Bayhaqi 18201 — A man who steals from the war booty after taking part

Sayyiduna Abdullah bin Abbas (may Allah be pleased with them both) said: A slave from among the slaves of the khumus (the one-fifth share) stole some of the khumus property. The matter was brought to the Prophet (peace and blessings be upon him), and he (peace and blessings be upon him) did not cut off his hand, and said: "It is the property of Allah; part of it has stolen another part." (b) Sayyiduna Ali bin Abi Talib (may Allah be pleased with him) narrated that a man stole a helmet from the spoils of war, and he did not cut off his hand.
This chain has weakness in it; it has also been narrated through another route from Maymun bin Mihran from the Prophet (peace and blessings be upon him) as mursal.
