أَخْبَرَنَا أَبُو ذَرٍّ مُحَمَّدُ بْنُ أَبِي الْحُسَيْنِ بْنِ أَبِي الْقَاسِمِ الْمُذَكِّرُ، ثنا أَبُو عَبْدِ اللهِ مُحَمَّدُ بْنُ يَعْقُوبَ الشَّيْبَانِيُّ، ثنا إِبْرَاهِيمُ بْنُ عَبْدِ اللهِ السَّعْدِيُّ، ثنا مُحَمَّدُ بْنُ عُبَيْدٍ، ثنا عُبَيْدُ اللهِ، عَنْ نَافِعٍ، عَنِ ابْنِ عُمَرَ أَنَّ رَسُولَ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ فَرَضَ زَكَاةَ الْفِطْرِ صَاعًا مِنْ تَمْرٍ وَصَاعًا مِنْ شَعِيرٍ عَلَى كُلِّ حُرٍّ وَعَبْدٍ صَغِيرٍ أَوْ كَبِيرٍ أَخْرَجَهُ الْبُخَارِيُّ وَمُسْلِمٌ فِي الصَّحِيحِ مِنْ حَدِيثِ عُبَيْدِ اللهِ بْنِ عُمَرَ.
Sayyiduna Abdullah bin Umar (may Allah be pleased with them both) said that the Messenger of Allah (peace and blessings be upon him) "prescribed sadaqat al-fitr as one sa' of dates or barley, upon every free person and slave, old and young."
وَأَمَّا الَّذِي رُوِيَ عَنْ قَيْسِ بْنِ سَعْدٍ فِي ذَلِكَ: فَأَخْبَرَنَاهُ أَبُو طَاهِرٍ الْفَقِيهُ، أنبأ أَبُو عُثْمَانَ عَمْرُو بْنُ عَبْدِ اللهِ الْبَصْرِيُّ، ثنا أَبُو أَحْمَدَ مُحَمَّدُ بْنُ عَبْدِ الْوَهَّابِ أنبأ يَعْلَى بْنُ عُبَيْدٍ، ثنا سُفْيَانُ، عَنْ سَلَمَةَ بْنِ كُهَيْلٍ، عَنِ الْقَاسِمِ بْنِ مُخَيْمِرَةَ، عَنْ أَبِي عَمَّارٍ، قَالَ: سَأَلْنَا قَيْسَ بْنَ سَعْدٍ عَنْ صَدَقَةِ الْفِطْرِ، فَقَالَ: " أَمَرَنَا بِهَا رَسُولُ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ قَبْلَ أَنْ تَنْزِلَ الزَّكَاةُ، فَلَمَّا نَزَلَتِ الزَّكَاةُ لَمْ يَأْمُرْنَا وَلَمْ يَنْهَنَا وَنَحْنُ نَفْعَلُهُ ". قَالَ الشَّيْخُ: وَهَذَا لَا يَدُلُّ عَلَى سُقُوطِ فَرْضِهَا؛ لِأَنَّ نُزُولَ فَرْضٍ لَا يُوجِبُ سُقُوطَ آخَرَ وَقَدْ أَجْمَعَ أَهْلُ الْعِلْمِ عَلَى وُجُوبِ زَكَاةِ الْفِطْرِ وَإِنِ اخْتَلَفُوا فِي تَسْمِيَتِهَا فَرْضًا فَلَا يَجُوزُ تَرْكُهَا وَبِاللهِ التَّوْفِيقُ.
Abu Ammar (may Allah have mercy on him) said: We asked Sayyiduna Qays bin Sa'd (may Allah be pleased with him) about sadaqat al-fitr, and he said: The Messenger of Allah (peace and blessings be upon him) commanded us (to give) it before the obligation of zakah was revealed; when the obligation of zakah was revealed, he (peace and blessings be upon him) neither commanded us nor forbade us, but we used to give it.
The Shaykh said: This does not indicate that its obligation was dropped, because the revelation of one obligation does not necessitate the dropping of another. The people of knowledge have agreed by consensus that sadaqat al-fitr is obligatory, even though they differed over calling it fard; so it is not permissible to abandon it.
