وَأَخْبَرَنَا أَبُو مُحَمَّدٍ عَبْدُ اللهِ بْنُ يَحْيَى بْنِ عَبْدِ الْجَبَّارِ السُّكَّرِيُّ، بِبَغْدَادَ، أنبأ إِسْمَاعِيلُ بْنُ مُحَمَّدٍ الصَّفَّارُ، ثنا أَحْمَدُ بْنُ مَنْصُورٍ، ثنا عَبْدُ الرَّزَّاقِ، أنبأ مَعْمَرٌ، عَنْ لَيْثٍ، عَنْ مُجَاهِدٍ، أَنَّ عُمَرَ بْنَ الْخَطَّابِ، رَضِيَ اللهُ عَنْهُ، قَضَى فِيمَنْ قَتَلَ فِي الْحَرَمِ أَوْ فِي الشَّهْرِ الْحَرَامِ أَوْ هُوَ مُحْرِمٌ بِالدِّيَةِ وَثُلُثِ الدِّيَةِ.
Mujahid (may Allah have mercy on him) narrated that Sayyiduna Umar bin al-Khattab (may Allah be pleased with him) ruled that for one who kills in the Haram, or in a sacred month, or while in ihram, the full diyah plus a third of the diyah is due.
