Book of Lost Property
باب: من قال: اللقيط حر، لا ولاء عليه
Those who said: A foundling is free, and no one has wala over him

لِقَوْلِ النَّبِيِّ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ: " إِنَّمَا الْوَلَاءُ لِمَنْ أَعْتَقَ ".
Because of the saying of the Prophet (peace and blessings be upon him): "Wala' (the right of clientage) belongs only to the one who sets free."
أَخْبَرَنَا أَبُو نَصْرٍ عُمَرُ بْنُ عَبْدِ الْعَزِيزِ بْنِ قَتَادَةَ، أنبأ أَبُو الْحَسَنِ مُحَمَّدُ بْنُ الْحُسَيْنِ بْنِ إِسْمَاعِيلَ السَّرَّاجُ، ثنا أَبُو خَلِيفَةَ، ثنا أَبُو الْوَلِيدِ، وَابْنُ كَثِيرٍ، عَنْ شُعْبَةَ، عَنْ يُونُسَ، عَنِ الْحَسَنِ، عَنْ عَلِيٍّ رَضِيَ اللهُ عَنْهُ أَنَّهُ " قَضَى فِي اللَّقِيطِ أَنَّهُ حُرٌّ، وَقَرَأَ هَذِهِ الْآيَةَ {وَشَرَوْهُ بِثَمَنٍ بَخْسٍ دَرَاهِمَ مَعْدُودَةٍ وَكَانُوا فِيهِ مِنَ الزَّاهِدِينَ} [يوسف: ٢٠] ".
It is narrated from Sayyiduna Ali (may Allah be pleased with him) that he ruled concerning a foundling that he is free, and he recited this verse: "And they sold him for a paltry price, a few counted dirhams, and they had no interest in him (Yusuf)" [Surah Yusuf: 20].
وَأَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ، وَأَبُو سَعِيدِ بْنُ أَبِي عَمْرٍو، قَالَا: ثنا أَبُو الْعَبَّاسِ هُوَ الْأَصَمُّ، ثنا يَحْيَى بْنُ أَبِي طَالِبٍ، ثنا يَزِيدُ بْنُ هَارُونَ، ثنا جُهَيْرُ بْنُ يَزِيدَ الْعَبْدِيُّ قَالَ: سَمِعْتُ الْحَسَنَ وَسُئِلَ عَنِ اللَّقِيطِ: أَيُبَاعُ؟ فَقَالَ: " أَبَى اللهُ ذَلِكَ، أَمَا تَقْرَأُ سُورَةَ يُوسُفَ؟ ".
Juhayr bin Yazid al-Abdi said: I heard al-Hasan (may Allah have mercy on him) when he was asked about a foundling: may he be sold? He said: "Allah has refused that. Have you not read Surah Yusuf?"
