Sayyiduna Usamah bin Zayd (may Allah be pleased with him) said: I said to the Messenger of Allah (peace and blessings be upon him): "O Messenger of Allah (peace and blessings be upon him), will you stay in your house in Makkah?" He (peace and blessings be upon him) said: "Has Aqil left any house for us?" He said: Aqil and Talib had inherited from Abu Talib, while Sayyiduna Ja'far and Ali (may Allah be pleased with them both) did not inherit, because both of them were Muslims while Talib and Aqil were both disbelievers. For this reason Sayyiduna Umar (may Allah be pleased with him) used to say: "A believer does not inherit from a disbeliever."

Sayyiduna Abu Hurayrah (may Allah be pleased with him), regarding the story of the Conquest of Makkah, said that Abu Sufyan (may Allah be pleased with him) came to the Messenger of Allah (peace and blessings be upon him) and said: "O Messenger of Allah, the leaders of Quraysh have been destroyed. After today there will be no Quraysh left." The Messenger of Allah (peace and blessings be upon him) said: "Whoever enters the house of Abu Sufyan will be granted safety, whoever throws down his weapons will also be granted safety, and whoever closes the door of his house will also be safe." The narrator said: The people went into the house of Abu Sufyan and closed the doors of their houses.

Abd al-Rahman bin Farrukh said that Nafi' bin Abd al-Harith (may Allah be pleased with him) bought a prison house from Safwan bin Umayyah (may Allah be pleased with him) to give to Sayyiduna Umar (may Allah be pleased with him). If he approved of it, Nafi' (may Allah be pleased with him) would give Safwan bin Umayyah (may Allah be pleased with him) four hundred. Ibn Uyaynah (may Allah have mercy on him) said: That building is still used as a prison today. Amr bin Dinar (may Allah have mercy on him) was asked: May the houses of Makkah be rented out? He said: There is no harm in it, just as there is no harm in buying them. Sayyiduna Umar (may Allah be pleased with him) bought a house from Safwan bin Umayyah (may Allah be pleased with him) for four thousand dirhams.

Hisham bin Urwah (may Allah have mercy on him) said that Sayyiduna Abdullah bin al-Zubayr (may Allah be pleased with him) prepared houses in Makkah in a way that no one else could. Sayyidah Aishah (may Allah be pleased with her) bequeathed her room to him, and he bought the chamber of Sayyidah Sawdah (may Allah be pleased with her).

Mufaddal bin Ghassan said that al-Zubayri said: Hakim bin Hizam (may Allah be pleased with him) sold Dar al-Nadwah to Sayyiduna Mu'awiyah bin Abi Sufyan (may Allah be pleased with them both) for one hundred thousand. Sayyiduna Abdullah bin al-Zubayr (may Allah be pleased with him) said: O Abu Khalid, you have sold the most honoured possession of Quraysh! He said: O my nephew, let it go; the honour of the Jahiliyyah has gone. Today honour comes only through Islam. Then he said: Bear witness that all these dirhams are charity in the path of Allah.

Sayyiduna Abdullah bin Amr (may Allah be pleased with them both) said that the Messenger of Allah (peace and blessings be upon him) said: "Makkah is a resting place for camels, so its dwellings are not to be sold, nor are its houses to be rented out."
Isma'il bin Ibrahim bin Muhajir is da'if (weak) and his father is not strong. There is disagreement over him: it is narrated from him in this way, and it is also narrated from him, from his father, from Mujahid, from Abdullah bin Amr as marfu' (attributed to the Prophet) with part of its meaning.

Sayyiduna Abdullah bin Amr (may Allah be pleased with them both) said that the Messenger of Allah (peace and blessings be upon him) said: "Makkah is sacred; selling its dwellings is forbidden, and renting out its houses is also forbidden." It has been narrated in this way as marfu' (attributed to the Prophet), but that is a mistake; the correct view is that this hadith is mawquf (the saying of the Companion). Abu Abd al-Rahman al-Sulami told me this from Imam al-Daraqutni.

Sayyiduna Abdullah bin Amr (may Allah be pleased with them both) said: Whoever consumes the rent of the houses of Makkah is only filling his belly with fire.

Alqamah bin Nadlah al-Kinani (may Allah be pleased with him) said: The houses of Makkah used to be called sawa'ib. In the time of the Messenger of Allah (peace and blessings be upon him), Abu Bakr and Umar (may Allah be pleased with them both), they were not sold. Whoever was in need would live in them, and whoever was well-off would give others lodging. This is munqati' (its chain is broken). This report shows the good custom they had of giving people lodging, and someone who knew the affairs of Makkah better than him has reported that inheritance and sale took place there. And Allah knows best.
