أَخْبَرَنَا أَبُو عَمْرٍو مُحَمَّدُ بْنُ عَبْدِ اللهِ الْبِسْطَامِيُّ الْأَدِيبُ، أنبأ أَبُو بَكْرٍ ⦗١٧٧⦘ الْإِسْمَاعِيلِيُّ، أَخْبَرَنِي الْحَسَنُ بْنُ سُفْيَانَ، ثنا مُحَمَّدُ بْنُ خَلَّادٍ الْبَاهِلِيُّ، وَمُحَمَّدُ بْنُ الْمُثَنَّى، قَالَا: ثنا مُحَمَّدُ بْنُ عَبْدِ اللهِ الْأَنْصَارِيُّ، حَدَّثَنِي أَبِي، حَدَّثَنِي ثُمَامَةُ، أَنَّ أَنَسًا حَدَّثَهُ، أَنَّ أَبَا بَكْرٍ رَضِيَ اللهُ عَنْهُ كَتَبَ لَهُ: هَذِهِ فَرِيضَةُ الصَّدَقَةِ الَّتِي فَرَضَ رَسُولُ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ عَلَى الْمُسْلِمِينَ. فَذَكَرَ الْحَدِيثَ وَفِيهِ: " لَا يُجْمَعُ بَيْنَ مُتَفَرِّقٍ وَلَا يُفَرَّقُ بَيْنَ مُجْتَمِعٍ خَشْيَةَ الصَّدَقَةِ وَمَا كَانَ مِنْ خَلِيطَيْنِ فَإِنَّهُمَا يَتَرَاجَعَانِ بَيْنَهُمَا بِالسَّوِيَّةِ " رَوَاهُ الْبُخَارِيُّ فِي الصَّحِيحِ عَنْ مُحَمَّدِ بْنِ عَبْدِ اللهِ الْأَنْصَارِيِّ. قَالَ الْبُخَارِيُّ فِي التَّرْجَمَةِ: وَيُذْكَرُ عَنْ سَالِمٍ عَنِ ابْنِ عُمَرَ عَنِ النَّبِيِّ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ مِثْلُهُ.
Sayyiduna Anas (may Allah be pleased with him) said that Sayyiduna Abu Bakr al-Siddiq (may Allah be pleased with him) wrote for him: This is the obligation of zakah which the Messenger of Allah (peace and blessings be upon him) prescribed for the Muslims. Then he narrated the whole hadith, in which there is also: "Those grazing separately are not to be combined, and those grazing together are not to be separated, for fear of zakah; and those who are partners will settle between themselves equally."
أَخْبَرَنَاهُ أَبُو عَلِيٍّ الرُّذْبَارِيُّ، أنبأ مُحَمَّدُ بْنُ بَكْرٍ، أنبأ أَبُو دَاوُدَ، ثنا عَبْدُ اللهِ بْنُ مُحَمَّدٍ النُّفَيْلِيُّ، ثنا عَبَّادُ بْنُ الْعَوَّامِ، عَنْ سُفْيَانَ بْنِ حُسَيْنٍ، عَنِ الزُّهْرِيِّ، عَنْ سَالِمٍ، عَنْ أَبِيهِ قَالَ: كَتَبَ رَسُولُ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ كِتَابَ الصَّدَقَةِ فَلَمْ يُخْرِجْهُ إِلَى عُمَّالِهِ حَتَّى قُبِضَ، فَقَرَنَهُ بِسَيْفِهِ فَعَمِلَ بِهِ أَبُو بَكْرٍ حَتَّى قُبِضَ، ثُمَّ عَمِلَ بِهِ عُمَرُ حَتَّى قُبِضَ فَكَانَ فِيهِ. فَذَكَرَ الْحَدِيثَ فِي صَدَقَةِ الْإِبِلِ وَصَدَقَةِ الْغَنَمِ وَقَالَ: " وَلَا يُفَرَّقُ بَيْنَ مُجْتَمِعٍ وَلَا يُجْمَعُ بَيْنَ مُتَفَرِّقٍ مَخَافَةَ الصَّدَقَةِ وَمَا كَانَ مِنْ خَلِيطَيْنِ فَإِنَّهُمَا يَتَرَاجَعَانِ بِالسَّوِيَّةِ " وَرُوِّينَاهُ فِي حَدِيثِ عَمْرِو بْنِ حَزْمٍ..
Imam al-Zuhri narrates from Salim (may Allah have mercy on him), and he from his father (Sayyiduna Abdullah bin Umar, may Allah be pleased with them both), that the Messenger of Allah (peace and blessings be upon him) wrote down the scale of zakah but had not yet sent it out to his governors when he (peace and blessings be upon him) passed away, so the document was tied to his (peace and blessings be upon him) sword. Sayyiduna Abu Bakr (may Allah be pleased with him) implemented it until he passed away, then Sayyiduna Umar (may Allah be pleased with him) acted upon it until he too passed away. He narrated the hadith on the zakah of camels and also of sheep, and said: "Those grazing together are not to be separated, and those grazing separately are not to be combined, for fear of zakah; and those who are partners will settle equally between themselves."
وَأَخْبَرَنَا أَبُو نَصْرِ بْنُ قَتَادَةَ الْأَنْصَارِيُّ، أنبأ أَبُو الْحَسَنِ بْنُ عَبْدَةَ، ثنا أَبُو عَبْدِ اللهِ الْبُوشَنْجِيُّ، حَدَّثَنِي النُّفَيْلِيُّ أَبُو جَعْفَرٍ، ثنا زُهَيْرُ بْنُ مُعَاوِيَةَ، ثنا أَبُو إِسْحَاقَ، عَنْ عَاصِمِ بْنِ ضَمْرَةَ، وَعَنِ الْحَارِثِ الْأَعْوَرِ، عَنْ عَلِيِّ بْنِ أَبِي طَالِبٍ رَضِيَ اللهُ عَنْهُ قَالَ زُهَيْرٌ أَحْسِبُهُ عَنْ رَسُولِ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ، فَذَكَرَ الْحَدِيثَ فِي زَكَاةِ الْوَرِقِ وَالْغَنَمِ وَالْإِبِلِ إِلَى أَنْ قَالَ: " فَإِذَا ⦗١٧٨⦘ زَادَتْ وَاحِدَةً يَعْنِي عَلَى التِّسْعِينَ فَفِيهَا حِقَّتَانِ طَرُوقَتَا الْجَمَلِ إِلَى عِشْرِينَ وَمِائَةٍ، فَإِذَا كَانَتِ الْإِبِلُ أَكْثَرَ مِنْ ذَلِكَ فَفِي كُلِّ خَمْسِينَ حِقَّةٌ وَفِي كُلِّ أَرْبَعِينَ كَذَا وَلَا يُفَرَّقُ بَيْنَ مُجْتَمِعٍ وَلَا يُجْمَعُ بَيْنَ مُتَفَرِّقٍ خَشْيَةَ الصَّدَقَةِ ".
Sayyiduna Ali bin Abi Talib (may Allah be pleased with him) said (Zuhayr said: I think he narrates it from the Prophet (peace and blessings be upon him)), and he narrated the hadith, mentioning the zakah of silver, sheep and camels, and said: "If they exceed ninety by even one, there are two hiqqahs in them, ready to be mounted by the stud, up to one hundred and twenty. If the camels are more than that, then in every fifty there is a hiqqah, and in every forty such-and-such. And those grazing together are not to be separated, and those grazing separately are not to be combined, for fear of zakah."
أَخْبَرَنَا أَبُو عَلِيٍّ الرُّذْبَارِيُّ، أنبأ مُحَمَّدُ بْنُ بَكْرٍ، ثنا أَبُو دَاوُدَ، ثنا مُحَمَّدُ بْنُ الصَّبَّاحِ الْبَزَّازُ، ثنا شَرِيكٌ، عَنْ عُثْمَانَ بْنِ أَبِي زُرْعَةَ، عَنْ أَبِي لَيْلَى الْكِنْدِيِّ، عَنْ سُوَيْدِ بْنِ غَفَلَةَ، قَالَ: أَتَانَا مُصَدِّقُ النَّبِيِّ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ فَأَخَذْتُ بِيَدِهِ وَقَرَأْتُ فِي عَهْدِهِ قَالَ: " وَلَا يُجْمَعُ بَيْنَ مُتَفَرِّقٍ وَلَا يُفَرَّقُ بَيْنَ مُجْتَمِعٍ خَشْيَةَ الصَّدَقَةِ ".
Suwayd bin Ghafalah (may Allah have mercy on him) said: The zakah collector of the beloved Prophet (peace and blessings be upon him) came to us. I took him by the hand and read in his written document: "Those (animals) that are separate shall not be combined, nor shall those that are combined be separated, out of fear of zakah."
أَخْبَرَنَا أَبُو الْحُسَيْنِ عَلِيُّ بْنُ مُحَمَّدِ بْنِ عَبْدِ اللهِ بْنِ بِشْرَانَ، أنبأ إِسْمَاعِيلُ بْنُ مُحَمَّدٍ الصَّفَّارُ، ثنا مُحَمَّدُ بْنُ إِسْحَاقَ، ثنا أَبُو الْأَسْوَدِ، ثنا ابْنُ لَهِيعَةَ، عَنْ يَحْيَى بْنِ سَعِيدٍ، قَالَ: سَمِعْتُ السَّائِبَ بْنَ يَزِيدَ يَقُولُ: صَحِبْتُ سَعْدَ بْنَ أَبِي وَقَّاصٍ زَمَانًا فَلَمْ أَسْمَعْهُ يُحَدِّثُ عَنْ رَسُولِ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ إِلَّا حَدِيثًا وَاحِدًا، يَقُولُ: قَالَ رَسُولُ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ: " لَا يُفَرَّقُ بَيْنَ مُجْتَمِعٍ وَلَا يُجْمَعُ بَيْنَ مُتَفَرِّقٍ فِي الصَّدَقَةِ وَالْخَلِيطَانِ مَا اجْتَمَعَ عَلَى الْفَحْلِ وَالرَّاعِي وَالْحَوْضِ ".
Sayyiduna al-Sa'ib bin Yazid (may Allah be pleased with him) said: I stayed in the company of Sayyiduna Sa'd bin Abi Waqqas (may Allah be pleased with him) for a period of time, and I heard only one hadith from him which he narrated from the Messenger of Allah (peace and blessings be upon him), that he (peace and blessings be upon him) said: "What is combined shall not be separated, and what is separate shall not be combined, in zakah. And 'partners' are those (whose animals) come together on the stud male, the trough and the shepherd."
أَخْبَرَنَا أَبُو بَكْرٍ أَحْمَدُ بْنُ الْحَسَنِ الْقَاضِي وَغَيْرُهُ، قَالَا ثنا أَبُو الْعَبَّاسِ مُحَمَّدُ بْنُ يَعْقُوبَ، ثنا السَّرِيُّ بْنُ يَحْيَى، ثنا قَبِيصَةُ، عَنْ سُفْيَانَ، عَنْ عُبَيْدِ اللهِ، عَنْ نَافِعٍ، عَنِ ابْنِ عُمَرَ قَالَ: " مَا كَانَ مِنْ خَلِيطَيْنِ فَإِنَّهُمَا يَتَرَاجَعَانِ بِالسَّوِيَّةِ " قَالَ سُفْيَانُ: قُلْتُ لِعُبَيْدِ اللهِ مَا يَعْنِي بِالْخَلِيطَيْنِ؟ قَالَ: إِذَا كَانَ الْمُرَاحُ وَاحِدًا وَالرَّاعِي وَاحِدًا وَالدَّلْوُ وَاحِدًا.
Nafi' narrates from Sayyiduna Ibn Umar (may Allah be pleased with them both): "Those who are partners shall settle the zakah share between themselves equally." Sufyan said: I said to Ubaydullah: What is meant by al-khalitayn (the two partners)? He said: Those whose pen is one, whose shepherd is one and whose bucket is also one.
أَخْبَرَنَا أَبُو الْحُسَيْنِ بْنُ الْفَضْلِ الْقَطَّانُ، بِبَغْدَادَ أنبأ عَبْدُ اللهِ بْنُ جَعْفَرٍ، ثنا يَعْقُوبُ بْنُ سُفْيَانَ، ثنا الْحَجَّاجُ بْنُ الْمِنْهَالِ، ثنا حَمَّادٌ، عَنْ حُمَيْدٍ قَالَ: قَدِمَ الْحَسَنُ مَكَّةَ، فَسَأَلُوهُ عَنْ أَرْبَعِينَ شَاةً بَيْنَ رَجُلَيْنِ قَالَ: " فِيهَا شَاةٌ ".
Humayd narrated that al-Hasan (may Allah have mercy on him) came to Makkah, and they asked him about forty goats belonging to two men. He said: There is one goat (due) on them.
أَخْبَرَنَا أَبُو بَكْرِ بْنُ الْحَارِثِ الْفَقِيهُ، أنبأ عَلِيُّ بْنُ عُمَرَ الْحَافِظُ، ثنا أَبُو بَكْرٍ النَّيْسَابُورِيُّ، ثنا أَبُو الْأَزْهَرِ، ثنا عَبْدُ الرَّزَّاقِ، أنبأ ابْنُ جُرَيْجٍ، قَالَ سَأَلْتُ عَطَاءً عَنِ النَّفَرِ الْخُلَطَاءِ لَهُمْ أَرْبَعُونَ شَاةً، قَالَ: " عَلَيْهِمْ شَاةٌ "، قُلْتُ: فَإِنْ كَانَتْ لِوَاحِدٍ تِسْعٌ وَثَلَاثُونَ وَلِآخَرَ شَاةٌ قَالَ: " عَلَيْهِمَا شَاةٌ ".
Ibn Jurayj (may Allah have mercy on him) said: I asked Ata' (may Allah have mercy on him) about a group of partners who have forty goats in common. He said: There is one goat (due) on them. He said: I said: What if one of them has thirty-nine and the other has one goat? He said: There is only one goat (due) on the two of them.
