وَبِإِسْنَادِهِ ثنا مَالِكٌ، أَنَّهُ بَلَغَهُ أَنَّ سَعِيدَ بْنَ الْمُسَيِّبِ قَالَ فِي رَجُلٍ هَلَكَ وَتَرَكَ بَنِينَ ثَلَاثَةً، وَتَرَكَ مَوَالِيَ أَعْتَقَهُمْ هُوَ عَتَاقَةً، ثُمَّ إِنَّ رَجُلَيْنِ مِنْ بَنِيهِ هَلَكَا وَتَرَكَا وَلَدًا، قَالَ سَعِيدٌ: " يَرِثُ الْمَوَالِي الْبَاقِيَ مِنَ الثَّلَاثَةِ، فَإِذَا هَلَكَ فَوَلَدُهُ وَوَلَدَا إِخْوَتِهِ فِي الْمَوَالِي شَرْعًا سَوَاءٌ ". وَقَدْ رُوِيَ فِيهِ حَدِيثٌ مُرْسَلٌ، يُؤَكِّدُ مَا مَضَى مِنَ الْآثَارِ..
Imam Malik (may Allah have mercy on him) said that it reached him that Sa'id bin al-Musayyib (may Allah have mercy on him) said, concerning a man who died and left three sons and slaves whom he had freed, and then two men among his children (i.e. sons) died and left a child: Sa'id bin al-Musayyib (may Allah have mercy on him) said that the remaining (son) will inherit those freed slaves; then when he dies, his children and his brothers' children will share equally in those freed slaves.
