Urwah bin al-Zubayr (may Allah have mercy on him) narrated from Sayyidah Aishah (may Allah be pleased with her) that Sayyidah Barirah (may Allah be pleased with her) came to her and said: "O Aishah, I have made a contract of manumission (mukatabah) with my people for seven uqiyyahs, one uqiyyah to be paid each year, so help me." She had not yet paid anything of her contract. Sayyidah Aishah (may Allah be pleased with her), who was keen on her, said: "Go back to your people; if they agree, I will pay them the whole sum at once and your wala' (right of inheritance from the freed slave) will be mine." So Sayyidah Barirah (may Allah be pleased with her) went and put this to her people, but they refused and said: If she wants to do you a kindness seeking reward, let her do so, but your wala' will be ours. Sayyidah Aishah (may Allah be pleased with her) mentioned this to the Messenger of Allah (peace and blessings be upon him), and he (peace and blessings be upon him) said: "Let that not stop you; buy her and set her free, for wala' belongs to the one who sets free." So she did that. The Messenger of Allah (peace and blessings be upon him) stood among the people, praised Allah, and then said: "What is the matter with people who stipulate conditions that are not in the Book of Allah Almighty nor in the Sunnah of His Prophet? Whoever stipulates a condition that is not in the Book of Allah, it is void, even if it be a hundred conditions. Allah's decree is more deserving to be fulfilled and Allah's condition is firmer, and wala' belongs to the one who sets free."
(b) Imam al-Shafi'i (may Allah have mercy on him) said: It has also been narrated from him (peace and blessings be upon him): "The Muslims are bound by their conditions, except a condition that makes the unlawful lawful or the lawful unlawful." And his detailed hadith explains the general one.

It is narrated from Sayyiduna Abu Hurayrah (may Allah be pleased with him) that the Prophet (peace and blessings be upon him) said: "It is not proper for a woman to stipulate the divorce of her sister in order to empty her vessel," that is, to take her provision for herself.

Sa'id bin Ubayd bin al-Sabbaq (may Allah have mercy on him) said that a man married a woman in the time of Sayyiduna Umar (may Allah be pleased with him) and stipulated for her that he would not take her away (from her home). Sayyiduna Umar (may Allah be pleased with him) cancelled that condition and said: The woman is with her husband. The opposite of this has also been reported from Sayyiduna Umar (may Allah be pleased with him).

Abd al-Rahman bin Ghanm (may Allah have mercy on him) said: I was present with Sayyiduna Umar (may Allah be pleased with him) when he was asked about this, and he said: She has her house. A man said to him: O Commander of the Believers, then they (the women) will divorce us! He said: Rights are settled according to the conditions.
The first narration is closer to the Book, the Sunnah and the view of the other Companions (may Allah be pleased with them).

Ata' al-Khurasani (may Allah have mercy on him) said: A man came to Sayyiduna Abdullah bin Abbas (may Allah be pleased with them both) and said: I married a woman on the condition that separation and intercourse would be in her hands. He said: You have gone against the Sunnah and handed the matter to someone not entitled to it; the dowry, separation and intercourse are in your hands. Another man came to him and said: I married a woman and stipulated to her that if I do not bring such-and-such by such-and-such a time, I have no marriage. Ibn Abbas (may Allah be pleased with them both) said: The marriage is valid, but the condition counts for nothing.

Ata' al-Khurasani (may Allah have mercy on him) said that a man married a woman, the woman paid the dowry and stipulated that intercourse and separation would be in her hands. The man was told: You have gone against the Sunnah and handed the right to someone not entitled to it. Sayyiduna Ibn Abbas (may Allah be pleased with them both) ruled that the dowry is upon the man and that intercourse and separation are in the man's hands.
(b) Ata' al-Khurasani (may Allah have mercy on him) said: Sayyiduna Ali (may Allah be pleased with him) and Sayyiduna Ibn Abbas (may Allah be pleased with them both) were asked about a man who married a woman, and the woman stipulated to the man that intercourse and separation would depend on her will and that she would pay the dowry. They said: He has gone against the Sunnah and handed the matter to someone not entitled to it. The dowry is binding on the man, and intercourse and separation are also in the man's hands.
