Ada' bin Khalid bin Hawdhah (may Allah be pleased with him) said: "Shall I not read to you a letter that the Messenger of Allah (peace and blessings be upon him) wrote for me?" He brought out a letter, and in it was: "This is what Ada' bin Khalid bin Hawdhah bought from Muhammad, the Messenger of Allah (peace and blessings be upon him): a male or a female slave (Abbad was unsure), with no disease, no deceit and no defect; it is the sale of a Muslim to a Muslim."
This hadith is known through Abbad bin al-Layth, and we have recorded it through another route that is not reliable.

Ada' bin Khalid bin Hawdhah (may Allah be pleased with him) said: "Shall I not read to you the letter that the Messenger of Allah (peace and blessings be upon him) wrote for me?" We said: Certainly. In it was written: "In the name of Allah, the Most Gracious, the Most Merciful. This is what Ada' bin Khalid bin Hawdhah bought from Muhammad, the Messenger of Allah (peace and blessings be upon him); he bought from him a male or a female slave." Uthman was unsure. "It is the sale of a Muslim to a Muslim; there is no disease, deceit or defect in it, nor anything unlawful or forbidden."

Abdullah bin al-Mubarak (may Allah have mercy on him) was asked about the hadith of Sharik from Zayd bin Thabit concerning a sale with release (from defects). He said: Sharik answered contrary to what was in his book, and we have not found any basis for this hadith.
The Shaykh said: The most authentic of what has been narrated on this subject is the report that follows.

Salim bin Abdullah (may Allah have mercy on him) said that Sayyiduna Abdullah bin Umar (may Allah be pleased with them both) sold a slave of his for 800 dirhams, and sold him declaring himself free of every defect. The man who had bought the slave from Sayyiduna Abdullah bin Umar (may Allah be pleased with them both) said: The slave has a disease which you did not name. The two took their dispute to Sayyiduna Uthman bin Affan (may Allah be pleased with him). The man said: He sold me a slave who had a disease, and he did not tell me. Sayyiduna Abdullah bin Umar (may Allah be pleased with them both) said: I sold him with a release (from defects). Sayyiduna Uthman (may Allah be pleased with him) required Sayyiduna Abdullah bin Umar (may Allah be pleased with them both) to swear an oath that, at the time he sold the slave, he knew of no disease in him. Sayyiduna Abdullah bin Umar (may Allah be pleased with them both) refused to swear the oath and took the slave back. Later Sayyiduna Abdullah bin Umar (may Allah be pleased with them both) sold that slave for 1,500 dirhams.
Imam Malik (may Allah have mercy on him) said: The agreed position among us is that whoever sells a slave, a slave girl or an animal with a release (from defects) is free of every defect, unless he knowingly concealed a defect. If he knowingly concealed a defect, his release will not benefit him, and what he sold will be returned to him.
Imam al-Shafi'i (may Allah have mercy on him) said concerning a person who sells a slave or an animal with a release from defects: What we follow, and Allah knows best, is the ruling of Sayyiduna Uthman bin Affan (may Allah be pleased with him): that he is free of every defect he did not know of, but not free of a defect he knew of and did not name.

Humayd (may Allah have mercy on him) said that Qadi Shurayh (may Allah have mercy on him) would not grant release from liability for a disease-defect until it had been shown.
Yahya (may Allah have mercy on him) said: (He would say:) I declare release from such-and-such; and even if a disease set in during that interval, they would not be released from it until this defect had been shown to him.
(b) Ibrahim al-Nakha'i (may Allah have mercy on him) said concerning a man who sells his goods and declares himself free of liability for disease-defects: He is free of whatever he named.
(c) Qadi Shurayh (may Allah have mercy on him) said: He is not released until he places his hand on the place of the disease. Ata bin Abi Rabah (may Allah have mercy on him) said the same.
