Bayhaqi 9990 — A man who shoots an arrow at game and hits

Abd al-Salam (may Allah have mercy on him) said: I asked Imam al-Awza'i (may Allah have mercy on him) about a man who sends his dog after game in the area outside the sanctuary (al-hill); the game enters the sanctuary, the dog chases it, brings it out to al-hill and kills it. He said: I have nothing on it; I dislike forcing an opinion. I said: O Abu Amr, say something about it. He said: I do not like eating it, and I do not think he owes compensation for it. Abd al-Salam said: Hajj became possible for me that same year, so I met Ibn Jurayj and asked him about it. He said: I heard Ata bin Abi Rabah report that Ibn Abbas (may Allah be pleased with them both) was asked about it, and he said: "I do not like eating it, and I do not think he owes compensation for it."
The Shaykh said: Likewise al-Shafi'i (may Allah have mercy on him) said about the one who sends it (his dog) after game from al-hill while in al-hill, and the game struggles on and enters the sanctuary, and the dog kills it there: the compensation does not apply to him and he does not eat it. And he distinguished between the dog and the arrow, which passes on and strikes it or something else within the sanctuary.
