، قَالَ: قَالَ رَسُولُ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ: " الْمُسْلِمُونَ تَكَافَأُ دِمَاؤُهُمْ يَسْعَى بِذِمَّتِهِمْ أَدْنَاهُمْ وَيُجِيرُ عَلَيْهِمْ أَقْصَاهُمْ وَهُمْ يَدٌ عَلَى مَنْ سُوَاهُمْ يَرُدُّ مُشِدُّهُمْ عَلَى مُضْعِفِهِمْ وَمُتَسَرِّعُهُمْ عَلَى قَاعِدِهِمْ لَا يُقْتَلُ مُؤْمِنٌ بِكَافِرٍ وَلَا ذُو عَهْدٍ فِي عَهْدِهِ " وَأَمَّا حَدِيثُ عِمْرَانَ.
Amr bin Shu'ayb narrates from his father, and he from his grandfather (may Allah be pleased with him), that the Messenger of Allah (peace and blessings be upon him) said: "The blood of the believers is equal, one to another; the protection granted by the lowest of them is honoured; the farthest of them may grant protection on their behalf; they will be helped against those besides them; the strong among them shares (the spoils) with the weak, and the one who rushes ahead (to fight) with the one who stays behind; a believer is not to be killed in return for a disbeliever, nor one who has a covenant while his covenant lasts."
فَأَخْبَرَنَا أَبُو بَكْرِ بْنُ الْحَسَنِ، وَأَبُو زَكَرِيَّا بْنُ أَبِي إِسْحَاقَ، وَأَبُو سَعِيدِ بْنُ أَبِي عَمْرٍو، قَالُوا ثنا أَبُو الْعَبَّاسِ مُحَمَّدُ بْنُ يَعْقُوبَ، ثنا بَحْرُ بْنُ نَصْرٍ، ثنا ابْنُ وَهْبٍ، أَخْبَرَنِي يَزِيدُ بْنُ عِيَاضٍ، عَنْ عَبْدِ الْمَلِكِ بْنِ عُبَيْدٍ، عَنْ خُرَيْنِقَ بِنْتِ الْحُصَيْنِ، عَنْ أَخِيهَا، عِمْرَانَ بْنِ الْحُصَيْنِ، قَالَ: قَالَ رَسُولُ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ يَوْمَ الْفَتْحِ: " أَلَمْ تَرَ إِلَى ⦗٥٥⦘ مَا صَنَعَ صَاحِبُكُمْ هِلَالُ بْنُ أُمَيَّةَ؟ لَوْ قَتَلْتُ مُؤْمِنًا بِكَافِرٍ لَقَتَلْتُهُ فَدُوهُ "، فَوَدَيْنَاهُ وَبَنُو مُدْلِجٍ مَعَنَا، فَجَاءُوا بِغَنَمٍ عُفْرٍ لَمْ أَرَ أحْسَنَ مِنْهَا أَلْوَانًا. وَكَانَتْ بَنُو مُدْلِجٍ حُلَفَاءَ بَنِي كَعْبٍ فِي الْجَاهِلِيَّةِ. وَرَوَاهُ أَيْضًا الْوَاقِدِيُّ، عَنْ عُمَرَ بْنِ عُثْمَانَ عَنْ عَبْدِ الْمَلِكِ بْنِ عُبَيْدٍ، إِلَّا أَنَّهُ قَالَ: خِرَاشُ بْنُ أُمَيَّةَ، بَدَلَ هِلَالِ بْنِ أُمَيَّةَ، وَلَمْ يذْكُرِ الدِّيَةَ وَمَا بَعْدَهَا.
Sayyiduna Imran bin Husayn (may Allah be pleased with him) narrated that on the day of the Conquest of Makkah the Messenger of Allah (peace and blessings be upon him) said: "Have you not seen what your companion Hilal bin Umayyah has done? If a believer were to be killed in return for a disbeliever, I would have killed him. Pay compensation for him." So we paid them the compensation. Banu Mudlij were with us, and they brought very beautiful sheep, of such fine colours as we had never seen before. Banu Mudlij had been allies of Banu Ka'b in Jahiliyyah.

أَخْبَرَنَا أَبُو سَعِيدٍ مُحَمَّدُ بْنُ مُوسَى بْنِ الْفَضْلِ الصَّيْرَفِيُّ، ثنا أَبُو الْعَبَّاسِ مُحَمَّدُ بْنُ يَعْقُوبَ، ثنا مُحَمَّدُ بْنُ سِنَانٍ، ثنا عُبَيْدُ اللهِ بْنُ عَبْدِ الْمَجِيدِ، ثنا ابْنُ مَوْهِبٍ، قَالَ: سَمِعْتُ مَالِكَ بْنَ مُحَمَّدِ بْنِ عَبْدِ الرَّحْمَنِ، عَنْ عَمْرَةَ بِنْتِ عَبْدِ الرَّحْمَنِ، عَنْ عَائِشَةَ، رَضِيَ اللهُ عَنْهَا، أَنَّهَا قَالَتْ: وُجِدَ فِي قَائِمِ سَيْفِ رَسُولِ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ كِتَابَانِ فَذَكَرَ أَحَدَهُمَا، قَالَ: وَفِي الْآخَرِ: " الْمُؤْمِنُونَ تَكَافَأُ دِمَاؤُهُمْ، وَيَسْعَى بِذِمَّتِهِمْ أَدْنَاهُمْ، لَا يُقْتَلُ مُسْلِمٌ بِكَافِرٍ، وَلَا ذُو عَهْدٍ فِي عَهْدِهِ، وَلَا يَتَوَارَثُ أَهْلُ مِلَّتَيْنِ، وَلَا تُنْكَحُ الْمَرْأَةُ عَلَى عَمَّتِهَا، وَلَا عَلَى خَالَتِهَا، وَلَا صَلَاةَ بَعْدَ الْعَصْرِ حَتَّى تَغْرُبَ الشَّمْسُ، وَلَا تُسَافِرُ الْمَرْأَةُ ثَلَاثَ لَيَالٍ إِلَّا مَعَ ذِي مَحْرَمٍ ". ابْنُ مَوْهَبٍ هُوَ عُبَيْدُ اللهِ بْنُ عَبْدِ الرَّحْمَنِ بْنِ مَوْهَبٍ، وَمَالِكٌ هُوَ ابْنُ أَبِي الرِّجَالِ، وَأَبُو الرِّجَالِ هُوَ مُحَمَّدُ بْنُ عَبْدِ الرَّحْمَنِ الْأَنْصَارِيُّ، الَّذِي رَوَى عَنْهُ ابْنُهُ مَالِكٌ.
Sayyidah Aishah (may Allah be pleased with her) said that two writings were found in the scabbard of the Prophet (peace and blessings be upon him); (the narrator) mentioned one of them, and in the other was written: "The blood of the believers is equal; the protection granted by the lowest of them is honoured; a Muslim will not be killed in return for a disbeliever, nor one who has a covenant while his covenant lasts; a disbeliever does not inherit from a Muslim, nor a Muslim from a disbeliever. A woman and her paternal aunt, or a woman and her maternal aunt, cannot be combined in one marriage. There is no prayer after Asr until the sun sets. A woman may not travel for three nights without a mahram."
أَخْبَرَنَا أَبُو سَعدٍ الْمَالِينِيُّ، أنبأ أَبُو أَحْمَدَ بْنُ عَدِيٍّ الْحَافِظُ، ثنا عَمْرُو بْنُ سِنَانٍ، ثنا إِبْرَاهِيمُ بْنُ سَعِيدٍ، ثنا أَنَسُ بْنُ عِيَاضٍ، عَنْ عَبْدِ السَّلَامِ بْنِ أَبِي الْجَنُوبِ، عَنِ الْحَسَنِ، عَنْ مَعْقِلِ بْنِ يَسَارٍ، قَالَ: قَالَ رَسُولُ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ: " لَا يُقْتَلُ مُؤْمِنٌ بِكَافِرٍ، وَلَا ذُو عَهْدٍ فِي عَهْدِهِ، وَالْمُسْلِمُونَ يَدٌ عَلَى مَنْ سِوَاهُمْ، تَتَكَافَأُ دِمَاؤُهُمْ ".
Ma'qil bin Yasar (may Allah be pleased with him) said that the Messenger of Allah (peace and blessings be upon him) said: "A believer will not be killed in return for a disbeliever, nor a dhimmi during his covenant; the Muslims are to be helped against those besides them, and their blood is equal."
