أَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ، أنا عَبْدُ الرَّحْمَنِ بْنُ حَمْدَانَ الْجَلَّابُ، ثنا مُحَمَّدُ بْنُ الْجَهْمِ، ثنا يَزِيدُ بْنُ هَارُونَ، أنا ابْنُ أَبِي ذِئْبٍ، ح وَأَخْبَرَنَا أَبُو عَلِيٍّ الرُّوذْبَارِيُّ، أنا مُحَمَّدُ بْنُ بَكْرٍ، ثنا أَبُو دَاوُدَ، ثنا أَحْمَدُ بْنُ يُونُسَ، ثنا ابْنُ أَبِي ذِئْبٍ، ح وَأَخْبَرَنَا أَبُو صَالِحٍ ابْنُ بِنْتِ يَحْيَى بْنِ مَنْصُورٍ الْقَاضِي، ثنا جَدِّي، ثنا أَبُو عَلِيٍّ مُحَمَّدُ بْنُ عَمْرٍو كَشْمَرْدُ، أنا الْقَعْنَبِيُّ، ثنا ابْنُ أَبِي ذِئْبٍ، عَنْ مَخْلَدِ بْنِ خُفَافٍ، عَنْ عُرْوَةَ، عَنْ عَائِشَةَ، قَالَتْ: قَالَ ⦗٥٢٥⦘ رَسُولُ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ: " الْخَرَاجُ بِالضَّمَانِ "..
Sayyidah Aishah (may Allah be pleased with her) said that the Messenger of Allah (peace and blessings be upon him) said: "Profit (kharaj) goes with liability."
وَأَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ، أنا أَحْمَدُ بْنُ يَعْقُوبَ الثَّقَفِيُّ، ثنا عُمَرُ بْنُ حَفْصٍ السَّدُوسِيُّ، ثنا عَاصِمُ بْنُ عَلِيٍّ، ثنا ابْنُ أَبِي ذِئْبٍ، فَذَكَرَهُ إِلَّا أَنَّهُ قَالَ: " قَضَى رَسُولُ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ الْخَرَاجَ بِالضَّمَانِ " وَكَذَلِكَ رَوَاهُ يَحْيَى بْنُ سَعِيدٍ الْقَطَّانُ، عَنِ ابْنِ أَبِي ذِئْبٍ، وَاخْتَلَفُوا عَلَى ابْنِ أَبِي ذِئْبٍ فِي قِصَّةِ الْحَدِيثِ.
Ibn Abi Dhi'b mentioned it, except that he said: The Messenger of Allah (peace and blessings be upon him) ruled that "revenue (kharaj) goes with liability."
وَأَخْبَرَنَا أَبُو زَكَرِيَّا بْنُ أَبِي إِسْحَاقَ الْمُزَكِّي، أنا أَبُو عَبْدِ اللهِ مُحَمَّدُ بْنُ يَعْقُوبَ، ثنا مُحَمَّدُ بْنُ عَبْدِ الْوَهَّابِ، ثنا جَعْفَرُ بْنُ عَوْنٍ، أنا ابْنُ أَبِي ذِئْبٍ، عَنْ مَخْلَدِ بْنِ خُفَافٍ، قَالَ: كَانَ بَيْنِي وَبَيْنَ شُرَكَائِي عَبْدٌ فَاقْتَوَيْنَاهُ فِيمَا بَيْنَنَا، قَالَ: وَكَانَ مِنْهُمْ غَائِبٌ فَقَدِمَ فَخَاصَمَنَا إِلَى هِشَامٍ فَقَضَى أَنْ يُرَدَّ الْعَبْدُ وَخَرَاجُهُ، وَقَدْ كَانَ اجْتَمَعَ مِنْ خَرَاجِهِ أَلْفُ دِرْهَمٍ، قَالَ: فَأَتَيْتُ عُرْوَةَ فَأَخْبَرْتُهُ فَأَخْبَرَنِي عُرْوَةُ، عَنْ عَائِشَةَ " أَنَّ رَسُولَ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ قَضَى بِالْخَرَاجِ بِالضَّمَانِ " قَالَ: فَأَتَيْتُ هِشَامًا فَأَخْبَرْتُهُ، قَالَ: فَرَدَّ ذَلِكَ وَأَجَازَهُ، وَبِمَعْنَاهُ رَوَاهُ سُفْيَانُ الثَّوْرِيُّ، عَنِ ابْنِ أَبِي ذِئْبٍ إِلَّا أَنَّهُ لَمْ يُسِمِّ الْأَلْفَ وَلَا هِشَامًا، وَقَالَ: إِلَى بَعْضِ الْقُضَاةِ، وَرَوَاهُ ابْنُ أَبِي فُدَيْكٍ، عَنِ ابْنِ أَبِي ذِئْبٍ وَسَمَّاهُمَا.
Makhlad bin Khufaf (may Allah have mercy on him) said: My partners and I jointly owned a slave, and we set a price on him among ourselves. One of them was absent; when he came, we took the dispute to Hisham. He ruled that the slave be returned along with his earnings, and a thousand dirhams had already accumulated from his earnings. Makhlad bin Khufaf (may Allah have mercy on him) said: I came to Urwah (may Allah have mercy on him), and he narrated a hadith from Sayyidah Aishah (may Allah be pleased with her) that she said: The Messenger of Allah (peace and blessings be upon him) ruled "profit in return for liability." I came to Hisham, and he withdrew his ruling and corrected it.
وَأَخْبَرَنَا أَبُو بَكْرٍ مُحَمَّدُ بْنُ الْحَسَنِ بْنِ فُورَكٍ، أنا عَبْدُ اللهِ بْنُ جَعْفَرٍ، ثنا يُونُسُ بْنُ حَبِيبٍ، ثنا أَبُو دَاوُدَ الطَّيَالِسِيُّ، ثنا ابْنُ أَبِي ذِئْبٍ، عَنْ مَخْلَدِ بْنِ خُفَافٍ الْغِفَارِيِّ، قَالَ: خَاصَمْتُ إِلَى عُمَرَ بْنِ عَبْدِ الْعَزِيزِ فِي عَبْدٍ دَلَّسَ لَنَا فَأَصَبْنَا مِنْ غَلَّتِهِ وَعِنْدَهُ عُرْوَةُ بْنُ الزُّبَيْرِ فَحَدَّثَهُ عُرْوَةُ، عَنْ عَائِشَةَ " أَنَّ رَسُولَ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ قَضَى أَنَّ الْخَرَاجَ بِالضَّمَانِ " وَبِهَذَا الْمَعْنَى رَوَاهُ الشَّافِعِيُّ عَمَّنْ لَا يُتَّهَمُ مِنْ أَهْلِ الْمَدِينَةِ، عَنِ ابْنِ أَبِي ذِئْبٍ.
Makhlad bin Khufaf al-Ghifari (may Allah have mercy on him) said: I took a dispute to Umar bin Abd al-Aziz (may Allah have mercy on him) concerning a slave whose defect had been concealed from us, and we had taken some of his earnings. Urwah bin al-Zubayr (may Allah have mercy on him) was with him, and Urwah (may Allah have mercy on him) narrated from Sayyidah Aishah (may Allah be pleased with her) that "The Messenger of Allah (peace and blessings be upon him) ruled that revenue (kharaj) goes with liability."
أَخْبَرَنَا أَبُو زَكَرِيَّا بْنُ أَبِي إِسْحَاقَ الْمُزَكِّي، فِي آخَرِينَ، قَالُوا: ثنا أَبُو الْعَبَّاسِ مُحَمَّدُ بْنُ يَعْقُوبَ، أنا الرَّبِيعُ بْنُ سُلَيْمَانَ، أنا الشَّافِعِيُّ، أَخْبَرَنِي مَنْ لَا أَتَّهِمُ عَنِ ابْنِ أَبِي ذِئْبٍ، قَالَ: أَخْبَرَنِي مَخْلَدُ بْنُ خُفَافٍ، قَالَ: ابْتَعْتُ غُلَامًا فَاسْتَغْلَلْتُهُ ثُمَّ ظَهَرْتُ مِنْهُ عَلَى عَيْبٍ فَخَاصَمْتُ فِيهِ إِلَى عُمَرَ بْنِ عَبْدِ الْعَزِيزِ فَقَضَى لِي بِرَدِّهِ، وَقَضَى عَلَيَّ بِرَدِّ غَلَّتِهِ فَأَتَيْتُ عُرْوَةَ فَأَخْبَرْتُهُ، فَقَالَ: أَرُوحُ إِلَيْهِ الْعَشِيَّةَ فَأُخْبِرُهُ أَنَّ عَائِشَةَ رَضِيَ اللهُ عَنْهَا أَخْبَرَتْنِي " أَنَّ رَسُولَ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ قَضَى فِي مِثْلِ هَذَا أَنَّ الْخَرَاجَ بِالضَّمَانِ ". فَعَجَّلْتُ إِلَى عُمَرَ فَأَخْبَرْتُهُ مَا أَخْبَرَنِي عُرْوَةُ، عَنْ ⦗٥٢٦⦘ عَائِشَةَ، عَنْ رَسُولِ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ، فَقَالَ عُمَرُ: فَمَا أَيْسَرَ عَلَيَّ مِنْ قَضَاءٍ قَضَيْتُهُ اللهُ يَعْلَمُ أَنِّي لَمْ أُرِدْ فِيهِ إِلَّا الْحَقَّ فَبَلَغَتْنِي فِيهِ سُنَّةٌ عَنْ رَسُولِ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ فَأَرُدُّ قَضَاءَ عُمَرَ وَأُنَفِّذُ سُنَّةَ رَسُولِ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ، فَرَاحَ إِلَيْهِ عُرْوَةُ فَقَضَى لِي أَنْ آخُذَ الْخَرَاجَ مِنَ الَّذِي قَضَى بِهِ عَلَيَّ لَهُ.
Makhlad bin Khufaf (may Allah have mercy on him) said: I bought a slave and took earnings from him; then I discovered a defect in him. I took the dispute to Umar bin Abd al-Aziz (may Allah have mercy on him); he ruled that the slave be returned, and he ruled that I must return his earnings. I came and informed Urwah (may Allah have mercy on him), and he said: I will go to him this evening and tell him that Sayyidah Aishah (may Allah be pleased with her) told me that the Messenger of Allah (peace and blessings be upon him) ruled in a case like this: "Revenue (kharaj) goes with liability." I hurried to Umar (may Allah have mercy on him) and told him what Urwah (may Allah have mercy on him) had told me from Sayyidah Aishah (may Allah be pleased with her) from the Messenger of Allah (peace and blessings be upon him). Umar (may Allah have mercy on him) said: How easy it is for me to change a ruling I have made! Allah knows that I intended nothing but the truth in it, and now a Sunnah of the Messenger of Allah (peace and blessings be upon him) has reached me about it, so I reverse the ruling of Umar and implement the Sunnah of the Messenger of Allah (peace and blessings be upon him). Urwah (may Allah have mercy on him) went to him, and he ruled for me that I take back the revenue from the one in whose favour he had ruled it against me.
أَخْبَرَنَاهُ أَبُو سَعْدٍ الْمَالِينِيُّ، أنا أَبُو أَحْمَدَ عَبْدُ اللهِ بْنُ عَدِيٍّ الْحَافِظُ، ثنا عَبْدَانُ، ثنا يَحْيَى بْنُ خَلَفٍ، ثنا عُمَرُ بْنُ عَلِيٍّ، عَنْ هِشَامِ بْنِ عُرْوَةَ، عَنْ أَبِيهِ، عَنْ عَائِشَةَ " أَنَّ رَسُولَ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ قَضَى أَنَّ الْخَرَاجَ بِالضَّمَانِ ".
Sayyidah Aishah (may Allah be pleased with her) said that the Messenger of Allah (peace and blessings be upon him) ruled that "revenue (kharaj) goes with liability."
أَخْبَرَنَا أَبُو عَبْدِ الرَّحْمَنِ السُّلَمِيُّ، أنا أَبُو الْحَسَنِ مُحَمَّدُ بْنُ مُحَمَّدِ بْنِ الْحَسَنِ الْكَارِزِيُّ، ثنا عَلِيُّ بْنُ عَبْدِ الْعَزِيزِ، ثنا أَبُو عُبَيْدٍ، ثنا هُشَيْمٌ، أنا الشَّيْبَانِيُّ، عَنِ الشَّعْبِيِّ، أَنَّ رَجُلًا اشْتَرَى مِنْ رَجُلٍ غُلَامًا فَأَصَابَ مِنْ غَلَّتِهِ ثُمَّ وَجَدَ بِهِ دَاءً كَانَ عِنْدَ الْبَائِعِ فَخَاصَمَهُ إِلَى شُرَيْحٍ، فَقَالَ: " رُدَّ الدَّاءَ بِدَائِهِ، وَلَكَ الْغَلَّةُ بِالضَّمَانِ ".
Imam al-Sha'bi (may Allah have mercy on him) said: A man bought a slave from someone and also took earnings from him; then he found in him a disease that had already existed while he was with the seller. They took the dispute to Qadi Shurayh, and he said: He is to be returned because of the disease, and the earnings are yours in return for the liability.
