باب: : ما جاء في الغلام يشهد قبل أن يبلغ، والعبد قبل أن يعتق، والكافر قبل أن يسلم، ثم بلغ الصبي، وعتق العبد، وأسلم الكافر، وكانوا عدولا، فشهدوا بها
Chapter: Reports on a boy who witnessed before reaching puberty, a slave before being freed and a disbeliever before accepting Islam, then the boy came of age, the slave was freed and the disbeliever accepted Islam, and being upright they testified to it

أَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ، أنبأ أَبُو الْوَلِيدِ الْفَقِيهُ، ثنا الْحَسَنُ بْنُ سُفْيَانَ، ثنا أَبُو بَكْرٍ هُوَ ابْنُ أَبِي شَيْبَةَ قَالَ: ثنا مُعَاذُ بْنُ هِشَامٍ، عَنِ الْأَشْعَثِ، عَنِ الْحَسَنِ، أَنَّهُ كَانَ يَقُولُ فِي الْعَبْدِ وَالذِّمِّي إِذَا شَهِدَا: رُدَّتْ شَهَادَتُهُمَا، ثُمَّ أعْتَقَ هَذَا، وَأَسْلَمَ هَذَا أَنَّهُمَا تَجُوزُ شَهَادَتُهُمَا ". ⦗٤٢٣⦘.
Al-Hasan (may Allah have mercy on him) said that the testimony of a slave and of a dhimmi is rejected; but if the slave is freed and the dhimmi accepts Islam, then their testimony is permissible.
